A code regulating the use, operation and maintenance of food and beverage vending machines and the licensure thereof, prohibiting the sale or possession with intent to sell through vending machines of adulterated or misbranded food or drinks, authorizing inspection of vending machines and operations connected therewith and fixing penalties for violations is hereby established pursuant to N.J.S.A. 26:3-69.1 et seq. A copy of said code is annexed hereto and made a part hereof.

The code established and adopted by this chapter is described and commonly known as "Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983)."

Three copies of said Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983), have been placed on file in the office of the Health Officer and Secretary of the Board of Health upon the introduction of this chapter and will remain on file in said office for use and examination by the public.

It shall be unlawful for any person, whether as principal or agent, servant or employee, either on behalf of himself or on behalf of any other person, or for any body corporate, firm or organization or otherwise to:
A. 
Engage in the operation of one or more machines or devices offered for public use which, upon insertion of a coin, coins or token or by other means, dispenses unit servings of food or beverages either in bulk or packages without the necessity of replenishing the devices between each vending operation, without having first applied to and procured a permit from the Board of Health of this municipality and without complying with any and all provisions of Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983), its amendments and supplements thereto, as hereinafter adopted or amended by said Board.
B. 
Maintain or permit to be maintained on or in any location in this municipality, private or public, one or more machines or devices offered for public use which, upon insertion of a coin, coins or token or by other means, dispenses unit servings of food or beverages either in bulk or packages without the necessity of replenishing the devices between each vending operation, without first having applied to and procured a license for each such machine or device from the Board of Health of this municipality and without complying with any and all of the provisions of Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983), its amendments and supplements thereto, as adopted by said Board.
A. 
The fees for permits and licenses as required by § 465-4 above for regulation and control to be paid annually to the municipality are hereby fixed as set forth in § 412-1, which fees shall be submitted for the initial calendar year with the application and which shall thereafter become due on the first day of July each year thereafter.

B. 
All permits and licenses issued under authority of this chapter shall expire on the 31st day of December of each year.
C. 
Permit and license fees shall be paid to the Board of Health of the Township of Mount Olive.

Application for an issuance of the permits and licenses referred to in § 465-4 above shall be made in conformity with the provisions of Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983), its amendments and supplements, as adopted by the Board of Health of this municipality. Such permits and licenses are not transferable.

Permits and licenses issued under authority of this chapter may be suspended, revoked or reinstituted by the Board of Health of this municipality pursuant to the provisions of Chapter XII, Sanitation in Retail Food Establishments and Food and Beverage Vending Machines (1983), its amendments and supplements, as adopted by said Board of Health.
