As provided by law, there is hereby established in the Township of Frankford a Board of Health which shall be composed of seven members, in addition to which there shall be two alternate members.

The members of the Board of Health shall be appointed by the Township Committee and shall be resident of the Township.

The regular members of the Board of Health shall hold office for a term of three years.
b. 
Alternate members of the Board of Health shall hold office for a term of two years.

If a vacancy shall occur on the Local Board of Health of the Township of Frankford it shall be filled in the same manner as original appointments.

There is hereby created an Economic Development Committee which will be known as the "Economic Development Committee of the Township of Frankford." This Committee shall be advisory to the Township Committee and shall consist of not less than five or more than 10 members.

a. 
The term of office of Committee members shall be for three years; and terms shall be arranged so that approximately one-third of the total membership shall expire each year.
b. 
Committee members shall be appointed by the Township Committee. Members may be comprised of, but not limited to, Frankford residents and Frankford business owners.
c. 
The Economic Development Committee shall meet on a schedule devised by its members, but not less than four times each year.
d. 
A quorum shall consist of a majority of the whole number of members.

The Committee shall organize annually by the election of one of its members as Chairman. The Committee shall also elect a Vice Chairman. The Committee shall also appoint a Secretary, which Secretary need not be a member of the Committee.

The Economic Development Committee shall have and perform the following duties:
a. 
The development of plans and programs to encourage the expansion and strengthening of existing business and commercial enterprises in Frankford Township consistent with the best interests of the Township as a whole.
b. 
The development of plans and programs which will attract new business and commercial enterprises to the Township of Frankford which are in the best interests of the Township as a whole.
c. 
The investigation, analysis and submission of regular reports to the Township Committee on any obstacles to the expansion of the industrial and commercial tax base of Frankford Township.
d. 
The making of recommendations to the Township Committee regarding any ways or means by which the Township can assist in meeting the needs of any development deemed appropriate.
e. 
The Economic Development Committee may designate one of its members to be a liaison with the Sussex County Economic Development Advisory Committee and the Office of Economic Development.
f. 
The Economic Development Committee may participate in appropriate County and regional economic development activities.
g. 
The Committee shall develop ways and means of promoting and attracting Frankford Township's economic development assets for industry, resort/tourism, transportation, governmental and other potential economic interests.
h. 
The Committee shall not exercise any power of condemnation and shall not be authorized to pledge the credit of the Township of Frankford or to create any debt against the Township or in any manner act as the agent of the Township, except as specifically authorized by resolution of the Township Committee.
i. 
The Committee is authorized to expend such monies as may be appropriated for its use in the annual Township Budget to carry out the purposes of the Committee as hereinabove set forth.
j. 
The Committee shall make an annual report to the Mayor and Township Committee setting forth in detail its operations and transactions for the preceding 12 months. The Committee shall keep complete and accurate records of its accounts, shall not exceed its budget, and monies received from the Township of Frankford shall be expended only for the purposes for which they have been appropriated.

Each member and officer of the Committee shall, before assuming office, take and subscribe an oath that he/she will faithfully and impartially discharge the duties of his/her office.

To effectuate its purposes, the Committee shall have the power to adopt suitable bylaws for the management of its affairs and to determine the qualifications and duties of its employees and to fix, subject to the budget for the Committee as adopted by the Township Committee, the compensation to be paid to any of its employees.

There is hereby established an Open Space Committee which shall consist of seven members, but may consist of up to nine members, and shall not exceed nine members at any time, whose terms and powers are hereinafter set forth.

All members of the Open Space Committee shall be residents of the Township, and shall consist of the following:
a. 
The Mayor or a Committee Member acting as the Mayor's designee.
b. 
Five residents of the Township appointed by the Township Committee.
c. 
Two members of the Frankford Township Land Use Board.
d. 
One member of the Park Commission.
The Township Engineer and Township Attorney shall advise the Committee, as necessary, in a professional, non-voting capacity.

a. 
The members of the Township Committee, Park Commission and Land Use Board appointed to the Open Space Committee shall have a term of one year.
b. 
The terms of the citizen members shall be for three years, and not more than (2) citizens' terms shall expire in any one year.

a. 
The Open Space Committee shall initially prepare a report recommending which parcels of land should be acquired in fee and/or those parcels of land from which the Township should acquire development rights only, as well as which farmland should be acquired for farmland preservation purposes and whether such farmland should be acquired in fee or only by acquisition of development rights. The report required by this section shall be referred to as the Township's Open Space Plan.
b. 
The Open Space Committee shall submit to the Township Committee a prioritized list of properties which it recommends that the Township acquire and/or from which it recommends that development rights should be acquired, as well as which farmland should be acquired for farmland preservation purposes and whether such farmland should be acquired in fee or only by acquisition of development rights. The Township Committee shall review the list as submitted and make a determination as to which properties are to be acquired and shall state the amount of funds that the Committee shall make available for such acquisition.
c. 
After selection of the properties to be acquired referred to in paragraphs a and b above, the Township may proceed to acquire by gift, purchase or by eminent domain proceedings, pursuant to N.J.S.A. 20:3-1 et seq., the identified parcels within the financial constraints established by the Township Committee.

The Open Space Committee shall hold public meetings, which public meetings shall be held in accordance with the Open Public Meetings Act, and the Committee shall give appropriate notification of the meetings.

The Open Space Committee shall select from among its members a Chairperson and Vice Chairperson to serve as the Presiding Officer in the absence of the Chairperson. The Committee shall also select a Secretary whose function shall be to maintain minutes of the Committee's meeting and records of the proceedings of the Committee.

The Open Space Committee shall have its annual reorganization meeting each calendar year.

a. 
There is hereby established a reserve in the general capital fund which shall be known and designated as the "reserve for open space acquisition." A separate bank account shall be opened and maintained for this purpose. Funds from the reserve for open space acquisition may, as directed by the Township Committee, be utilized to acquire vacant land, as well as land which has improvement upon it at the time of the acquisition where the principal purpose of the acquisition is to preserve open space and may also be used for maintenance and improvements on properties that are acquired. In the event that the Township Committee shall find it appropriate to apportion the cost of acquisition between open space and improvements, it may do so and charge the reserve for open space acquisition for the approximate value that it deems appropriate relative to open space and the Township's capital account for the value that it determines shall be attributed to improvements.
b. 
The reserve for open space acquisition may also, as directed by the Township Committee, be used for the retention of consultants to assist the Open Space Committee in (a) identifying lands for acquisition in accordance with the Township's Open Space Plan, (b) updating the Township's Open Space Plan, (c) applying for any grants, including but not limited to, planning incentive grants, and (d) for administrative costs associated with any activities permitted under this section.
c. 
The reserve for open space acquisition may be funded through the dedication to the fund of an amount between $0.0 to $0.03 per $100 of assessed valuation of each annual tax levy commencing on tax years determined by the Committee. The reserve shall also be permitted to accept donations and testamentary bequests. The funds accumulated within the reserve may be utilized for the acquisition or development rights of land or as a down payment for the issuance of bonds for the same purpose at the discretion of the Township Committee, provided that the annual levy collected will not exceed $0.03 per $100 of assessed valuation of each annual tax levy. Any and all interest accruing shall remain in the reserve and may be utilized for the above-described purposes.

No property acquired with these funds from the reserve for open space acquisition shall be leased or sold or otherwise diverted until such action has been authorized by the Township Committee in the manner prescribed by law.

In the event that no property is acquired under this section for a period of five consecutive years, then the Township Committee shall review the activities of the Open Space Committee and issue a report with recommendations and conclusions concerning the reserve for open space acquisition and the continued existence of the Open Space Committee.

The Mayor shall appoint a Municipal Emergency Management Coordinator from among the residents of the municipality. The Municipal Emergency Management Coordinator shall serve for a term of three years. Provided, however, that, as a condition of his appointment and his right to continue for the full term of his appointment, the Municipal Emergency Management Coordinator shall have successfully completed at the time of his appointment or within one year immediately following his appointment, whichever is later, the State-approved Home Study Course and the Basic Emergency Management Workshop. The duties of the Municipal Emergency Management Coordinator shall be those duties enumerated in N.J.S.A. App. A:9-40.4 et seq. In addition, the Municipal Emergency Management Coordinator shall appoint a Deputy Emergency Management Coordinator with the approval of the Mayor.

An Emergency Management Council shall be maintained for the Township. The Emergency Management Council shall be composed of not more than 15 members who are residents of the Township and who shall be appointed by the Mayor and shall hold office at the will and pleasure of the Mayor. The Municipal Emergency Management Coordinator shall be a member and shall serve as Chairman of the Emergency Management Council. The duties, responsibilities and powers of the Emergency Management Council shall be those stated in N.J.S.A. App. A:9-41 et seq.
