a. 
It shall be mandatory for all persons, except those physically disabled who are owners, lessees and occupants of residential property, to separate glass bottles and jars, newspapers, leaves and aluminum cans as hereinafter defined from all other solid waste produced by such residence for collection and ultimate recycling of these materials.
b. 
In accordance with existing State regulations (N.J.A.C. 14A:3-11), all service stations, oil retainers and motor vehicle reinspection stations with "used oil holding tanks" shall accept up to five gallons at a time of used motor oil from individuals changing oil from cars, lawn mowers or motorcycles, and shall post a sign informing the public that they are a "Used oil collection site."
c. 
It shall be mandatory for all owners, lessees or occupants of business schools and industrial property and of private, public and governmental institutions and buildings to separate glass bottles and jars, newspapers, leaves, aluminum cans, corrugated cardboard and/or high grade paper from all other solid waste produced by the nonresidential establishments and arrange for collection and the ultimate recycling of said material. It shall be mandatory for all haulers of recyclables from nonresidential establishments to provide a record to the municipality of the types and quantities of materials recycled. Weight receipts and/or letters on official company stationery should clearly describe the quantity and disposition of each material.
d. 
It shall be mandatory for all owners, lessees or occupants of both residential and nonresidential properties to separate tin and bimetal cans in addition to the items previously required to be recycled under this section.
e. 
All apartments and other multi-family complexes, schools, businesses and institutions shall provide separate and clearly marked containers for use of residents, students, employees, customers or other visitors, for trash and the various categories of recyclables.
f. 
Construction, demolition or land clearing debris, which includes asphalt, concrete, brick, block, tree parts, metal appliances or other bulk metal items larger than one cubic foot and/or five pounds and solid waste, shall not be disposed of at any Monmouth County landfill. As of January 1, 2011, computers, computer monitors and related electronics hardware, as well as analog or digital televisions, are prohibited from being placed with other solid waste for disposal.
g. 
It shall be mandatory for all owners, lessees or occupants of both residential and nonresidential properties to separate, from their solid waste, pourable plastic containers (#1 and #2), in addition to the items required to be recycled under previous sections herein.
h. 
The Township shall issue construction and demolition permits only after the applicant has identified disposal and recycling arrangements. The applicant shall provide appropriate records documenting the quantity and disposition of all materials.

As used in this section:
ALUMINUM
Shall mean and include only disposable items made of aluminum including aluminum containers used for soda, beer or other beverages. Excluded are foil wrappers, containers for prepared food, screen frames and lawn chairs.
CORRUGATED CARDBOARD
Shall mean and include cardboard of the type used to make cardboard boxes, cartons, pasteboard and similar corrugated and kraft paper material.
GLASS
Shall mean and include all products made from silica or sand, soda ash and limestone; the product being transparent or translucent and being used for packing or bottling of various matters excluding, however, blue or flat glass commonly known as window glass.
HIGH GRADE PAPER
Shall mean and include white and/or off-white stationery, photocopy and computer paper.
NEWSPAPER
Shall mean and include paper of the type commonly referred to as newsprint and distributed at stated intervals, usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Expressly excluded, however, are all magazines or other periodicals as well as all other products of any nature whatsoever.
PLASTIC CONTAINERS
Shall mean and include all disposable containers made from plastic used for liquid such as soda, water, milk, juice, bleach as well as soap/detergent-powdered and liquid, or like products, Not acceptable are containers such as yogurt, ice cream, deli products, motor oil, antifreeze, paint thinners, insecticides, or products marked hazardous or toxic.
SOLID WASTE
Shall mean and include all garbage and rubbish normally produced by the occupants of commercial, industrial and residential property and disposed of by private or public pick-up.

a. 
The position of Recycling Coordinator is hereby created and established within the Township.
b. 
The Recycling Coordinator shall be appointed by the Township Committee for a term of one year expiring December 31 of each year.
c. 
The Recycling Coordinator, subject to the approval of the Township Committee, shall establish and promulgate reasonable rules and regulations as to the manner, days and times for the collection, sorting, transportation, sale and/or marketing of recyclable material in order to encourage the preservation of material resources while minimizing the cost of the recycling program to the Township.

The Township Committee may use municipal personnel to collect residential recyclable materials set forth herein at curbside and/or from a drop-off center and shall sell recyclable material if a market exists therefor pursuant to N.J.S. 40A:11-1 et seq.
The Township Committee may elect to enter into agreements with qualified persons or corporations authorizing them to collect residential recyclable material at curbside or from a drop-off center and to sell recyclable material.
Any private hauler collecting recyclables from nonresidential establishments shall register with the recycling coordinator, the name, address and phone number of their company and the name and address of the establishment from which they are collecting recyclables.
Any nonresidential establishment shall register with the Recycling Coordinator the name and address of the private hauler with which they have contracted for collection of recyclables.
No owners, lessees or occupants of any nonresidential establishment or premises shall set out or deposit any recyclable materials at curbside for collection as part of the municipal recycling pickup, nor deposit or have any recyclable materials at a municipal drop-off center.
Any company or agency providing dumpsters, roll-off or other containers to multifamily residential complexes with shared disposal/recycling areas, businesses, institutions, schools or construction/demolition job sites, shall be responsible for clearly marking such containers for "trash" or for specific "recyclables," as may be appropriate.

It shall be a violation of this section for any person unauthorized by the Township Committee to pick up, or cause to be picked up, recyclable materials as defined herein. Each collection in violation hereof shall constitute a separate and distinct offense punishable as hereinafter provided.

a. 
Those materials required to be recycled in the Township pursuant to this section shall be placed for collection in such manner and at such times as provided for in the rules and regulations promulgated by the Recycling Coordinator.
b. 
Solid waste haulers shall be prohibited from collecting household garbage which contains materials required by this section to be separated for the purpose of recycling.
c. 
In the event that a fine is imposed upon a Township as a result of a private contractor bringing unseparated mandatory recyclable materials to the Monmouth County Reclamation Center, then in that event, the Township shall have a right to require reimbursement by the private contractor in the amount of any penalty imposed upon the Township.

Anything herein to the contrary notwithstanding, any person, partnership or corporation who is owner, lessee or occupant of a residential or nonresidential property, may donate or sell recyclable materials as defined herein, to any person, partnership or corporation whether or not operating for a profit. The person, partnership or corporation, however, shall not pick up recyclable materials at curbside or at a drop off center.

Any person, firm or corporation who violates or neglects to comply with any provision of this section or any rule or regulation promulgated pursuant thereof, shall be liable, upon conviction, to the penalty stated in Chapter 1, Section 1-5. As an alternate penalty, a convicted person may be ordered to perform community service in the recycling program, for a period not to exceed 90 days.
Each day such violation or neglect is committed or permitted to continue, shall constitute a separate offense and be punishable as such.
Fines levied for noncompliance with the provisions of the Municipal Recycling Ordinance may be placed in a designated municipal fund for reinvestment in the local recycling program(s).
This section may be enforced by any official or office of the Township. The Recycling Coordinator, the Monmouth County Health Department and Municipal Code Enforcement Officer are hereby individually and severally empowered to inspect solid waste and recycling arrangements and compliance at local residences, businesses, schools and institutions, and to enforce the provisions of this section, by issuance of summonses and complaints. A typical inspection may consist of sorting through containers and opening bagged solid wastes to detect the presence of any recyclable materials.

The purpose of this section is to require dumpsters and other refuse containers that are outdoors or exposed to stormwater to be covered at all times and prohibit the spilling, dumping, leaking, or otherwise discharge of liquids, semi-liquids or solids from the containers to the municipal separate storm sewer system(s) operated by Holmdel Township and/or the waters of the State so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.

For the purpose of this section, the following terms, phrases, words, and their derivations shall have the meanings stated herein unless their use in the text of this section clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4)
Shall mean a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) that is owned or operated by Holmdel Township or other public body, and is designed and used for collecting and conveying stormwater.
PERSON
Shall mean any individual, corporation, company, partnership, firm, association, or political subdivision of this State subject to municipal jurisdiction.
REFUSE CONTAINER
Shall mean any waste container that a person controls whether owned, leased, or operated, including dumpsters, trash cans, garbage pails, and plastic trash bags.
STORMWATER
Shall mean water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.
WATERS OF THE STATE
Shall mean the ocean and its estuaries, all springs, streams and bodies of surface or ground water, whether natural or artificial, within the boundaries of the State of New Jersey or subject to its jurisdiction.

Any person who controls, whether owned, leased or operated, a refuse container or dumpster must ensure that such container or dumpster is covered at all times and shall prevent refuse from spilling out or overflowing.
Any person who owns, leases or otherwise uses a refuse container or dumpster must ensure that such container or dumpster does not leak or otherwise discharge liquids, semi-liquids or solids to the municipal separate storm sewer system(s) operated by Holmdel Township.
No dumpsters are allowed on a public street, except in the instance where the driveway immediately adjacent to the street is under construction or is being replaced. In such an instance a permit may be granted by the Code Enforcement Officer for a maximum of five days at a cost of $25.
Any roll-off dumpster or roll-off container parked on or along any street, highway or public property in the Township shall be equipped with and display markers consisting of all yellow reflective diamond-shaped parcels having a minimum size of 18 inches by 18 inches in order to warn passersby of the presence of a traffic hazard requiring the exercise of unusual care. These panels shall be mounted at the edge of the dumpster at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic. The markers shall have a minimum mounting height of three feet from the bottom of the panels to the surface of the roadway.

The following are exempt from the prohibitions set forth in this section:
a. 
Permitted temporary demolition containers.
b. 
Litter receptacles (other than dumpsters or other bulk containers).
c. 
Individual homeowner trash and recycling containers.
d. 
Refuse containers at facilities authorized to discharge stormwater under a valid NJPDES permit.
e. 
Large bulky items (e.g., furniture, bound carpet and padding, white goods placed curbside for pickup).

This section shall be enforced by the Holmdel Township Code Enforcement Officer.

Any person found guilty or pleading guilty to a violation of this section shall be subject to the penalty provisions of Section 1-5, General Penalty.

The purposes of the regulations set forth herein are to preserve the peace and quiet in neighborhoods during the hours when most residents are asleep pursuant to the authority granted by N.J.S.A. 40:66-1.6.

No person, company or other entity shall do or cause to be done any activity related to the collection of solid waste in any areas of the Township zoned for residential use or within 500 feet of an existing residential use at any times set forth below:
1. 
Monday through Friday — 9:00 p.m. to 7:00 a.m.
2. 
Saturday, Sunday and any Federal holiday — 9:00 p.m. to 8:30 a.m.
b. 
In further explanation of the hours of solid waste collection restrictions set forth in paragraph a above, the permissible solid waste collection hours are only as follows:
1. 
Monday through Friday — 7:00 a.m. to 9:00 p.m.
2. 
Saturday, Sunday and any Federal holiday — 8:30 a.m. to 9:00 p.m.
