The short title of this Part shall be "Old Lycoming Township
Recycling Ordinance," and the same may be cited in that manner.

Empty all-aluminum beverages and food containers.
A person or entity desirous of being authorized as a collector
of sourceseparated recycled materials.
Empty food or beverage containers consisting of steel and
aluminum.
A large container for a specific recyclable item to be stored
in until collected.
Those properties used primarily for commercial or industrial
purposes and those multiple dwelling residential buildings containing
more than four dwelling units.
Church, school, civic, service group, municipal functions
and all other such functions.
Structural paper material with an inner core shaped in rigid
parallel furrows and ridges.
Empty steel or tin-coated steel food or beverage containers.
Bottles and jars made of clear, green or brown glass.
All white paper, bond paper and computer paper used in commercial,
institutional and municipal establishments and in residences.
Those facilities that house or serve groups of people such
as hospitals, schools, day care centers, and nursing homes.
Include, but shall not be limited to, automotive, truck and
industrial batteries that contain lead.
Leaves from trees.
A person authorized to collect source separated recyclable
materials in Old Lycoming Township.
Printed matter containing miscellaneous written pieces published
at fixed or varying intervals. Expressly excluded are all other paper
products of any nature whatsoever.
Four or more dwelling units per structure.
Public facilities operated by Old Lycoming Township and other
governmental authorities.
A source separation and collection program for recycling
municipal waste or source-separated recyclable materials or a program
for designated drop-off points or collection centers for recycling
municipal waste or source-separated recyclable materials, which are
operated by or on behalf of a municipality. The term includes any
source separation and collection program for composting yard waste
that is operated by or on behalf of a municipality. The term shall
not include any program for recycling construction/demolition waste
or sludge from sewage treatment plants or water supply treatment plants.
Old Lycoming Township, Lycoming County, Pennsylvania.
Paper of the type commonly referred to as newsprint and distributed
at fixed intervals, having printed thereon news and opinions, containing
advertisements and other matters of public interest.
Owners, lessees and occupants of residences, commercial or
institutional establishments.
Empty plastic food and beverage containers. Due to the large
variety of types of plastic, the recycling regulations may stipulate
specific types of plastic which may be regulated. Currently #1 and
#2 plastics are recyclable.
The collection, separation, recovery and sale of reuse of
metals, glass, paper, leaf waste, plastics and other materials which
would otherwise be disposed or processed as municipal waste or the
mechanized separation and treatment of municipal waste (other than
through combustion) and creation and recovery of reusable materials
other than a fuel for the operation of energy.
Any occupied single or multi-family dwelling having up to
and including three dwelling units per structure.
Those materials separated at the point of origin for the
purpose of being recycled including those materials listed in Act
101 and by the Township to be recycled.
A material whose original purpose has been completed and
which is directed to a disposal or processing facility or is otherwise
disposed. The term does not include source-separated recyclable materials.

1.
Establishment of a Municipal Recycling Program for Residential Dwellings.
There is hereby established a municipal recycling program for the
mandatory separation of recyclable materials from solid waste by persons
residing in residential dwellings having between one and three dwelling
units per structure.
2.
Separation of Recyclables and Placement for Disposal. Recyclable
materials from residential dwellings shall be placed at the curb or
a designated place separate from solid waste for collection or taken
to drop off sites at such times, dates and places and manner as may
be established by the Township. Materials to be recycled are: aluminum
cans, bi-metal containers, brown, green and clear glass, magazines
and newspaper, plastic and other materials that may be designated
by law as recyclable.
3.
Separation of Recyclables by Commercial, Municipal and Institutional
Establishments and at Community Activities.
A.
Commercial, municipal and institutional establishments shall separate
and store, until collection, high-grade office paper, corrugated paper,
aluminum beverage containers, leaf waste and other materials deemed
appropriate according to law. These establishments must arrange for
the collection of recyclables by a licensed recycler at least once
a month. The licensed recycling collector shall annually provide to
Old Lycoming Township evidence of such arrangement and documentation
of the total number of tons recycled by providing invoices of all
materials collected from the establishments that were marketed.
B.
At all community activities, recyclable materials designated by the
Township must be separated for collection. Sponsoring organizations
must arrange for the transfer of the materials to a recycling market.
4.
Separation of Recyclables by Multi-family Housing, Housing Properties
and Placement for Disposal. The governing body of a municipality shall
allow an owner, landlord or agent of an owner or landlord of multi-family
rental housing properties with four or more units to comply with its
responsibilities under this subsection by establishing a collection
system for recyclable materials at each property. The collection system
must include suitable containers for collecting and sorting materials,
easily accessible locations for the containers and written instructions
to the occupants concerning the use and availability of the collection
system. Owners, landlords and agents of owners or landlords who comply
with this Part shall not be liable for the noncompliance of occupants
of their buildings. These landlords or owners must arrange for the
collection of recyclables by a licensed recycler at least once a month.
The licensed recycling collector shall annually provide to Old Lycoming
Township evidence of such arrangement and documentation of the total
number of tons recycled by providing invoices of materials collected
from the establishments that were marketed.

No person may place a used lead acid battery in mixed municipal
solid waste, discard or otherwise dispose of a lead acid battery except
by delivery to an automotive battery retailer or wholesaler, to a
secondary lead smelter permitted by the Environmental Protection Agency,
or to a collection of recycling facility authorized under the laws
of the Commonwealth.

Yard Waste/Leaves. All persons who reside in residential dwellings
and all persons who are responsible for administration of multi-family
housing properties, commercial, municipal and institutional establishments
who gather yard waste/leaves shall source separate all leaves from
other waste and place them for collection at the times and in the
manner prescribed by the Township. Yard waste/leaves are not to be
incorporated into the regular waste stream. Nothing herein shall require
any person to gather yard waste/leaves or prevent any person from
utilizing yard waste/leaves for compost, mulch, or other agricultural,
horticultural, silvicultural, gardening or landscape purposes. The
Township shall collect leaves, curbside, in the fall and other yard
waste in the spring.

Christmas Trees. Once a year the Township will provide curbside collection
of Christmas trees.
4.
Mulch/Recycling Area. The Township has provided an area located at
1250 Princeton Avenue, also known as the Township Farm, to be designated
as a drop-off site for owners, lessees and occupants of residences,
commercial or institutional establishments, located within the Township,
to dispose of yard waste. Such yard waste consists of recycling items
as follows: trees and trimmings, brush and shrubs, and garden plantings.
These items are cumstomarily recycled into mulch for use by Township
residents. Hours of operation will be designated on the mulch/recycling
area sign. All items other than yard waste listed above are prohibited,
including construction debris and ashes.
5.
Landscaper/Tree Surgeon Registration. The Township will allow landscape
businesses and tree trimming businesses to drop off yard waste, when
such business is located within Old Lycoming Township or doing business
in Old Lycoming Township. However, such businesses must register with
the Township annually and pay the appropriate registration fees. The
Township may set and/or change registration fees by way of resolution.

Ownership of any recyclable materials is retained by the owners,
lessees and occupants of residences, commercial or institutional establishments
until the materials are placed at curbside or a similar location for
collection.
2.
Thereafter, once the materials are placed at curbside, they become
the property of the Township or its contract collector.
3.
It shall be a violation of this Part for any persons unauthorized
by the Township to collect or pick up or cause to be picked up any
such recyclable material. Each such collection in violation hereof
shall constitute a separate and distinct offense punishable as hereinafter
provided.
4.
Nothing herein shall prohibit an individual from taking his/her source
separated recyclable materials directly to a designated drop off site
or to market in accordance with this Part.

1.
All recyclable materials must be delivered by an authorized collector
to recycling markets.
2.
It shall be a violation of this Part for the collection of recyclable
materials to deliver such materials to a landfill or incinerator for
the purpose of disposal. All authorized collectors shall provide to
the Township the weight receipts of the recyclable materials, collected
and marketed.

1.
Old Lycoming Township may enter into agreement(s) or contracts with
public or private agencies or firms to authorize them to collect all
or part of the recyclable material from curbside or from drop-off
collection points. The Township shall authorize, by issuance of a
business license, such hauler(s) to collect and market source-separated
recyclable materials from multi-family dwellings, commercial and institutional
establishments within the Township. All applications for licensing
shall be reviewed by the Township and shall be approved in accordance
with the following criteria:
A.
Licenses may be issued to only those persons or entities that can
provide satisfactory evidence that they are capable of providing the
necessary services and can comply with the provision and intent of
this Part and the rules and regulations established by Old Lycoming
Township.
B.
At the time of application submission, the applicant shall indicate
that he has the appropriate type of closed or covered truck with which
to collect source separated recyclable materials and shall provide
evidence that he carries sufficient liability insurance on the vehicle.
C.
Licenses shall be issued on a fiscal year basis, but may be revoked
at any time by the Township for just cause in accordance with the
rules and regulations of the Department of Environmental Resources.
D.
Fees for such licenses shall be paid by the applicant to Old Lycoming
Township. Said fees shall be on the basis of cost and covered in the
rules and regulations of Old Lycoming Township.

1.
Any action by any person, firm, corporation, or other entity which
violates this Part or any regulations thereof shall be punishable
by a fine not to exceed $60, or undergo imprisonment for no more than
90 days or both. Each day of continued violation shall constitute
a separate offense.
2.
The Township may remove the improperly deposited items. The cost
of such removal shall be a lien against the property. Said lien shall
include attorney fees, interest and the like.
