No fence, wall or hedge will be permitted to be erected or maintained
in the Township of Lower Mount Bethel except in conformance with the
following regulations contained in this Part. It is expressly stated
that freestanding walls and hedges that serve the same purpose or
similar purposes as a fence shall also be governed by this Part as
if they were fences.

Anyone wishing to erect a fence, wall or hedge governed by this
Part shall file an application for a building permit with the Township
Zoning Officer, accompanied by the appropriate fee as may be set forth,
from time to time, by the Lower Mount Bethel Township Board of Supervisors.

1. Within the front yard of any lot, as defined in the Lower Mount Bethel Township Zoning Ordinance [Chapter
27], including, but not limited to both street frontages for a corner lot or a lot having double frontage, fences, walls and hedges shall not exceed four feet in height.
2. Behind the front yard line as defined in the Lower Mount Bethel Township Zoning Ordinance [Chapter
27], fences, walls and hedges may not exceed five feet in height.
3. All corner lots, fences, walls and hedges shall comply with the Lower Mount Bethel Township Zoning Ordinance [Chapter
27] in all respects by providing sight triangles as set forth therein and shall not interfere, inhibit nor affect traffic visibility whatsoever at said location.
4. No fence, hedge or wall may be placed closer to a street than the
ultimate right-of-way line.

1. Within the front yard of any lot as defined by the Lower Mount Bethel Township Zoning Ordinance [Chapter
27], including all street frontages, fences, walls and hedges constructed of solid materials which block visibility may not exceed four feet in height.
2. Within the front yard of any lot as defined by the Lower Mount Bethel Township Zoning Ordinance [Chapter
27], including all street frontages, fences, walls and hedges constructed of open materials such as mesh, posts or rails, which allow good visibility, may not exceed six feet in height.
3. All corner lots, fences, walls and hedges shall comply with the Lower Mount Bethel Township Zoning Ordinance [Chapter
27], in all respects by providing sight triangles as set forth therein and shall not interfere, inhibit nor affect traffic visibility whatsoever at said location, regardless of the type of fence construction.
4. No fence, wall or hedge may be placed closer to a street than the
ultimate right-of-way line.

1. Fences, walls and hedges shall not interfere with traffic visibility along a curve, across the corner of a lot or at an access driveway as defined by the Lower Mount Bethel Township Zoning [Chapter
27] and/or Subdivision Ordinances [Chapters
22].
2. Fences, walls and hedges shall not affect the flow of surface stormwater
runoff.
3. Fences, walls and hedges shall not be erected in an easement along
the property line.
4. Fences, walls or hedges placed in the front of any use whatsoever
shall be placed no nearer to the right-of-way line for any public
street than the required front yard in that district.

1. Barbed wire shall not be used for fences, walls or hedges except
for agricultural purposes.
2. Electrified fences are prohibited except for agricultural purposes.
3. Fences shall be constructed of durable fencing material. Waste material
such as discarded vehicles, appliances, assembled or partially assembled
materials or raw materials are expressly prohibited.
4. No signs, flags and/or messages exceeding two square feet shall be
placed on the surface of any fence, wall or hedge.
5. The fence, wall or hedge shall be compatible with the neighborhood
and be maintained in such a manner as to not constitute a safety hazard.
6. If the fence, wall or hedge is wood cover or woodframe, the framework
must face onto the interior of the lot, unless the fence is so designed
to provide equal frame and cover to adjoining yards.
7. If the fence, wall or hedge is open metal mesh, supported by posts
and frames of either pipe or wood, the posts or frames must be on
the interior of the mesh.
8. If the fence, wall or hedge is of masonry construction, a finished
side must be provided to the exterior side.

A security fence shall be a minimum of six feet and nor more
than nine feet high and all security fences shall provide a continuous
barrier completely encircling the perimeter of the area required to
be protected except for no more than three locking gates.

Fences, walls or hedges erected on tracts of six acres or more
utilized solely for agricultural purposes are exempt from the requirements
of this Part.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
