Hellam Township hereby approves entering into articles of agreement (hereinafter referred to as "agreement") with the Boroughs of East Prospect, Yorkana, Wrightsville, and Hallam, and the Township of Lower Windsor to provide a regional emergency management agency. A copy of the agreement is attached hereto and incorporated by reference (and shall be filed with the minutes of the meeting at which this article was enacted), with the intent and effect that Hellam Township adopts the terms of the agreement by reference and shall be bound by the terms of the agreement.[1]

Hellam Township is authorized to enter into the agreement for the purposes contained therein and attached hereto, and the Chairman or Vice Chairman of the Hellam Township Board of Supervisors, acting alone or together with the Secretary or Assistant Secretary, is hereby authorized and directed to execute said agreement on behalf of Hellam Township, and to execute and deliver any additional instruments, and to take such further actions, as may be necessary or appropriate, to carry forth the articles of agreement and the transactions to be effected under the agreement.
As required by the Intergovernmental Cooperation Act, codified at 53 Pa.C.S.A. §§ 2301-2315, the following matters are hereby set forth:
A. 
The conditions of the agreement are set forth in the articles of agreement attached hereto.
B. 
The agreement shall be perpetual in nature until or unless terminated by all participants to the agreement.
C. 
The purposes and objectives of the intermunicipal agreement are to permit and authorize a regional emergency management agency and to accomplish the other purposes and objectives as are set forth in the articles of agreement.
D. 
Financing shall be under the formula set forth in the agreement, with the initial annual contribution to be based on a base fee of $500 per municipality, plus $0.12 per resident, plus $50 per square mile of each municipality's geographic area, which totals $2,610.16, and shall be paid from the general fund of the Township through ordinary tax revenues.
E. 
No additional organizational structure or change in any organizational structure of the participants is required to implement the agreement.
F. 
A separate or new entity shall be created under this agreement which shall be known as the "Eastern York County Emergency Management Agency," under the control of the participating municipalities as set forth in the agreement.
