A. 
Section 22a-354o of the Connecticut General Statutes provides that a town in which an aquifer protection area is located shall authorize, by ordinance, an existing board or commission to act as an aquifer protection agency.
B. 
It is determined by the Town Council that it is in the best interest of the Town of Plainville to designate the Planning and Zoning Commission as the Town's Aquifer Protection Agency.
A. 
In accordance with the provisions of § 22a-354a et seq. of the Connecticut General Statutes, the Planning and Zoning Commission of the Town of Plainville is hereby designated as the Aquifer Protection Agency of the Town of Plainville. The staff of the Planning and Zoning Commission shall serve as the staff of the Aquifer Protection Agency.
B. 
Members of the Planning and Zoning Commission shall serve coexisting terms of office on the Aquifer Protection Agency. The membership requirements of the Aquifer Protection Agency shall be the same as those of the Planning and Zoning Commission, including but not limited to the number of members, term of office, method of selection and appointment, method of removal from office and the filling of vacancies.
C. 
At least one member of the Aquifer Protection Agency or staff of the Aquifer Protection Agency shall complete the course in technical training formulated by the Commissioner of Energy and Environmental Protection of the State of Connecticut pursuant to § 22a-354v of the Connecticut General Statutes.[1]

A. 
The Aquifer Protection Agency shall adopt regulations in accordance with § 22a-354p of the Connecticut General Statutes.
B. 
Said regulations shall provide for:
(1) 
The manner in which boundaries of aquifer protection areas shall be established and amended or changed.
(2) 
The form for an application to conduct regulated activities within the area.
(3) 
Notice and publication requirements.
(4) 
Criteria and procedures for review of applications.
(5) 
Administration and enforcement.
(6) 
Procedures for the regulation of activities within the area.
(7) 
Such other duties and responsibilities which from time to time may be provided for by state statute or regulation.
This article shall not be construed to conflict with any state statute, rule or regulation.
