Parking in the nonmetered municipal parking lot on the Municipal
Complex fronting on Chestnut Street and West Third Avenue is restricted
to municipal employees and official vehicles which have spaces designated
therein. Vehicles so parked shall be properly identified.

No person, business, or commercial entity shall park any motor
vehicle on the public streets or highways of the Borough for the purpose
of advertising or exhibiting the vehicle or other items for sale.
Notwithstanding the foregoing, nothing herein shall prohibit a person,
business, or commercial entity from displaying a business or trade
name on a vehicle parked on the public streets or highways of the
Borough, nor prohibit a person who is not regularly engaged in the
business of the sale of used or new vehicles, from advertising a motor
vehicle owned and titled to such person as for sale by owner from
parking said motor vehicle on the public streets or highways of the
Borough.

The locations described in Schedule XXVI (§ 523-135), attached to and made a part of this chapter, are hereby designated as permit parking areas.

The provisions of this article shall be applicable to all permit
parking areas in municipal parking lots located at 217 Chestnut Street,
Block 3101, Lot 33.01, and 130 East Second Avenue, Block 3101, Lot
5. These regulations shall be deemed to be in addition to any special
regulations provided for in any individual parking lot.

A.
If any vehicle is parked in a parking space herein provided for in
violation of the provisions of this chapter, the Police Department
may cause any such vehicle to be removed to such a place as is designated
by the Chief of Police. The owner or operator of any vehicle so removed
shall pay the reasonable cost and expense of such removal and storage
which may result.
B.
Permit parking is established in the following municipal lots: 217
Chestnut Street, Block 3101, Lot 33.01, and 130 East Second Avenue,
Block 3101, Lot 5, as indicated in this article. The Police Department
is hereby authorized to issue persons applying therefor, on payment
of the required fees, on a first-come-first-served basis, permits
for the parking of motor vehicles in the parking spaces. Said permits
shall be issued on a quarterly basis for the period of three months,
commencing January 1, April 1, July 1 and October 1 of each year,
and each permit shall authorize the person to whom it has been issued
to park a designated motor vehicle at a designated space provided
in the Borough during the hours when vehicles may be legally parked
in said space. The right to renew shall be subject to payment within
five days of the due date. Failure to comply will result in the leasing
of the permit to the next available applicant.
C.
The fee for obtaining one parking permit shall be $60 per quarter,
payable in advance.
D.
At the time of the issuance of each permit, the Police Department
shall also issue to the person to whom the permit is granted a sticker
containing the registration number of the motor vehicle for which
the permit was issued and the permit number and the expiration date
of said permit designated by the Quarter No. 1, 2, 3 or 4. Each person
to whom a parking sticker is issued shall display same in the lower
right corner of the inside of the rear window of the motor vehicle
for which the permit was issued in such a manner as to be clearly
visible to any officer enforcing parking regulations.
E.
If any vehicle is parked in any permit parking space without the
necessary permit as indicated aforementioned in violation of the provisions
of this article, the Police Department may cause any such vehicle
to be removed to such a place as is designated by the Chief of Police.
The owner or operator of any vehicle so removed shall pay the reasonable
cost and expense of such removal and storage which may result.

No vehicle shall be parked or stopped adjacent to any space in a preferential parking zone described in Schedule XXVII (§ 523-136) attached to and made a part of this chapter.

A.
Except as provided for in § 523-25A, it shall be unlawful for any person to sell, rent, transfer or lease or cause to be sold, rented, transferred or leased for any value or consideration or no value or consideration any preferential parking permit. Upon conviction of a violation of this subsection, all preferential permits issued to or for the benefit of the unit for which the sold, rented, transferred or leased permit was authorized shall be void and shall be returned to the Police Department.
B.
It shall be unlawful for any person to buy or otherwise acquire for
value or otherwise use any preferential parking permit, except as
provided for in this chapter.

A.
The Police Department shall issue four permits for preferential parking.
The permits shall be issued to the owner of Block 3101, Lot 34. The
owner, in his sole discretion, will designate the holder of the permit.
The owner shall provide the Police Department with the name of the
holder of the permit and the make, model and license plate of the
owner of the vehicle.
B.
Applications for preferential parking permits under this article
shall be made in writing on forms provided by the Police Department.
C.
Duration of permits. Permits issued pursuant to this section shall
remain effective from January 1 to December 30 of the year following
the date of issuance, or fraction thereof, or as long as the applicant
continues to own Block 3101, Lot 34, or until the preferential parking
zone for which such permit was issued is eliminated, whichever period
of time is less. Renewals for any permits shall be applied for and
issued during the month of December preceding the period for which
a renewal is sought. Each renewal shall be subject to the same conditions
and restrictions as any new application. Permits are nontransferable
except as provided heretofore.
D.
The permit shall be returned to the Police Department upon sale,
junking or other transfer of a vehicle. Permits shall be surrendered
to the Police Department when moving outside the permit parking area.
New permits will be issued if a substitute vehicle is purchased or
leased.
E.
Conditions of permits. Each permit issued shall be subject to all
the conditions and restrictions set forth in this chapter and of the
preferential parking zone for which it was issued, including conditions
and restrictions which may be altered or amended from time to time.
The issuance of such permit shall not be construed to be a permit
for, or approval to, violate any provision of this chapter or any
other laws or regulations.
F.
All permits shall be displayed on the lower right corner of the inside
of the rear window of the vehicle in such a manner as to be clearly
visible to any officer enforcing parking regulations.
G.
There will not be any application fee required to obtain any permit.
The Police Department may remove, at the owner's expense, any
vehicle in violation of this article.
No person shall park a vehicle at any time upon any of the streets or parts there of which are described in Schedule XII (§ 523-122), attached to and made a part of this chapter.
No person shall stop or stand a vehicle upon any of the streets described in Schedule XIII (§ 523-123), attached to and made a part of this chapter.

A.
Wherever any words or phrases are used in this section, the meaning
respectfully ascribed to them in Title 39:1-1, Definitions, of the
New Jersey Statutes Annotated shall be deemed to apply to such wards
and phrases used herein.
B.
No person shall park any truck, bus, truck/trailer, truck semitrailer,
jitney, pickup trucks, vans or trucks of any type with commercial
markings, trucks of any type loaded or equipped in a manner that would
lead a reasonable observer to believe that same was being used for
commercial or industrial purposes, or recreational vehicles, upon
any street within the Borough of Roselle between the hours of 11:00
p.m. and 6:00 a.m.
C.
Pickup or delivery and services.
(1)
Notwithstanding the foregoing, hereafter, there shall be no parking
on any street within the Borough of Roselle of the following vehicles,
at any time, except during the hours of 6:00 a.m. to 7:00 p.m. for
the pickup and delivery of material on or in front at such building
in which the vehicle shall be parked in front of (loading and unloading),
or while owner/driver is providing service or commodity to a residence,
business or commercial facility when such vehicles are being used
for work in connection with the furnishing or supplying of the service
or commodity:
(a)
Trucks with a registered gross vehicle weight of 4 (tons) or
both;
(b)
Buses of any type;
(c)
Truck/trailer;
(d)
Truck semitrailer;
(e)
Jitneys;
(f)
Pickup trucks, vans or trucks of any type with commercial markings;
(g)
Trucks of any type loaded or equipped in a manner that would
lead a reasonable observer to believe that same was being used for
commercial or industrial purposes; and
(h)
Recreational vehicles, at any time, except for the pickup and
delivery of material on or in front at such building in which the
vehicle shall be parked in front of.
(2)
For purpose of this section, "recreational vehicles" will be defined
as self-propelled or towed vehicle equipped to serve as temporary
living quarters for recreational, camping or traveling purposes. Additionally,
boats on trailers used solely for family or personal purposes will
be considered recreational vehicles.
D.
The provisions of this section shall not apply to vehicles owned
by a public utility as defined in N.J.S.A. 48:2-13 when such vehicles
are being used for work in connection with the furnishing or supplying
of the commodity which by law the public utility is authorized to
furnish or supply.
E.
Proper signs shall be erected by the Police Department pursuant to
law (N.J.S.A. 39:4-198).
F.
Violations and penalties.
(1)
Any person, association or corporation who shall violate the provisions
of this section shall, upon conviction, be subject to a fine of not
less than $250 nor more than $2,000 or imprisonment for a period not
to exceed 30 days, or both, at the discretion of the court.

(2)
In addition to the above penalties set forth in Subsection F(1), the Borough Police Department, after the issuance of a second summons to the same vehicle within a thirty-day period, may cause such vehicle to be towed or otherwise removed from the public street or municipal property with the owner of such vehicle being responsible for the cost of such removal.
No person shall park a vehicle between the hours specified in Schedule XV (§ 523-124) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to and made a part of this chapter.
No person shall stop a vehicle during the times specified in Schedule XVI (§ 523-125) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, attached to and made part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVII (§ 523-126) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVII, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 523-127) at any time between the hours listed in said Schedule XVIII of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVIII, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX (§ 523-128), except at the angle designated and only within the painted stall lines. On all streets and portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
The locations described in Schedule XX (§ 523-129), attached to and made a part of this chapter, are hereby designated as loading zones.
The locations described in Schedule XXI (§ 523-130), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXII (§ 523-131), attached to and made a part of this chapter, are hereby designated as bus stops.

A.
The locations listed on Schedule XXIX, § 523-138, are hereby designated as restricted parking spaces reserved for use by a specific person in front of a certain residence who has been issued special vehicle identification cards by the Division of Motor Vehicles, pursuant to the provisions of N.J.S.A. 39:4-205, when using a motor vehicle on which is displayed a certificate for which a special vehicle identification card has been issued, pursuant to N.J.S.A. 39:4-206. All spaces indicated hereby shall be painted and signed in accordance with the applicable regulations issued from time to time by the State of New Jersey Department of Transportation.
B.
Violations and penalties; schedule of restricted handicap parking
spaces.
(1)
Any person parking a motor vehicle in a parking space restricted
for use to persons who have been issued special vehicle identification
cards or wheelchair symbol license plates by the Division of Motor
Vehicles without such a special vehicle identification card or wheelchair
symbol license plate shall be liable to a fine of $250 for the first
offense and, for subsequent offenses, a fine of at least $250 and
up to 90 days' community service on such terms and in such form as
the court shall deem appropriate, or any combination thereof. This
penalty provision shall apply to vehicles parked on public or private
property.
C.
Change in residence.
(1)
If any person for whom a parking space has been designated pursuant
to this section ceases to reside at the specified resident address,
he or she shall promptly notify the Borough Clerk in writing that
the designated parking space is no longer required.
(2)
In the event that the person holding the designated handicapped parking
permit no longer resides at the specified residence address, the designation
may be terminated by resolution.

A.
BOROUGH
MOTOR VEHICLE or VEHICLE
PARK STREET AREA
Definition and word usage. As used in this section, the following
terms shall have the meanings indicated:
The Borough of Roselle.
Includes all vehicles propelled otherwise than by muscular
power, excepting such vehicles as run only upon rails or tracks and
motorized bicycles, as defined in N.J.S.A. 39:1-1 et seq.
The 100 Block of Park Street that is within the confines
of the Borough of Roselle Property Tax Map.
B.
Issuance of parking permit.
(1)
Every resident who resides in the Park Street Area of the Borough shall be provided an annual parking permit for each vehicle registered at such address by the Roselle Police Department which permit shall be placed conspicuously on the vehicle's front driver's dashboard (if a placard) or driver side rear window (if a sticker). The permits shall be numbered such that each permit may be associated with the resident who resides in the Park Street Area to whom it was issued. The permits shall be mailed by the Borough to the address provided by the resident as reflected in the application provided for in Subsection D hereof.
(2)
Every resident who resides in the Park Street Area of the Borough
may apply, not more than four times per month, to the Roselle Police
Department for up to 10 daily guest parking permits per household.
The daily guest parking permit shall be placed conspicuously on the
vehicle's front driver's dashboard. The daily guest parking permit
shall indicate the date for which it is valid (e.g., 8:00 p.m. Monday
until 6:00 a.m. Tuesday), and identify the residence it is associated
with in the Park Street Area. A resident may apply for additional
guest parking permits, and, upon a showing of good cause, the Police
Department, may issue additional permits. The daily guest parking
permit shall be in such form as adopted by the Police Department.
C.
Parking restriction. Parking in the Park Street Area shall be restricted
to those licensed, registered and insured vehicles displaying a valid
parking permit between the hours of 6:00 p.m. and 6:00 a.m.
D.
Permits for residents. Any resident who desires a parking permit
to enable him/her to park a vehicle in non-metered spaces in the Park
Street Area during the restricted period may apply for a parking permit
under this section by completing a form, to be provided by the Borough,
detailing the applicant's name and address, insurance, and the registration
number of the motor vehicle for which the applicant desires a parking
permit. Residents may obtain a parking permit for each vehicle registered
to such resident.
E.
Placement of signs. Signs posted to indicate the requirements imposed
by this section shall be placed in the Park Street Area in accordance
with existing rules and regulations of the State of New Jersey.
F.
Duration, restrictions and prohibitions.
(1)
Each permit shall be issued upon request of any resident of the Park
Street Area, on an annual basis commencing on January 3 of each year.
There shall be no proration if less than the full relevant period
remains at the time an application for a permit is submitted.

Parking permission is subject to:

Permission to park may be revoked for any of the following:
(a)
Falsely representing the ownership of a vehicle or the residence
of the owner;
(b)
The commission by the holder of a parking permit of any unlawful
act prohibited by the laws of the State of New Jersey or for any act
in violation of the provisions of this section or contrary to any
regulation of the Borough pertaining to the use and occupation of
any parking area while entering, parking or leaving such parking area
as set forth in this section.
(4)
Reproduction of any parking permit is prohibited:
(b)
No person shall furnish false information or fraudulent documents
in connection with an application for a parking permit.
(c)
Any person found violating the provisions of this Subsection F shall be subject to a fine not to exceed $2,000 and/or imprisonment for not more than 10 days, and shall forfeit the right to receive or use a parking permit under this section for a period of three years.
(d)
No parking permit may be issued to a person with three or more outstanding summonses for violation of any of the provisions of Subsection F of this section. Further, the Borough may provide for the removal of any vehicle which is allowed to stand or be parked in any parking area in violation of the provisions of Subsection F of this section. The owner of such vehicle shall bear the reasonable cost of removal and storage that may result from such removal before regaining possession of the vehicle.
G.
Proper signs shall be erected by the Borough pursuant to law (N.J.S.A.
39:4-198).
H.
Violations and penalties. Any person, association or corporation
who shall violate the provisions of this section shall, upon conviction,
be subject to a fine of not less than $150 per violation. The fine
prescribed for a person, association or corporation wishing to admit
the commission of the parking offense with no court appearance required
shall be $183.
