There shall be appointed the following Borough officers. They shall perform the duties required by law and Borough ordinance. Residency in the Borough shall not be required for any officer unless otherwise provided. Unless sooner removed, they shall hold office for the time period provided herein. Where no time period is provided, they shall hold office for one year and until their successor shall have been qualified.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-136 et seq., there shall be in the Borough the position of Municipal Administrator, referred to as the Borough Administrator.
B. 
Appointment. The Borough Administrator shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve at the pleasure of the Mayor and Council.
C. 
Residency requirement. The Borough Administrator shall be a resident of the Borough. In the event that on the date of the initial appointment the Borough Administrator is not a resident of the Borough, he or she shall become one within one year of such appointment and shall continue his or her residency throughout his or her term of office. If circumstances so warrant, this residency requirement may be waived by a majority vote of the Council.
D. 
Removal. The Borough Administrator may be removed from office in accordance with N.J.S.A. 40A:9-138.
E. 
Qualifications for appointment. The Borough Administrator shall be appointed on the basis of executive and administrative abilities and qualifications with special regard to education, training and experience in government affairs.
F. 
General duties and responsibilities. The Borough Administrator shall be the chief administrative officer of the Borough and shall be responsible to the Mayor and Council for the proper and efficient administration of Borough affairs.
G. 
Powers and duties. The Borough Administrator shall have the following duties and responsibilities to the extent not prohibited by law:
(1) 
The Borough Administrator shall be responsible for the operation of all departments and offices within the Borough, and all department heads and officers of the Borough shall report to him or her.
(2) 
The Borough Administrator shall be responsible for the preparation of the annual Borough capital and operating budgets and shall submit the same to the Mayor and Council for approval. He or she shall be responsible to see that each department, office, board or other agency adheres to the budget approved by the Mayor and Council.
(3) 
The Borough Administrator shall be responsible for Borough purchasing procedures, administrative procedures and organizational structure, and shall make recommendations for change to the Mayor and Council relating thereto as he or she shall deem necessary from time to time.
(4) 
The Borough Administrator shall maintain sound personnel practices and shall maintain appropriate records of all employees. He or she shall have the authority to recommend to the Mayor and Council the hiring of all Borough employees.
(5) 
The Borough Administrator shall delegate to any department head or other Borough employee such of his or her powers as he or she may deem necessary for efficient administration.
(6) 
The Borough Administrator shall make studies and surveys of such municipal problems of the Borough as shall be assigned to him or her, from time to time, by the Mayor and Council and shall prepare and submit written reports of his or her findings and determinations to the Mayor and Council for their consideration and action.
(7) 
The Borough Administrator shall attend all meetings with the right to participate in discussions but without the right to vote.
(8) 
The Borough Administrator shall implement and enforce the policy of the Council with respect to the compiling and release of public information.
(9) 
The Borough Administrator shall investigate complaints concerning municipal operations, cause corrective action to be taken when indicated and keep records of complaints received and actions taken.
(10) 
The Borough Administrator shall have the authority to refer charges and recommend employee disciplinary action to a designated hearing officer.
(11) 
The Borough Administrator shall be responsible for the day-to-day operations and efficiency of the Police Department.
(12) 
The Borough Administrator shall perform such additional duties as may be assigned to him or her from time to time by the Mayor and Council.
H. 
Compensation. The Borough Administrator shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-133, there is hereby established the position of Municipal Clerk, referred to as the Borough Clerk.
B. 
Appointment; term. The Borough Clerk shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve a three-year term from the date of appointment.
C. 
Duties. The Borough Clerk shall:
(1) 
Act as secretary of the municipal corporation and custodian of the municipal seal and of all minutes, books, deeds, bonds, contracts, and archival records of the municipal corporation;
(2) 
Act as secretary to the Mayor and Council, prepare meeting agendas at the discretion of the Mayor and Borough Administrator, be present at all meetings of the Mayor and Council, keep minutes of the proceedings of every meeting, retain the original copies of all ordinances and resolutions;
(3) 
Serve as the chief administrative officer of all elections held in the Borough, subject to the requirements of Title 19 of the Revised Statutes;
(4) 
Serve as the chief registrar of voters in the Borough, subject to the requirements of Title 19 of the Revised Statutes;
(5) 
Serve as the administrative officer responsible for the acceptance of applications for licenses and permits, and the issuance of licenses and permits;
(6) 
Serve as coordinator and records manager responsible for implementing local archives and records retention programs as mandated pursuant to Title 47 of the Revised Statutes; and
(7) 
Perform such other duties as are now or hereafter imposed by statute of regulation or Borough ordinance or regulation; and
(8) 
Perform such other duties as the Mayor or Council may direct.
D. 
Compensation. The Borough Clerk shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-135, the position of Deputy Borough Clerk is hereby created.
B. 
Appointment; term. The Deputy Borough Clerk shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve a one-year term from January 1 to December 31 or until his or her successor has been appointed and qualified.
C. 
Duties. The duties of the Deputy Borough Clerk shall be to assist the Borough Clerk in all the duties of his or her office, and the Deputy Borough Clerk shall have all the powers and perform all the duties of the Borough Clerk during such times and for such specific periods as the Borough Clerk shall be absent.
D. 
Compensation. The Deputy Borough Clerk shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-140.10, there is hereby created the position of Chief Financial Officer for the Borough of Chatham.
B. 
Appointment; term. The Chief Financial Officer shall be appointed by the Mayor, with the advice and consent of Council, and shall serve a four-year term from January 1 in the year in which the Chief Financial Officer is appointed.
C. 
Powers and duties. The Chief Financial Officer shall be responsible for the supervision, administration and operation of the Finance Office, which shall include budget preparation and audit functions, financial electronic data processing, maintenance of investments, bank statement reconciliation, encumbrance system, fixed assets, general ledger, payroll and other duties which may be assigned by the Mayor and Council from time to time.
D. 
Compensation. The Chief Financial Officer shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-139, there is hereby created the position of Municipal Attorney, referred to as the Borough Attorney.
B. 
Appointment; term. The Borough Attorney shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve a term of one year commencing January 1 and terminating December 31 in each year. The Borough Attorney shall be licensed to practice law in the State of New Jersey.
C. 
Powers and duties. The Borough Attorney shall serve as legal advisor to the Mayor and Council; represent the Borough in all legal matters; advise and assist the Mayor, Council, Borough Administrator and department heads as required in the administration of the Borough government; represent the Borough in all litigation, arbitration, administrative hearings and appeals and other such proceedings; attend Council meetings; draft ordinances and resolutions and such other legal instruments as relate to the business of the Borough; give opinions and rulings on questions of law and render such other professional legal services as may be required by statute or as requested by the Mayor and Council from time to time, whether by ordinance, resolution or otherwise.
D. 
Compensation. The compensation to be paid the Borough Attorney shall be by contract on an hourly basis. In addition, the Borough Attorney shall be paid such reasonable fees and costs for litigation, administrative proceedings, legal services related to labor matters, extraordinary proceedings and/or unforeseeable matters or services as may be necessary and required in accordance with his or her professional services contract.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-141, there is hereby established the position of Tax Collector.
B. 
Appointment; term. The Tax Collector shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve a four-year term from January 1 next following the appointment.
C. 
Powers and duties. The Tax Collector shall:
(1) 
Receive and collect all current and delinquent real and personal property taxes, and charge and receive penalties and interest as provided by general law.
(2) 
Maintain an up-to-date record of municipal taxes, charges, liens and payments with reference to the tax map and lot and block numbers, recording thereon all changes in ownership, address or character of property.
(3) 
Prepare and mail tax bills.
(4) 
Keep accounts of all tax collections in such form and manner as may be prescribed or approved by the Chief Financial Officer and the Borough Auditor.
(5) 
Transfer daily to the Chief Financial Officer, for deposit, all funds received in payment of Borough taxes, interest, penalties or fees.
(6) 
Make and certify searches for tax and other liens on real property in the Borough, and charge and collect fees therefor.
(7) 
Make such periodic reports and accounts of revenues and delinquent taxes as the Chief Financial Officer may require. Such reports and accountings shall be filed as a public record with the Borough Clerk.
(8) 
Enforce collection of delinquent taxes by conducting timely sale of properties in accordance with statutes governing foreclosure of municipal tax liens and the holding of municipal tax sales.
(9) 
Perform other functions and duties of a collector of taxes as provided by general law and as directed by the Mayor and Council.
D. 
Compensation. The Tax Collector shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-148, there is hereby established the position of Tax Assessor.
B. 
Appointment; term. The Tax Assessor shall be appointed by the Mayor, with the advice and consent of the Council, and shall serve a four-year term from July 1 next following the appointment.
C. 
Powers and duties. The Tax Assessor shall:
(1) 
Value all real and personal property in the Borough for purposes of assessment and taxation in accordance with general law and ordinances.
(2) 
Value and assess real and personal property for the purpose of ad valorem taxation.
(3) 
Prepare the tax list and duplicate list required by law and keep assessment records of each and every parcel of real property assessed or exempted.
(4) 
Assist the Borough Engineer in the preparation and maintenance of the Borough Tax Map.
(5) 
Make appraisals of property for any Borough purpose upon the direction of the Council.
(6) 
Have such other powers, functions and duties given to municipal assessors by general law and as directed by the Mayor and Council.
D. 
Compensation. The Tax Assessor shall receive such compensation as may from time to time be provided by resolution.
A. 
Establishment. Pursuant to N.J.S.A. 40A:9-140, there is hereby created the office of Municipal Engineer, referred to as the Borough Engineer.
B. 
Appointment; term. The Borough Engineer shall be a licensed engineer in the State of New Jersey, appointed by a majority vote of the Council. The Borough Engineer shall serve a three-year term from the date of appointment in accordance with N.J.S.A. 40A:9-140.
C. 
Powers and duties. The Borough Engineer shall keep accurate maps, plats and records of all public works, lands or property owned by the Borough. The Borough Engineer shall further advise the Council and Borough officials on all engineering matters referred to him or her, and shall perform such duties as are provided by law or ordinance, and in addition thereto, such other duties as from time to time may be imposed upon him or her by the Council or by the Borough Administrator. He or she shall, from time to time as required by the Council, make reports regarding public improvements, repairs of streets, bridges and sidewalks, or such other work as the Council may request, and shall make such suggestions to the Council, regarding the same, as shall in his or her judgment seem best and proper.
D. 
Compensation. The Borough Engineer shall be compensated as provided by law, either in an annual salary or fixed-fee basis or at an hourly rate and based upon actual time and expenses agreed on prior to the rendering of the services.
E. 
Consulting engineers. Nothing in this article shall be deemed to prohibit the Council from entering into a contract with any consulting engineer or consulting engineers, in the manner provided by state law and Borough ordinance, for any engineering work.
A. 
There is hereby created the position of Purchasing Agent for the Borough of Chatham.
B. 
The Purchasing Agent shall be appointed by the Mayor, with the advice and consent of the Council, by resolution.
C. 
The Purchasing Agent is required to possess a valid qualified purchasing agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.
D. 
The Purchasing Agent shall have, on behalf of the Mayor and Council, the authority, responsibility and accountability for the purchasing activity of the Borough pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. The Purchasing Agent shall be authorized to prepare advertisements, to advertise for and receive bids and requests for proposals for the provision or performance of goods, services and construction contracts, to make awards for the Borough as permitted by the Local Public Contracts Law, and to conduct any activities as may be necessary or appropriate to the purchasing function of the Borough.
E. 
In accordance with the Local Public Contracts Law, the Purchasing Agent shall be authorized to award contracts as follows:
(1) 
Under 15% of the threshold amount; or
(2) 
Over 15% up to the threshold amount after soliciting at least two competitive quotations.
