The office of City Counselor of the City of Kennett is hereby created in accordance with Section 98.340, RSMo. The City Counselor shall have the duty to give legal counsel to the City Council, Board of Public Works and other officers of the City, represent the City in the courts of this State excluding Kennett Municipal Court, draft all ordinances and contracts and perform such other duties as shall be prescribed by ordinance or ordered by the Council or the Mayor from time to time. An Assistant City Counselor may be designated by the City Counselor, with approval of the Mayor and Council. The Assistant City Counselor shall work at the direction of the City Counselor and have the same authority and duties as the City Counselor in his/her absence.

The compensation for the City Counselor shall be a sum as set by ordinance from time to time and the City Counselor shall be entitled to reasonable compensation for extraordinary services rendered if prior approval of such services is approved by the Mayor or City Council. The Assistant City Counselor shall receive no compensation without prior approval by the City Council.

The position of City Attorney of the City of Kennett is hereby created in accordance with Section 98.340, RSMo. The City Attorney shall have the duty to prosecute all cases brought on behalf of the City regarding the enforcement of ordinances of the City, including the filing of complaints, for the violation of any ordinances and representing the City in any courts for the enforcement of such ordinances.

The City Attorney shall be a person learned in the law, duly licensed as an attorney at law in this State and enrolled as such.

In any suit or action at law or in equity brought by or against the City, except prosecutions begun before the Municipal Judge, the City Council may, by resolution, employ an attorney or attorneys, and pay him/her or them a reasonable fee therefor.

The City Counselor and the City Attorney shall be appointed by the Mayor with the approval of the City Council pursuant to the provisions of Section 77.370.2, RSMo. The persons holding such appointed offices shall serve in such capacity at the pleasure of the Mayor and City Council.

There is hereby created the office of Assistant City Attorney.

Upon the recommendation of the City Attorney, the Assistant City Attorney shall be appointed by the Mayor with the approval of a majority of the members of the City Council; said officer to serve for an indefinite term at the pleasure of the City Council, who shall have the right to remove said officer at any time, with or without cause, or to replace said officer at any time, or to permit said office to remain vacant. The Assistant City Attorney shall be a licensed member of the Missouri Bar, in good standing, and a resident of and actively engaged in the practice of law in the City of Kennett.

The Assistant City Attorney shall perform such duties as the City Attorney shall delegate to him/her.

The Assistant City Attorney shall receive such compensation, if any, as the Council shall fix from time to time by ordinance.
