Be it enacted and it is hereby ordained by the Mayor and Council of the Borough of Mt. Jewett, in the County of McKean and State of Pennsylvania, that no person shall hereafter construct a driveway leading to or parallel with any street in the said Borough without obtaining a permit therefor, as hereinafter provided.
Any person who shall desire to construct a driveway leading to or parallel with any street in said Borough shall make application to the Mayor, in writing, for the purpose. The said application shall set forth the exact location of the driveway, the length thereof, the type and size of the drainage pipe in the same, the surface covering and the grade thereof.
All driveways hereafter constructed shall be at a grade established by the Street Commissioner and shall provide for the drainage, and the drainage pipe shall be of suitable material subject to approval, at least 12 inches in diameter.

Any person who violates or permits a violation of this chapter shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of McKean County.
