A. 
The purpose of this article is to:
(1) 
Promote pedestrian safety (including those of minors);
(2) 
Avoid life-threatening situations; and
(3) 
Coordinate traffic control through the joint coordinated effort of the Borough's Police Department, Public Works Department and Board of Education.
B. 
This article shall apply to all pedestrians.
C. 
While there is an essential need to protect minors and promote pedestrian safety, the goal is not to punish children by subjecting them to a penalty of a fine, imprisonment or both, but to educate them so that they may become responsible citizens conducting themselves in a safe and orderly manner.
D. 
This article is declared to be remedial and essential to the public interest, and it is intended that this article be liberally construed to effectuate the purposes as stated in this article.
Pedestrian travel on streets, avenues and other roadways within the Borough. On streets, avenues and other roadways within the Borough where traffic is controlled by a traffic control signal or by police officers, traffic officers or school traffic guards, pedestrians shall not travel in the roadway or cross the roadway against the red or stop signal unless otherwise specifically directed to go by a police officer, traffic officer or school traffic guard or other traffic control device. Where traffic is not controlled and directed by either a police officer, traffic officer or school traffic guard, pedestrians shall not travel in the roadway and shall cross the street, avenue or roadway within a crosswalk or, in the absence of a crosswalk, and where not otherwise prohibited, at right angles to the roadway. Where sidewalks are provided, it shall be unlawful for any pedestrian to walk along and upon an adjacent street, avenue and roadway, except in case of any emergency. Where sidewalks are not provided, it shall be unlawful for any pedestrian to block or impede the driver/operator of any motor vehicle from traveling along and upon the street, avenue, and roadway, except in case of an emergency.
At intersections where traffic is directed by a police officer, traffic officer or school crossing guard, no pedestrian shall enter upon or cross the roadway at a point other than the crosswalk.
The operator of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within a marked crosswalk or within any unmarked crosswalk at an intersection, except at crosswalks when the movement of traffic is being regulated by police officers, traffic officers, school traffic guards or other traffic control signals, or where otherwise prohibited by state, county or other municipal regulations and codes. No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for an operator to yield. Nothing contained within the provisions of this article shall relieve a pedestrian from using due care and caution for his safety. Every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway.
Penalties under this article shall be controlled by the provisions as provided for hereunder.
It is a violation of this article for any person to do any act forbidden or fail to perform any act required in this article.
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this article or any supplement thereto.
A. 
Any person who violates or fails or refuses to comply with this article shall be liable to a penalty of not less than $5 nor more than $50 for each offense, to be recovered by and in the name of the Borough, except that, for the first offense in case of violations, the penalty shall not be less than $1 nor more than $50, to be recovered in the same manner. A person who refuses or neglects to pay forthwith the amount of a judgment rendered against him or her and the costs and charges incident thereto may be committed by the Judge to the county jail for a period not exceeding 10 days in the case of the first conviction, and, in the case of a second, subsequent or continuing violation, for a term not exceeding 30 days.
B. 
Any person who violates any provision hereof for a second or third offense shall, upon conviction thereof, be punished by a fine not exceeding $250 for a second offense or $500 for a third offense and may be subject to imprisonment in the county/municipal jail for a term not exceeding 90 days, or a period of community service not exceeding 90 days, or any combination thereof as determined by the Municipal Court Judge. Each day on which a violation of an ordinance exists shall be considered a separate and distinct violation and shall be subject to imposition of a separate penalty for each day of the violation as the Municipal Court Judge may determine.
