The office of the City Clerk is hereby created. The City Clerk shall be appointed by the City Council for an indefinite term, at a salary to be established by the City Council.

The person appointed to the office of the City Clerk shall be competent and qualified and of the age of twenty-one (21) years or more.

Before entering upon the duties as City Clerk, he/she shall take and subscribe an oath or affirmation as provided in Section 115.020. Within fifteen (15) days after his/her appointment and before entering upon the discharge of the duties of his/her office, the City Clerk shall execute to the City of Charleston a bond, in the sum as set by the City Council, with a bonding company, conditioned that he/she will faithfully discharge all the duties of his/her office as required by the laws of the State of Missouri governing cities of the Third Class and the ordinances of the City of Charleston, and that he/she will promptly pay over all monies coming into his/her possession that belong to the City at the time and in the manner provided by law. Said bond, with the City Manager's approval endorsed thereon, shall be filed in the office of the City Treasurer, who shall preserve and safely keep the same.

The City Clerk shall, among other duties, keep the journal of the proceedings of the Council. He/she shall safely and properly keep all records and papers belonging to the City which may be entrusted to his/her care; he/she shall be the general accountant of the City, and generally shall perform all the duties required of him/her by ordinance or orders of the Council. He/she is hereby empowered to administer official oaths, and also oaths to persons certifying to demands or claims against the City.

Whenever, for any reason, the City Clerk is unable to perform the duties of his/her office, the City Council may by resolution appoint a temporary clerk, who shall have all the power and perform all the duties of the regular clerk, and shall receive the same salary for the time he/she so acts.
