As used in this article, the following terms shall have the
meanings indicated:
REFUSE
All dirt, rubbish, waste article or substance, whether liquid
or solid, yard waste (leaves, grass clippings, brush, etc.), tires,
containers, appliances, fill or other obstructions.

The Board of Trustees shall have the power to regulate by resolution
any sanitary landfill area now or hereafter established.

No refuse shall be thrown, placed, left, deposited or dumped
within the Village of Walton, including, but not limited to, the streets,
storm drains, culverts, ditches, streams and rivers or in any sanitary
landfill area now or hereafter established by the Village, except
at such place or places designated by the Board of Trustees.
No person, firm or corporation shall transport refuse for hire
to any sanitary landfill area now or hereafter established by the
Village without having first obtained a license therefor as hereinafter
provided.
A license to transport refuse for hire shall be issued by the
Village Clerk-Treasurer upon payment of an annual fee of $100. The
term of such license shall be one year from date of issuance, and
such license may be renewed annually at an annual renewal fee of $100.

A. Any person found to be in violation of this chapter shall be served
in person or by ordinary United States first class mail by the Village
of Walton Code Enforcement Officer with written notice stating the
nature of the violation and providing seven days for satisfactory
correction thereof from the date of either service or mailing. The
violator shall, within the period of time stated in such notice, permanently
cease all violations.
B. If, after the expiration of the notification period, the violation
has not been corrected, then the Code Enforcement Officer shall issue
a citation upon the violator that states the nature and substance
of the violation and requires the violator to appear before the local
justice having jurisdiction within, the Village of Walton.
C. Any person found in violation of the provisions of this article shall
be guilty of a violation and, upon conviction thereof, shall be fined
an amount no less than $50 and not to exceed $250 for each violation.
If the identified refuse has not been removed at the time of sentencing,
the Court may direct the removal of the identified refuse by a specific
date and if the refuse is not removed by that date, that the refuse
may be removed by the Village of Walton and the cost of such removal
shall be assessed as restitution against the violator.

All prior local laws or parts of local laws of this Village, including, but not limited to, prior Chapter
35, §§
35-1 to 35-6 inclusive, are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any local law hereby repealed prior to the taking effect of this article.

The provisions of this local law may be enforced by the Village
Code Enforcement Officer or the Village Police.

controlling in the Village of Walton.]
