All curb and gutter constructed in the City shall be constructed
under the supervision and direction of the City Engineering Department
within such time the Board of Aldermen shall direct and provide.

Prior to the issuance of a curb and gutter building permit for
repair or construction of curb and gutter, general plans shall be
submitted to the Engineering Department for review and approval.

A. The City
of Sullivan does hereby establish a cost-sharing program for placement
of curb and gutter on City streets with the following guidelines:
1. The
City will pay for fifty percent (50%) of the costs of the installed
concrete curb and gutter and drive entrances (materials and labor).
The City will also be responsible for other costs that are associated
with the placement of the curb and gutter such as storm drainage,
backfill and street widening.
2. Property
owners on whose property the curb and gutter and street improvements
will front will be responsible for fifty percent (50%) of the cost
of the installed concrete curb and gutter and drive entrances (materials
and labor).
3. The
cost of fifty percent (50%) of the installed curb and gutter and drive
entrances shall be levied as a special assessment against the lot,
tract or parcel of ground along and in front of which said improvement
is made. Said assessment shall be levied by ordinance which shall
set out separately the number and title of the ordinance under authority
of which the work will be done, a separate description of each lot,
tract or parcel assessed, the name of the owner thereof, the number
of front feet therein and the total amount thereof. Said assessment
ordinance shall also authorize the City Clerk to issue said tax bills
as identified in Revised Statutes of the State of Missouri.
4. Curb
and gutters will be installed based on priority of need considering
the following factors: width of the existing street, traffic volume,
safety to motorists, desire for improvements by property owners and
any other factors which could influence the need for improvements.
The City Engineering Department shall prioritize curb and gutter projects
within the City.
5. This
program will be limited to available funding as approved in the City's
annual budget.
6. All
curb and gutter and road improvements shall be designed to conform
to the present City subdivision code, if possible.
7. Property
owners desiring to install curb and gutter adjacent to their property,
on their own accord, may request the City's assistance to perform
grading and street widening if the property owner pays for or furnishes
storm piping and curb and guttering. These projects shall only be
allowed where the curb and gutter and drainage improvements will fit
into the overall street widening and drainage improvements planned
for the area.

A. The Board
of Aldermen may, when deemed necessary or expedient, declare it necessary
to construct curb and gutter on any street within the City and have
the curb and gutter constructed by a contractor or built by City crews
when necessary. The cost of the improvements shall be assessed to
the property owners by a special tax bill in accordance with the Revised
Statutes of the State of Missouri.
B. The Board
of Aldermen shall, by resolution, declare the work or improvement
necessary, state the nature thereof and the method of payment, and
refer to the plans, specifications and estimates of cost filed in
the office of the City Clerk. The Board of Aldermen shall cause the
resolution to be published in some weekly newspaper printed in the
City for two (2) consecutive issues.
C. Prior
to award of any construction contract, the City Engineer shall prepare
and submit to the Board of Aldermen an estimate of the cost of said
curb and gutter, including all labor and materials for the installation
of said curb and gutter and drive entrances, which estimate shall
be the price for the finished improvement; and no contract shall be
let for a price in excess of said estimate.

A. All curb and gutter constructed in the City shall be in accordance with the "Unified Land Use Regulations" if at all possible (see Chapter
400 of this Code).
B. Variations
from the current subdivision code shall only be allowed by the Board
of Aldermen if there is no feasible way to construct the improvements
as specified.

All special tax bills which are paid to the City shall be deposited
into the Capital Improvements Fund.
