Any noise caused by the following activities shall not be a
violation of this chapter:
A. The sounding of place of worship or school bells and chimes, train
signals, sirens or other sound devices operated by any public safety
officer or agency, or amplifying devices used in connection with athletic
games or contests scheduled by a school, college or other educational
institution located in the Borough. However, no such instrument or
device shall be operated for any commercial or advertising purpose
or in such a manner as to become a nuisance.
B. Parades, political rallies, community events or any other activities
for which a special event permit has been granted if the event or
activity is located in a Commercial District, Mixed Use District,
Industrial District or the Riverfront Sub-Districts.
C. Live music from restaurants, brew pubs, clubs, lodges, community
centers, places of assembly, tap rooms, and theaters if the performance
occurs between 12:00 p.m. to 10:00 p.m. on Sunday through Thursday,
or 12:00 p.m. to 11:00 p.m. on Friday and Saturday.
D. Any sound or noise created by a single stationary source or device
upon any real or personal property if the sound is not unreasonably
loud when heard at a distance of 50 feet from the sound emitter.
This chapter shall be enforced by the Borough of Millvale Police
Department.
Any person, firm or corporation violating any of the provisions
of this chapter shall, upon conviction thereof, be sentenced to pay
a fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30
days, provided that each day's violation shall constitute a separate
offense and notice to the offender shall not be necessary in order
to constitute an offense. In the event that such claims for fines
and penalties exceed the monetary jurisdiction of a Magisterial District
Judge as set forth in the Pennsylvania Judicial Code (relating to
jurisdiction and venue), exclusive of interest, costs or other fees,
the Borough may bring such action in the Court of Common Pleas or
may, pursuant to the Pennsylvania Judicial Code, waive that portion
of fines or penalties that exceeds the monetary jurisdictional limits
so as to bring the matter within the monetary jurisdiction of the
Magisterial District Judge.
