As used in this Part, the following terms shall have the meanings indicated unless a different meaning clearly appears in the context:
COMPETENT OPERATOR
Individuals possessing the documented training and knowledge necessary for the safe handling and use of fireworks. The entity certifying the training shall be acceptable to the Township.
DISPLAY
A formal, organized, and controlled display of fireworks by qualified individuals.
FIREWORKS
Any composition, device, or pyrotechnic intended for the purpose of producing a visible or audible effect for entertainment purposes by combustion, deflagration, or detonation.
OPERATOR(S)
Individuals or employees handling, setting up, and executing the display.

1. 
Individual or Personal Use. It shall be prohibited for any individual or individuals to possess, manufacture, store, sell, display, or use fireworks as defined in Pennsylvania Statutes, Title 35.[1] Individuals may possess devices identified as ground and handheld sparkling devices, novelties, and toy caps as defined in Title 35.

Approved Display. Fireworks displays for public or private groups shall be authorized with the acceptable submission of a fireworks display permit approved by the Code Enforcement Department.
3. 
Township Property. No individual shall possess, manufacture, store, sell, display, or use fireworks of any and all types on Township property to include parks and recreation areas.

1. 
Individuals, companies, entities, or competent operators shall secure a certificate of insurance, naming Lower Swatara Township as an additional insured prior to application for a fireworks display permit.
2. 
The minimum amount required for the certificate of insurance shall be $2,000,000. This amount may be increased when, in the opinion of the Township, additional hazards and liability exist.

1. 
A fireworks display permit shall be issued by the Code Enforcement Department before any fireworks are transported, stored, staged, or used in the Township.
2. 
The individual, company, organization, or firm making application for the permit shall provide the following information:
A. 
Location of the fireworks display.
B. 
Day, date, time, and estimated duration of the display.
C. 
General description of the type(s) and number of fireworks.
D. 
Fire prevention features to be in place during the display.
E. 
Contact person, company, address, and telephone number of operator or operators executing or performing the display.
F. 
Proof of qualification of the individuals/company executing the display.
G. 
Insurance carrier, policy number, type and amount of coverage, and attached proof of insurance.
H. 
Contact individual name, telephone number, organization, and address of the responsible individual, company, organization, and firm for whom the display will be provided.
I. 
Applicant's name, address, and telephone number.

The Code Enforcement Department shall ensure all required information is provided by the applicant.
4. 
Permit Revocation. When, in the opinion of the Fire Marshal, Deputy Fire Marshal, Police Officer, or Fire Department Line Officer, weather or other conditions exist or are imminent that would compromise safety before or during any approved and permitted fireworks display, the permit shall be revoked and the operators directed to terminate the display.
5. 
Rescheduled Events. The permit date may be extended by the Fire Marshal should inclement weather or other acceptable conditions prevent a fireworks display from occurring on the approved date. The applicant is required to secure such an extension from the Fire Marshal, in writing, before proceeding with any display.

Any person, firm, or corporation who shall violate any of the provisions of this Part shall be subject to the provisions of § 7-401, Violations and Penalties.
