The purpose of the within article is to prohibit smoking within public buildings and on properties owned or controlled by the Borough of Palmyra in order to protect the health, safety and welfare of employees, residents and visitors. This is a result of numerous determinations that the effect of tobacco smoke is detrimental to an individual's health.
The following terms when used in this article shall have the meanings indicated:
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter of substance which contains tobacco.
Smoking is hereby prohibited within any park owned or leased by the Borough of Palmyra, Burlington County, New Jersey, except in designated smoking areas. This prohibition includes but is not limited to the Legion Field Athletic Complex, the Ethel B. Hardy Park, the Band Shell, the War Memorial, and the Community Center.
Any person who violates any one or more sections of this article shall be subject to a fine of not more than $500 for each separate offense and/or confinement in the Burlington County Jail for a period of not more than 30 days.
