[Adopted as Ch. 85, Art. II, of the 1975 Borough Code]
No person, except as in this article provided, shall solicit, canvass or call from house to house to sell goods by sample or to take orders for future delivery, with or without accepting advance payments, without having first reported to and received a written permit from the Chief of Police or the officer in charge of police headquarters.
A. 
Before the permit required by the preceding section may be issued, the solicitor or canvasser shall make an application in writing to the Chief of Police, giving the following information:
(1) 
Full name and address.
(2) 
Place or places of residence for the preceding three years.
(3) 
By whom employed and address of employer.
(4) 
Date for which permit is requested.
(5) 
Nature of merchandise solicited or canvassed.
(6) 
Whether or not previously arrested or convicted for disorderly persons offenses or crimes and the nature of each such offense or crime.
B. 
The application shall be accompanied by a letter from the individual, partnership or corporation for which the applicant purports to work, authorizing the applicant to act as his representative.
C. 
Each applicant shall furnish a photograph of himself before a permit may be issued.
After due investigation, upon being satisfied that the applicant is of good moral character and that he is soliciting or canvassing for a project free from fraud, the Chief of Police or, in his absence, the officer in charge at police headquarters, shall grant a permit to solicit or canvass. A copy of the photograph aforesaid shall be attached to said permit.
At the time of the issuance of the permit, there shall also be issued to each solicitor or canvasser a button approximately 3 1/2 inches in diameter on which substantially the following legend shall appear: "Canvasser - Roselle Police No. 000." Upon the issuance of said permit and button, the canvasser shall deposit with the Chief of Police or, in his absence, the officer in charge of police headquarters, the sum of $5. While canvassing, the canvasser shall display said button in a prominent and suitable place on his outer garment.

Every permit issued under the provisions of this article shall limit the period of solicitation or canvassing to such period as designated at the discretion of the Mayor and Council.
A permit granted as provided in this article shall be revoked by the Chief of Police or, in his absence, the officer in charge of police headquarters, on the basis of further investigation with regard to the character of the permittee or upon the failure or default of the permittee to observe the provisions of this article.

A. 
No person shall solicit or canvass except between the hours of 9:00 a.m. and 9:00 p.m. on days other than Saturday, Sunday and holidays.

No person shall solicit or canvass except between the hours of 12:00 noon and 9:00 p.m. on Saturday, Sunday and holidays.

C. 
The permittee shall exhibit his permit to any police officer or other person upon request. The permittee shall be courteous and respectful to all persons in canvassing, shall not importune or annoy any inhabitants of the Borough and shall conduct himself in a lawful manner. Upon the expiration of the permit, the holder thereof shall either surrender the same to the officer in charge at police headquarters or apply for a renewal thereof. At the time of the surrender of said permit, the canvasser shall return the aforesaid button and the deposit of $5 shall be refunded to him.
This article shall not affect any person engaged in the delivery of goods, wares or merchandise or other articles or things in the regular course of business to the premises of persons ordering or entitled to receive the same, nor employees of any public utility subject to the regulations of the Board of Public Utility Commissioners of the State of New Jersey when carrying a card of identification issued by such utility company.

Any person violating the provisions of this article shall be subject, upon conviction thereof, in addition to the revocation of the permit, to a fine not exceeding $500 or to imprisonment in the county jail for a period not exceeding 90 days, or both.
