As used in this chapter, the following terms shall have the meanings indicated:
TANK
Any tank which is used for oil, waste material, septic tanks and gasoline.
All tanks removed from the ground of any structure shall require a permit from the Building Department and shall be disposed of within five days of the date hereof.
In the interim period, said tanks shall be secured in such a manner as to avoid being a danger to the neighbors and their children in the surrounding area.
The hole from whence the tank was removed shall be covered within 72 hours if soil tests reveal that the ground is not contaminated.
During the 72 hours, the hole must be secured with guards as defined in BOCA to prevent any danger to the neighbors and their children in the surrounding area.
The penalty for a violation of this chapter shall be $100 per day assessed against the owner of the premises.
In the event that the tank is not removed from the premises within five days from the date of its removal from the ground, the Borough of Roselle, at its option, shall have the same removed by order of the Code Official and disposed of at the cost of the owner, and the charge thereof shall constitute a lien against the premises in question.
In the event that the excavation has not been filled within 72 hours from the date of the removal of the tank from the ground, the Borough of Roselle, at its option, shall have the same filled at the cost of the owner and the charge thereof shall constitute a lien against the premises in question.
