[Adopted 11-24-1987 by Ord. No. 1689; amended in its entirety 2-21-1996 by Ord. No. 1999 (Ch. 55, Art. II, of the 1975 Borough Code)]
As used herein, the following terms shall have the meanings indicated:
POTENTIALLY DANGEROUS DOG
Any dog or dog hybrid declared potentially dangerous by a municipal court pursuant to Section 7 of P.L. 1989, c. 307 (N.J.S.A. 4:19-23).
VICIOUS DOG
Any dog or dog hybrid declared vicious by a municipal court pursuant to Section 6 of P.L. 1989, c. 307 (N.J.S.A. 4:19-22).
A. 
Any person, corporation, partnership or other association within the Borough of Roselle who owns a vicious or potentially dangerous dog shall obtain a special license therefor from the Borough of Roselle. Such license shall be obtained within 30 days of the effective date of this article. Such license shall be in addition to any other license required by local ordinance or state statute.
B. 
The application for the license shall contain such information as the Borough of Roselle feels is in the best interests of the Borough of Roselle to know, including but not limited to the following: the name and address of the owner and handler and the address where the vicious or potentially dangerous dog is to be housed or maintained. In the event any of the information on said application indicating the new information at least one week prior to such change.
A. 
No person under the age of 18 years may own, control, attempt to control or walk a vicious or potentially dangerous dog. In the event of a violation of this section, such person may be charged with an act of delinquency if so permitted by state statute, and the owner and/or handler of the vicious or potentially dangerous dog, if the owner and/or handler is 18 years of age or over, shall be subject to the fines and penalties set forth in this article.
B. 
No person shall walk more than one vicious or potentially dangerous dog at a time.
A. 
In the event any vicious or potentially dangerous dog is sold or otherwise transferred to another person, corporation, partnership or association, the transfer of ownership shall be reported to the Borough of Roselle on an amended application form to be filed with the Borough of Roselle at least one week in advance of such sale or transfer.
B. 
Whenever a vicious or potentially dangerous dog is outside of closed premises, it shall have a muzzle securely affixed to the animal's mouth which shall be affixed to a harness and which must prevent the animal from using its mouth for fighting. The leash and collar must be of steel only, and no barbed-wire collar or other type of collar shall be permitted on the vicious or potentially dangerous dog which shall hamper efforts to subdue the animal. In addition, any owner and/or handler who walks such an animal shall carry with him/her an implement which can force open the animal's jaws.

A. 
All applications and amended applications filed herein shall be on file with the office of the Health Officer and shall be accompanied by a fee of $10 for an initial application and a fee of $5 for subsequent applications or amendments.
B. 
The Health Officer shall forthwith transmit copies of each such application, subsequent application and amendment to the Police and Fire Departments and such other departments as shall request such information.
Any person, partnership, association or corporation which shall violate any of the provisions of this article may be fined in an amount not to exceed $1,000 and/or six months in jail for each such violation. In addition, if any person, partnership, association or corporation is guilty of a second or subsequent offense under this article, the animal in question shall be confiscated by the Borough of Roselle.
