A. 
It shall be unlawful for any person to place or cause to be placed any structure, merchandise, equipment, sign or other object projecting beyond the building line into or over any sidewalk, public street or highway, within the limits of the Borough of Chatham without a sidewalk encumbrance permit issued by the Clerk of the Borough of Chatham and subject to the terms set forth herein.
B. 
The Borough Clerk shall review each application for a sidewalk encumbrance permit. The Borough Clerk, upon the recommendation of the Borough Engineer, shall approve or deny the application, taking into account all factors which it may deem relevant including within 10 days.
C. 
Any applicant who is denied a sidewalk encumbrance permit may, in writing, request a hearing on said denial before the Borough Administrator.
The lowest fabric portions of any table umbrellas, awnings or other overhead shade or rain protection must be at least seven feet above the sidewalk or walking surface, and the lowest rigid portion or framework supporting any table umbrellas, awnings or other overhead shade or rain protection must be at least 7 1/2 feet above the sidewalk or walking surface.
In the event a person fails to remove any structure, merchandise, equipment, sign or other object erected or maintained in violation of this article within five days written notice thereof, the Borough Engineer may remove such any structure, merchandise, equipment, sign or other object and collect the cost of such removal, together with the penalty imposed by this chapter, from the person constructing or maintaining same.
The annual fee for a sidewalk encumbrance permit shall be set from time to time by duly adopted resolution of the Borough Council.
A. 
The provisions of this article shall not apply to loading, unloading, moving, or transportation of such merchandise, equipment, or other objects.
B. 
In case of an emergency, the Chief of Police may grant permission to permit a sidewalk encumbrance for such period as may be reasonable under the circumstances.
No person shall ride or operate a bicycle, skateboard, scooter, skates, or similar apparatus upon the sidewalks within the central business district of the Borough, as defined in Chapter 165, Land Development Regulations, provided that this section shall not apply to the use of such apparatus by children under 10 years of age, nor to children's carriers, nor to the use of such apparatus by persons with disabilities.
