The following words and phrases, when used in this Title, mean:
ALL-TERRAIN VEHICLE
Any motorized vehicle manufactured and used exclusively for off-highway use which is fifty (50) inches or less in width, with an unladen dry weight of six hundred (600) pounds or less, traveling on three (3), four (4) or more low pressure tires, with a seat designed to be straddled by the operator, and handlebars for steering control.
ALLEY OR ALLEYWAY
Any street with a roadway of less than twenty (20) feet in width.
AUTOCYCLE
A three-wheeled motor vehicle which the drivers and passengers ride in a partially or completely enclosed non-straddle seating area, that is designed to be controlled with a steering wheel and pedals, and that has met applicable Department of Transportation National Highway Traffic Safety Administration requirements or Federal Motorcycle Safety Standards.

BICYCLE
Every vehicle propelled solely by human power upon which any person may ride, having two (2) tandem wheels, or two (2) parallel wheels and one (1) or two (2) forward or rear wheels, all of which are more than fourteen (14) inches in diameter, except electric bicycles, scooters, and similar devices.

BUSINESS DISTRICT
The territory contiguous to and including a highway when within any six hundred (600) feet along the highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks, or office buildings, railroad stations and public buildings which occupy at least three hundred (300) feet of frontage on one (1) side or three hundred (300) feet collectively on both sides of the highway.
BUSINESS VEHICLE
1. 
Any motor vehicle which displays the name, emblem or symbol of any business enterprise; or
2. 
Any motor vehicle which openly and visibly stores or carries equipment or supplies designed and used for any business enterprise.
CENTRAL BUSINESS (OR TRAFFIC) DISTRICT
All streets and portions of streets within the area described by City ordinance as such.
COMMERCIAL TRAILER
Any trailer which is prominently labeled with commercial advertisement or carries a commercial vehicle or other commercial equipment or supplies in plain view excluding ladder racks.
COMMERCIAL VEHICLE
Any motor vehicle exceeding twenty-four (24) feet in length, eight (8) feet in height, and eight (8) feet in width, each measured from the furthest points of the exterior of the motor vehicle body and any accessory affixed thereto, but excluding therefrom ladder racks.
CONSTRUCTION ZONE or WORK ZONE
Any area upon or around any roadway which is visibly marked by the Missouri Department of Transportation, the County of St. Charles, Missouri, the City or a contractor or subcontractor performing work for the Missouri Department of Transportation, the County of St. Charles, Missouri, or the City as an area where construction, maintenance, incident removal or other work is temporarily occurring. The term "work zone" or "construction zone" also includes the lanes of roadway leading up to the area upon which an activity described above is being performed, beginning at the point where appropriate signs or traffic control devices are posted or placed. The terms "worker" or "highway worker" as used in Sections 304.582 and 304.585, RSMo., shall mean any person that is working in a construction zone or work zone, or any employee of the Department of Transportation that is performing duties under the Department's motorist assist program on a State highway or the right-of-way of a State highway.
CONTROLLED ACCESS HIGHWAY
Every highway, street or roadway in respect to which owners or occupants of abutting lands and other persons have no legal right of access to or from the same except at such points only and in such manner as may be determined by the public authority having jurisdiction over the highway, street or roadway.
CROSSWALK
1. 
That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs, or in the absence of curbs from the edges of the traversable roadway; or
2. 
Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.
CURB LOADING ZONE
A space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
DIRECTOR OF REVENUE
The Director of the Department of Revenue of the State of Missouri acting directly or through his authorized officers and agents.
DRIVER
Every person who drives or is in actual physical control of a vehicle.
ELECTRIC BICYCLE
A bicycle equipped with fully operable pedals, a saddle or seat for the rider, and an electric motor of less than seven hundred fifty (750) watts that meets the requirements of one (1) of the following three (3) classes:

1. 
Class 1 electric bicycle — an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches the speed of twenty (20) miles per hour.
2. 
Class 2 electric bicycle — an electric bicycle equipped with a motor that may be used exclusively to propel the bicycle and that is not capable of providing assistance when the bicycle reaches the speed of twenty (20) miles per hour.
3. 
Class 3 electric bicycle — an electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches the speed of twenty-eight (28) miles per hour.
EMERGENCY VEHICLE
Is a vehicle of any of the following types:

1. 
A vehicle operated by the State Highway Patrol, the State Water Patrol, the Missouri Capitol Police, a Conservation Agent or a State Park Ranger, those vehicles operated by enforcement personnel of the State Highways and Transportation Commission, Police or Fire Department, Sheriff, Constable or Deputy Sheriff, Federal Law Enforcement Officer authorized to carry firearms and to make arrests for violations of the laws of the United States, Traffic Officer or Coroner or by a privately owned emergency vehicle company;
2. 
A vehicle operated as an ambulance or operated commercially for the purpose of transporting emergency medical supplies or organs;
3. 
Any vehicle qualifying as an emergency vehicle pursuant to this Title;
4. 
Any wrecker, or tow truck or a vehicle owned and operated by a public utility or public service corporation while performing emergency service;
5. 
Any vehicle transporting equipment designed to extricate human beings from the wreckage of a motor vehicle;
6. 
Any vehicle designated to perform emergency functions for a civil defense or emergency management agency established pursuant to the provisions of Chapter 44, RSMo.;
7. 
Any vehicle operated by an authorized employee of the Department of Corrections who, as part of the employee's official duties, is responding to a riot, disturbance, hostage incident, escape or other critical situation where there is the threat of serious physical injury or death, responding to mutual aid call from another criminal justice agency, or in accompanying an ambulance which is transporting an offender to a medical facility;
8. 
Any vehicle designated to perform hazardous substance emergency functions established pursuant to the provisions of Sections 260.500 to 260.550, RSMo.;
9. 
Any vehicle owned by the State Highways and Transportation Commission and operated by an authorized employee of the Department of Transportation that is marked as a Department of Transportation emergency response or motorist assistance vehicle; or
10. 
Any vehicle owned and operated by the civil support team of the Missouri National Guard while in response to or during operations involving chemical, biological, or radioactive materials or in support of official requests from the State of Missouri involving unknown substances, hazardous materials, or as may be requested by the appropriate State agency acting on behalf of the Governor.
EQUIPMENT
Items used in the maintenance of a home or lawn including, but not limited to, mowers, chippers, snow blowers or similar types of items.
FARM TRACTOR
Every motor vehicle designed and used primarily as a farm implement for drawing plows, mowing machines and other implements of husbandry.
FREIGHT CURB LOADING ZONE
A space adjacent to a curb for the exclusive use of vehicles during the loading or unloading of freight (or passengers).
GOLF CART
A motor vehicle that is designed and manufactured for operation on a golf course for sporting or recreational purposes and that is not capable of exceeding speeds of twenty (20) miles per hour.
HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
INTERSECTION
1. 
The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two (2) highways which join one another at, or approximately at, right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come in conflict;
2. 
Where a highway includes two (2) roadways thirty (30) feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. In the event such intersecting highway also includes two (2) roadways thirty (30) feet or more apart, then every crossing of two (2) roadways of such highways shall be regarded as a separate intersection.
LANED ROADWAY
A roadway which is divided into two (2) or more clearly marked lanes for vehicular traffic.
LICENSE
An operator's or driver's license, temporary instruction permit, chauffeur's or registered operator's license issued under the laws of the State of Missouri.
LOW-SPEED VEHICLE
Shall have the same meaning as that found in 49 CFR 571.3.
MOTOR VEHICLE
Any self-propelled vehicle not operated exclusively upon tracks, except farm tractors and motorized bicycles.
MOTORCYCLE
Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three (3) wheels in contact with the ground, but excluding a tractor.
MOTORIZED BICYCLE
Any two-wheeled or three-wheeled device, except motorized scooters, having an automatic transmission and a motor with a cylinder capacity of not more than fifty (50) cubic centimeters, which produces less than three (3) gross brake horsepower and is capable of propelling the device at a maximum speed of not more than thirty (30) miles per hour on level ground.
MOTORIZED PLAY VEHICLE
Includes mini-motorcycles, pocket bikes and any other vehicle that is capable of transporting a person or persons at a speed in excess of five (5) miles per hour; that is self-propelled by a motor or engine and that is not otherwise defined by Missouri Statutes or the St. Peters City Code as a motor vehicle, motorcycle, bicycle or motorized bicycle.
MOTORIZED SCOOTER
Any two (2), three (3) or four (4) wheeled device having handlebars that are attached to a footboard, which is designed to be either stood upon by the operator or equipped with a seat and is powered by a motor that is capable of propelling the device with or without human propulsion.
MOTORTRICYCLE
A motor vehicle upon which the operator straddles or sits astride that is designed to be controlled by handle bars and is operated on three (3) wheels, including a motorcycle while operated with any conveyance, temporary or otherwise, requiring the use of a third wheel. A motortricycle shall not be included in the definition of all-terrain vehicle.

NEW MOTOR VEHICLE FRANCHISE DEALER
Any motor vehicle dealer who has been franchised to deal in a certain make of motor vehicle by the manufacturer or distributor of that make and motor vehicle and who may, in line with conducting his/her business as a franchise dealer, sell, barter or exchange used motor vehicles.
OFF-ROAD VEHICLE
Any vehicle designed for or capable of cross-country travel on or immediately over land, water, ice, snow, marsh, swampland, or other natural terrain without benefit of a road or trail including, without limitation, the following:
1. 
Jeeps;
2. 
All-terrain vehicles;
3. 
Dune buggies;
4. 
Multi-wheel drive or low-pressure tire vehicles;
5. 
Vehicle using an endless belt, or tread or treads, or a combination of tread and low-pressure tires;
6. 
Motorcycles, trail bikes, minibikes and related vehicles;
7. 
Any other means of transportation deriving power from any source other than muscle or wind; and
Excluding the following:
1.
Registered motorboats;
2.
Aircraft;
3.
Any military, fire or law enforcement vehicle;
4.
Farm-type tractors and other self-propelled equipment for harvesting and transporting farm or forest products;
5.
Any vehicle being used for farm purposes, earth moving, or construction while being used for such purposes on the work site;
6.
Self-propelled lawnmowers, or lawn or garden tractors, or golf carts, while being used exclusively for their designed purpose; and
7.
Any vehicle being used for the purpose of transporting a handicapped person
OFFICIAL TIME STANDARD
Whenever certain hours are named herein they shall mean standard time or daylight-saving time as may be in current use in the City.
OFFICIAL TRAFFIC CONTROL DEVICES
All signs, signals, markings and devices not inconsistent with this Title placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic.
PARK OR PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
PASSENGER CURB LOADING ZONE
A place adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.
PEDESTRIAN
Any person afoot.
PERSON
Every natural person, firm, copartnership, association or corporation.
PICKUP CAMPER
A detached structure designed primarily to be mounted on a pickup truck and with sufficient equipment to render it suitable for use as a temporary dwelling for travel and recreational purposes.
POLICE OFFICER
Every officer of the Municipal Police Department or any officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
PRIVATE ROAD OR DRIVEWAY
Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
RAILROAD
A carrier of persons or property upon cars, other than streetcars, operated upon stationary rails.
RAILROAD TRAIN
A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars.
RECREATIONAL EQUIPMENT
All types of boats, jet skis and other such watercraft designed to be used in or on water, plus the trailers used to transport such equipment on any street.
RECREATIONAL VEHICLE AND/OR RECREATIONAL TRAILER
A vehicle, whether self propelled or a trailer, which is constructed with sufficient equipment to render it suitable for use as a temporary dwelling for travel or recreation.
RESIDENCE DISTRICT
The territory contiguous to and including a highway not comprising a business district when the property on such highway for a distance of three hundred (300) feet or more is in the main improved with residences or residences and buildings in use for business.
RIGHT-OF-WAY
The right of one (1) vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
ROADWAY
That portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two (2) or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively.
SAFETY ZONE
The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
SIDEWALK
That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use of pedestrians.
STAND OR STANDING
The halting of a vehicle, whether occupied or not, otherwise than for the purpose of and while actually engaged in receiving or discharging passengers.
STOP
When required, complete cessation from movement.
STOP OR STOPPING
When prohibited, any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or traffic control sign or signal.
STREET OR HIGHWAY
The entire width between the lines of every way publicly maintained when any part thereof is open to the uses of the public for purposes of vehicular travel. "State Highway", a highway maintained by the State of Missouri as a part of the State Highway system.
THROUGH HIGHWAY
Every highway or portion thereof on which vehicular traffic is given preferential right-of-way, and at the entrances to which vehicular traffic from intersecting highways is required by law to yield right-of-way to vehicles on such through highway in obedience to either a stop sign or a yield sign, when such signs are erected as provided in this Title.
TRAFFIC
Pedestrians, ridden or herded animals, vehicles, streetcars and other conveyances either singly or together while using any highway for purposes of travel.
TRAFFIC CONTROL SIGNAL
Any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and to proceed.
TRAFFIC DIVISION
The Traffic Division of the Police Department of the City, or in the event a Traffic Division is not established, then said term whenever used herein shall be deemed to refer to the Police Department of the City.
TRAILER
Any vehicle without motive power designed for carrying property or passengers on its own structure and for being drawn by a self-propelled vehicle, except those running exclusively on tracks, including a semitrailer, as defined by Section 301.010, RSMo., or vehicle of the trailer type so designed and used in conjunction with a self-propelled vehicle that a considerable part of its own weight rests upon and is carried by the towing vehicle. The term trailer shall not include cotton trailers as defined by Section 301.010, RSMo., manufactured homes as defined by Section 410.270 of the City Code or mobile home or house trailer as defined by Section 405.100 of the City Code.

UTILITY VEHICLE
Any motorized vehicle manufactured and used exclusively for off-highway use which is sixty-three (63) inches or less in width, with an unladen dry weight of one thousand eight hundred fifty (1,850) pounds or less, traveling on four (4) or six (6) wheels, to be used primarily for landscaping, lawn care, or maintenance purposes.
VEHICLE
Any mechanical device on wheels designed primarily for use or used on highways, except motorized bicycles, motorized scooters, motorized play vehicles, vehicles propelled or drawn by horses or human power, or vehicles used exclusively on fixed rails or tracks, cotton trailers or motorized wheelchairs operated by handicapped persons.

Every person operating or driving a vehicle upon the highways, streets and alleys of this City shall observe and comply with the rules and regulations as established by this Title.
A. 
For the purposes of this Section, "special enforcement area" is defined as follows: Any private roadway or street, where the speed limit has been established at twenty-five (25) miles per hour or less or as a School Speed Zone.
B. 
Conviction of a moving violation in a "special enforcement area", as defined in this Section is punishable by a fine of up to five hundred dollars ($500.00). In order to determine the appropriate fine, any person found guilty of a moving motor vehicle violation in a "special enforcement area" within the City limits of the City of St. Peters shall be fined at a rate not less than double the standard fine for such moving motor vehicle violation as provided in the schedule established by the City.
