Whenever there is a difference between the standards specified herein and those indicated in other applicable regulations, the more stringent requirement shall apply.
The provisions of this chapter are severable. Should any section, sentence, clause, part or provision hereof shall be held illegal, invalid, or unconstitutional by any court of competent jurisdiction, such decision shall not effect or impair the remaining sections, sentences, clauses, parts or provisions of this chapter. It is hereby declared to be the intent of the Board of Supervisors that this chapter would have been enacted if such illegal, invalid, or unconstitutional sections, sentence, clause, part, or provision had not been included herein.
A.
The Lancaster Township Zoning Ordinance, Ordinance No. 29, is hereby amended; provided, however, that the amendment shall in no manner be construed as a waiver, release or relinquishment of the right to initiate, pursue, or prosecute, as the case may be, any proceeding at law or in equity, including criminal proceedings, pertaining to any act done which would have been constituted a violation of Ordinance No. 29, and all provisions of Ordinance No. 29 shall remain in full force and effect, and are not repealed hereby, as they pertain to such acts.
B.
The provisions of this chapter, so far as they are common to those regulations in force immediately prior to the enactment of this chapter, are intended as a continuation of such prior regulations and not as new enactments.
C.
All ordinances or regulations, or parts of such ordinances or regulations, in conflict with this chapter or inconsistent with its provisions, are hereby repealed to the extent necessary to give this chapter full force and effect.
D.
The adoption of this chapter does not make legitimate development activity in the Township under provisions of the prior regulations illegal, nor does it annul any litigation currently being pursued or that may be pursued in the future against such illegal activity.
