(a) 
The land and improvements thereon, commonly known as "724 Park Avenue, Plainfield, New Jersey," Block 713, Lot 3, granted to the City of Plainfield by the First Unitarian Society of Plainfield by deed dated May 15, 2019, is named the "Plainfield Arts, Culture and Education Center."
(b) 
The Plainfield Arts, Culture and Education Center is administered by the Department of Health and Social Services, through the Division of Community Development, and shall be dedicated to the pursuit of artistic, cultural, educational, and other activities of interest that might benefit the community and that are appropriate for the facilities of the Plainfield Arts, Culture and Education Center.
As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Any liquid (or solid that can be converted into a liquid) that is fit to drink and has an alcoholic content of more than 1/2 of 1% by volume is an alcoholic beverage and is subject to control by the Division of Alcoholic Beverage Control. This includes, but is not limited to, beer, wine, and spirits. A license or permit from Alcoholic Beverage Control is required to make, distribute or sell any such alcoholic beverage.
EDUCATIONAL OR STUDENT FILMS
A not-for-profit film made by currently enrolled students under the sponsorship of an accredited school or institution of higher learning who have evidenced such sponsorship with a letter written on school letterhead signed by a school administrator and who present a certificate of insurance. Student films are required to obtain a Plainfield filming permit at the Municipal Clerk's office.
EDUCATIONAL RECITALS
Performances offered at the end of an educational program that do not have any fee charged in connection with admission for attendance at such recital.
PHOTOGRAPHY/PHOTOSHOOTS
Photographs or other visual impressions that are not films that are sold, leased or otherwise commercially exchanged and all activity related to the staging or shooting of such photographs or visual expressions.
PRIVATE EVENTS
All events that have invited attendees and are not open to the public. Private events do not generally have fees charged in connection with attendance. Examples include, but are not limited to, meetings, workshops, classes, private art exhibitions, and/or private parties.
PUBLIC EVENTS AND/OR EVENTS OPEN TO THE PUBLIC
All events that are open to the public, whether or not there are admission fees charged. All events open to the public are required to provide proof of insurance.

Friday through Sunday.

Considerations.

Plainfield residents must supply proof of residency.
(2) 
Nonprofit organizations must supply a copy of the IRS 501(c)(3) designation letter.
(3) 
Weekend rates: If starting after 1:00 p.m. on weekends, rentals have a four-hour minimum.

(3) 
Filming in the Plainfield Arts, Culture and Education Center.
(A) 
The Arts, Culture and Education Center is available for filming and photoshoots. Selective filming requires a City of Plainfield film permit to film in the Plainfield, Arts Culture and Education Center.
(B)

(C) 
"Film shoots" do not include filming connected with private social activities at the Plainfield Arts, Culture and Education Center, including weddings, unless the filming or photography at such events is sold, leased, rented or used in any commercial purposes, including reality television, in which event a Plainfield film permit must be obtained and all fees paid.
(4) 
Multiple room rentals.
(A) 
Rentals of both the Theater and Heritage Hall receive a 20% discount to the Theater rate. To receive the discount, both rentals must be booked in advance and at the same time.
(B) 
Renters of the Theater and/or Heritage Hall may rent the main kitchen at $20 per hour. Kitchen rental does not include cooking facilities, such as oven, stove, or grill.
(C) 
At the City's discretion, Heritage Hall may be rented at the Theater rate.
(D) 
Renters of both the Theater and at least one classroom receive a 20% discount to the classroom rate.
(E) 
Garden rental: Renters of the Garden Room may rent the garden for an additional $25 per hour.
(5) 
Additional costs, charges, and requirements:
(A) 
Police officer: Any event with the service of alcoholic beverages and over 100 attendees and/or any event with 150 or more attendees requires paid police presence.
(B) 
Hiring of an off-duty police officer for Friday-Sunday evening activities or activities with alcoholic beverages. There is a four-hour minimum for this requirement.
(C) 
Additional hours for event setup or breakdown are available at 50% of the standard hourly rate.
(D) 
Refundable security deposit: A refundable security deposit will be charged for all rentals. Deposit costs depend on the day, room, and activity: $150-$300.
(E) 
Sound or lighting technician: $40-$60 per hour; four-hour minimum (upon availability).
(F) 
Additional tables, chairs, sound system, piano, setup/breakdown assistance: $25-$150.
(G) 
Per-table fee: $2.50.
(H) 
Additional chair fee: $1 per chair over 60 chairs.
(I) 
Additional costs for garbage/recycling may be passed on to the renter.
(J) 
Alcohol fee and surcharge: This fee will be charged for any event where alcoholic beverages are served. This fee is in addition to the Division of Alcoholic Beverage Control (ABC) permit.
(i) 
Theater/Garden Room: $125.
(ii) 
Nonprofit Theater/Garden Room: $100.
(iii) 
Heritage Hall: $175.
(iv) 
Nonprofit Heritage Hall: $125.
(K) 
Multiple-use discount: This discount is available on rental fees only and must be booked in advance and at the same time.
(i) 
Eight or more rentals annually: eligible for 10% discount.
(ii) 
Twenty or more rentals annually: eligible for 20% discount.
(L) 
Cancellation fees:
(i) 
Processing fee for cancellation: $40.
(ii) 
If the renter cancels within 30 days of the event without rescheduling the event, the City will refund 50% of the total rental fees.
(iii) 
If a renter cancels within 10 days of the event without rescheduling the event, the City will refund 25% of the total rental fees.
(M) 
Insurance: Any and all events open to the public and/or any events where alcohol is served at the Plainfield Arts, Culture and Education Center are required to secure insurance and provide proof of insurance as follows:
(i) 
Public liability insurance of not less than $1,000,000 per person and $500,000 per accident covering all aspects of the planned activity.
(ii) 
The rental applicant shall furnish evidence of property damage insurance coverage of not less than $1,000,000.
(iii) 
The rental applicant shall furnish a cash or surety bond for $1,000,000 conditioned that no damage is incurred to City property or City streets and that no paper, litter or other debris will be permitted to remain upon the licensed premises or on the streets.
(iv) 
Each insurance policy required herein must contain an endorsement providing for 20 days' notice to the City in the event of any material change or cancellation of the policy.
(v) 
In the event any insurance policy required by this article shall lapse or is canceled by the issuing company, the rental and event will be suspended and the deposit withheld.
(N) 
Renters must agree, in writing, to indemnify and hold harmless the City from any and all liability or damages from the use of the Plainfield Arts, Culture and Education Center.
(O) 
Entertainment permit: Renters are required to make an affirmative statement that they have gone to the Municipal Clerk's office to review if their event is required to have a City of Plainfield entertainment permit. A copy of the filed permit must be submitted to the Plainfield Arts, Culture and Education Center within seven days of the event.
(P) 
Long-term licenses: Licenses for long-term use are available depending on space, duration, hours, and nature of the use of facilities.
(Q) 
The City may exercise its discretion regarding rates and fees to cosponsor and/or support cultural, educational or other activities that advance cultural, artistic, educational, economic and diversity opportunities of the City of Plainfield.
(R) 
Forms of payment: All fees shall be paid in cashier's checks or postal money order made out to the "City of Plainfield."
