There shall be established in the Borough of Roselle a department known as the "Department of Public Works of the Borough of Roselle," to have jurisdiction over municipal roads as well as public works projects as more specifically designated by Mayor and Council.
Mayor and Council hereby establishes the position of Superintendent of Public Works for the Borough of Roselle.
The Superintendent of Public Works shall be the executive officer in the Department of Public Works and shall be appointed by the Mayor with the advice and consent of the Borough Council pursuant to state law. The term of office of the Superintendent of Public Works shall be one year commencing on January 1 of each year with a salary thereafter provided for in the Salary Ordinance of the Borough of Roselle.
The Superintendent of Public Works shall have the qualification of and hold a Public Works Manager certificate pursuant to N.J.S.A. 40A:9-154.6c et seq.
The Superintendent of Public Works shall perform the following duties:
A. 
The Superintendent of Public Works shall have full charge and management of the Department of Public Works and of the other personnel and employees in said Department as may from time to time be authorized by resolution of the Mayor and Borough Council.
B. 
He shall keep accurate time cards, personnel and payroll records and an accurate account of all his transactions as Superintendent of Public Works, of the work and transactions of his office and the personnel serving thereunder. He shall prepare budget recommendations for the Department and shall have full charge and management of the properties and equipment belonging or assigned to the Department of Public Works.
C. 
He shall render to the Mayor and Borough Council such reports, recommendations, drawings or other documents as may be required at regular stated intervals or upon special request therefor.
D. 
The Superintendent of Public Works shall coordinate the work of the Department of Public Works with the work of the other Borough departments as it applies to public works projects. He shall be available for advice, guidance and consultation to the other departments of the Borough.
E. 
He shall direct the Department purchasing activities, including the preparation of technical specifications for equipment, materials and other items for purchasing; assist supervisory personnel in departmental training and safety programs; confer with citizens, contractors, suppliers and local officials; and direct the investigation and disposition of complaints, if any, relative to public works services and facilities.
F. 
He shall supervise all recycling within the Borough; vehicle maintenance; traffic signs, sidewalk maintenance; curbing maintenance; catch basin maintenance; painting; street sweeping; stormwater management; sanitation; designated nonresidential waste removal; collection and removal of leaves; snow removal; and maintenance of public buildings.
G. 
Such other duties and responsibilities as the Mayor and Council may direct.
Within the Department of Public Works shall be a Division of Buildings and Grounds and a Division of Streets and Roads, each headed by a supervisor.

A. 
Establishment. A Division to be known as the "Borough of Roselle Shade Tree Division" is hereby established within the Borough of Roselle Department of Public Works.
B. 
Purpose. The purpose of the Shade Tree Division shall be to:
(1) 
Make recommendations to the Mayor and Borough Council concerning the planting, maintenance, control, protection and improvement of shade trees and shrubbery along public streets and roads and public places within the Borough of Roselle.
(2) 
Replace and perform, among others, the duties and responsibilities of the entity formerly known as the "Borough of Roselle Shade Tree Commission."
(3) 
Establish and enact programs for the protection and preservation, removal and/or replacement of existing shade trees and shrubbery situated in the public rights-of-way and upon Borough-owned properties.
(4) 
Continue, revise and maintain, as deemed appropriate, existing plans and programs for the planting of new trees and shrubbery within and upon the Borough-controlled properties, and establish and enact such plans and programs when deemed necessary to do so by the Borough Council.
C. 
Powers and duties. The Shade Tree Division shall bear the ultimate responsibility for all matters concerning the planting, maintenance, control, protection, improvement of shade trees and shrubbery along public streets and other public places within the Borough of Roselle. The functions and responsibilities for the Shade Tree Division shall be implemented through and under the direction of the Superintendent of Public Works, as may be modified from time to time by action of the Borough Council, and shall consist of the following:
(1) 
To exercise full and exclusive control, under the direction of the Superintendent of Public Works, over the regulation, planting and care of shade and ornamental trees and shrubbery now located or which may hereafter be planted in any public road, park or parkway, except county parks or parkways, of the Borough, including the planting, trimming, spraying, care and protection thereof.
(2) 
To regulate and control the use of the ground surrounding such trees and shrubbery so far as may be necessary for their proper growth, care and protection.
(3) 
To move, or require the removal of, any tree or part thereof dangerous to public safety, at the expense of the owner of such tree.
(4) 
To assess, inspect and inventory all shade trees and shrubbery located along public streets and roads and public places within the Borough of Roselle.
(5) 
To make determinations with respect to the planting, maintenance, control, protection and improvement of such shade trees and shrubbery.
(6) 
To work in concert with such other municipal departments and employees as may be directed by the Superintendent of Public Works.
(7) 
Under the supervision of the Superintendent of Public Works, to work in cooperation with such outside contractors, vendors and suppliers who may be approved by the Borough Council.
(8) 
To review subdivision plans and make recommendations through the Superintendent of Public Works to the Planning Board, Zoning Board, and or Development Review Committee with respect to tree selection, planting and location.
(9) 
At the request of the Borough Council, to carry out such studies and perform such duties for shade tree care and preservation as the Borough Council may from time to time request, and to prepare and provide to the Borough Council such reports, recommendations, analyses and conduct investigations as to matters relating to all other duties, responsibilities and functions set forth within this section.
(10) 
To grant permits for the conduct of certain activities specified in §§ 430-2 and 430-3 of the Borough Code.
(11) 
To levy fines for violations of §§ 430-2 and 430-3 in accordance with the fee schedule set forth in § 430-4.
(12) 
To review all requests for the removal of any diseased, decayed or otherwise damaged tree situated on public property or within a public right-of-way, which presents a public hazard or creates a blight and, to report its recommendations to the Superintendent of Public Works concerning the action to be taken in connection with such request,
(13) 
To disseminate information to property owners concerning tree selection (particularly as to disease-prone and insect-prone trees), planting, composting, pruning and such other information as the Shade Tree Division may deem advisable for the protection and preservation of shade trees within the Borough.
(14) 
To review requests of public utility companies for the pruning or removal of trees within a utility right-of-way and to recommend to the Borough Council approval or disapproval of the request made or of the action to be taken.
(15) 
To study and advise the Borough Council as to the necessity of shade tree replacement on public property and as to the need for programs, ordinances or other forms of planning and control for the installation, protection and preservation of shade trees within the Borough.
(16) 
In addition to the enumerated powers granted herein, the Shade Tree Division shall have such other powers as may be from time to time provided for by law.
(17) 
To remove any tree or part thereof at the expense of the owner of the property where such tree is located, provided that such tree has been deemed by an expert to be diseased, decayed or is an otherwise-damaged tree, which presents a public hazard and constitutes a danger to the public, health and safety, and is in danger of falling on public property or the property of adjoining landowners in the Borough. In such case, the property owner is to be given notice to remove the tree or part thereof, and shall remove same within 10 days after notice. If the property owner refuses or neglects to remove the same in a manner necessary and expedient for the preservation of the public health, safety and general welfare, or to eliminate a hazard, within the time provided in the notice, the Borough Code Enforcement Officer shall provide for its removal by and under the direction of the Department of Public Works, Shade Tree Division, and the owner shall be subject to the imposition of penalties and costs as provided in this chapter.
(18) 
Establishment of lien. In all cases where trees, stumps, roots are removed from any lands in private ownership by or under the direction of the Department of Public Works, the Director of Public Works shall certify the cost thereof to the Borough Council, which shall examine the certificate and, if found current, shall cause the cost as shown thereon to be charged against the lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.
D. 
Personnel. The Shade Tree Division shall have the following personnel:
(1) 
No less than two employment positions shall be created by the Borough Council so as to staff the Shade Tree Division with sufficient personnel to perform the administrative, investigatory and field-related tasks necessary to carry out the functions, powers and duties of the Shade Tree Division.
(2) 
All Shade Tree Division staff shall, or within a reasonable time period after hiring will, have participated in and successfully completed a training skills and accreditation program established pursuant to Section 6 of P.L. 1996, c. 135 (N.J.S.A. 13:1L-17.6).
(3) 
All Borough of Roselle departments and officials, including, but not limited to, the Mayor and Council, the Department of Engineering and the Department of Finance, shall work constructively and cooperatively with Shade Tree Division to implement and effectuate the provisions of this section. Establish and enact programs for the protection and preservation, removal and/or replacement of existing shade trees and shrubbery situated in the public rights-of-way and upon Borough-owned properties.
(4) 
Continue, revise and maintain, as deemed appropriate, existing plans and programs for the planting of new trees and shrubbery within and upon the Borough-controlled properties, and establish and enact such plans and programs when deemed necessary to do so by the Borough Council.
E. 
Records. The Shade Tree Division shall keep complete and accurate records of its activities and shall make an annual report to the Mayor and Council.
