Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle I of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time
as may be in current use in the township.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other more restrictive
provisions prohibiting or limiting the stopping, standing or parking
of vehicles as set forth in R.S. 39:4-138, any other New Jersey statute
or as hereinafter provided.

a. Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY NO PARKING
signs are displayed. The chief of police or, in his absence, the ranking
police officer is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, fire, public celebrations, etc., dictate or require the
avoidance of hazards or other conditions which interfere with the
free flow of traffic. Notification that EMERGENCY NO PARKING signs
are being or will be posted shall be given to the operator or owner
of any vehicle which has been parked prior to the posting of the signs.
b. Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and menace to the safe and proper regulations
of traffic and any police officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of removal and storage
which may result from such removal before regaining possession of
the vehicle.
c. The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

No person shall park a vehicle at any time upon any of the streets
or parts thereof described in Schedule I attached to and made a part
of this chapter.

a. No person shall park a vehicle upon any municipal street, road or
right-of-way between November 1 of each year and April 30 of the following
year.
b. The purpose of this subsection is to prohibit parking on municipal
streets, roads and rights-of-way to facilitate snow plowing between
November 1 of each year and April 30 of the following year.
c. Any unoccupied vehicle stopped or standing, in violation of this
subsection, shall be deemed a nuisance to the safe and proper regulation
of traffic, and any police officer or member of the Township Road
Department may authorize the removal of such vehicle by a private
towing company. The owner of such vehicle shall be responsible for
the cost of removal and storage before regaining possession of the
vehicle.

No person shall stop or stand a vehicle between the hours specified
in Schedule III of any day (except Sundays and public holidays) upon
any of the streets or parts of streets described in Schedule III attached
to and made a part of this chapter.

No person shall park a vehicle for longer than the time limit
shown in Schedule IV at any time between the hours listed in Schedule
IV of any day (except Sundays and public holidays) upon any of the
streets or parts of streets described in Schedule IV attached to and
made a part of this chapter.

Trucks over four tons gross weight are hereby excluded from
the streets or parts of streets described in Schedule V except for
the pick up and delivery of materials on such streets. Schedule V
being attached to and made a part of this chapter.

The streets or parts of streets described in Schedule VI attached
to and made a part of this chapter are hereby designated as one-way
streets in the direction indicated.

Pursuant to the provisions of R. S. 39:4-140, the streets or
parts of streets described in Schedule VII attached to and made a
part of this chapter are hereby designated as Through Streets. STOP
signs shall be installed on the near right side of each street intersecting
the Through Street except where YIELD signs are provided for in the
designations.

Pursuant to the provisions of R.S. 39:4-140, the intersections
described in Schedule VIII attached to and made a part of this chapter
are hereby designated as Stop Intersections. STOP signs shall be installed
as provided therein.

described in Schedule IX attached to and made a part of this chapter
are hereby designated as Yield Intersections. YIELD signs shall be
installed as provided therein.

Pursuant to the applicable provisions of N.J.S.A. Title 39 the
streets described in Schedule XVI attached to and made a part of this
chapter are controlled by speed limits as indicated. Regulatory and
warning signs shall be erected and maintained to effect the above
designated speed limits.

Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this ordinance
or any supplement thereto shall be liable to a penalty of not less
than $150 or more than $500 or imprisonment for a term not exceeding
15 days or both.
All former traffic ordinances of the Township of Lafayette covered
in this traffic chapter are hereby repealed except that this repeal
shall not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this ordinance.

The following words and terms, when used in this chapter, shall
have the following meanings, unless the context clearly indicates
otherwise:
ENGINE BRAKING
Shall mean the use or operation of any mechanical exhaust
device designed to aid in the braking, decompression or deceleration
of any motor vehicle which results in the excessive, loud, unusual
or explosive noise from such vehicle.
EMERGENCY SITUATION
Shall mean the use one in which there is imminent danger
of a collision with property, persons and/or animals and/or what is
necessary for the health, safety and welfare of the community.
EXCESSIVELY LOUD
Shall mean audible at a distance of 100 feet from the building,
structure or vehicle in which it is located shall be prima facie evidence
of a violation of this section.

It is unlawful for the driver of any motor vehicle to activate
or use an internal combustion engine powered vehicle on any posted
public ways, including, but not limited to, streets, alleys, easements
or right-of-ways established for vehicle operation with the Township
of Lafayette, while said vehicle or operator is utilizing an engine
brake without an exhaust muffler sufficient to prevent the creation
of excessively loud noises, by said vehicle, due to improperly maintained,
defective or modified muffler systems, except when the use of such
engine brake is necessary in an emergency situation. The section is
not intended to prohibit the passage of vehicle equipped with engine
brakes in posted areas, but rather limit the use of such equipment
in posted areas under the aforesaid circumstances.

The provisions of this section shall not be applicable in emergency
situations as described herein:
a. Noise caused by the application of engine brakes, also known as "compression
braking", which is effectively muffled or if the application is necessary
for the health, safety and welfare of the community is exempt from
the provisions of this section.
b. Sounds created by emergency equipment for emergency purposes are,
also, exempt.

The Township is hereby authorized to post, at reasonable locations
with the Township, signs indicating the prohibition of engine braking
in a non-emergency situation.

a. Any person, firm or corporation violating any provision of this article
shall be mandated to a court appearance, fined not less than $150
or more than $500 and required to pay court costs and fees for each
offense.

b. A separate offense shall be deemed committed on each day during or
on which a violation occurs or continues.

As used in this section:
OVERNIGHT PARKING
The parking of a motor vehicle in any Municipal Lot from
7:00 p.m. to 6:00 a.m. of the following date (a “period”),
without having a current, in-force permit issued by the Township.

This section prohibits parking in all Municipal Lots located
within the Township and generally identified on Schedule A below.

The exception to overnight parking in the Municipal Lots shall
be granted to those owners of duly licensed passenger cars and light
trucks that exhibit a valid permit issued by the Township.

No permits for overnight parking shall be issued to commercial
vehicles, unless a passenger car or light truck utilized by the owner
both for business and pleasure use.

Enforcement of this section shall be by the Township Zoning
Officer or such other municipal official as the Township may, from
time to time, designate.

In the event a vehicle that does not display a valid permit
permitting overnight parking in a Municipal Lot, the violator shall
be subject to the following:
a. For the
first offense, a minimum fine of $50.
b. If a violation
occurs for three consecutive periods, the Township has the authority
to have the offending vehicle towed at the owner’s expense.
c. In addition
to fines provided for in paragraph a above, the Municipal Court may
impose an additional fine for each day the violation is not cured,
commencing on the Court date. The fine shall be in the amount of $100
per day for each violation.
