It shall be unlawful for any person or persons to permit or
suffer any decayed limbs or branches of trees or dead trees not planted
or under the jurisdiction of the Shade Tree Commission to remain on
his, her or their land in or along and extending over the streets
and sidewalks of the Town of Belvidere or to permit or suffer the
limbs and branches of trees not planted or under the jurisdiction
of the Shade Tree Commission standing in the streets or sidewalks
of said Town on his, her or their lands to obstruct or prevent the
rays of the streetlights from lighting the whole street and sidewalks
lying between said lights in a sufficient and ample manner.
The Division of Street Services of the Town of Belvidere shall
notify the person or persons violating the foregoing section of this
chapter to remove said dead and decaying limbs, branches and trees
and branches and limbs of trees obstructing the streetlights as forbidden
by said foregoing section, and, in case said person or persons shall
not forthwith remove the same on his, her or their land in or extending
over said streets and sidewalks in the Town of Belvidere, then said
Division of Street Services shall cause the same to be done and shall
certify the cost thereof to the Town Council, which shall examine
the certificate and, if found to be correct, shall cause the cost
as shown thereon to be charged against said lands, with the amount
so charged becoming a lien upon the lands and to be added to and become
and form part of the taxes next to be assessed and levied upon such
lands and to bear interest at the same rate as taxes and to be collected
and enforced by the Tax Collector.

Any person who shall continue to violate any of the provisions
of this chapter, after being duly notified of such violations, or
shall neglect or refuse to comply with any lawful order of the Department
of Public Works or any lawful order of the Shade Tree Commission shall
be subject to prosecution in the Municipal Court for violation of
this chapter.

Any person who shall violate any provision of this chapter shall
be subject to a penalty of $50 for the first offense; a penalty of
$200 for the second offense; and a penalty of $500 for any subsequent
offense.
