This chapter shall be known as the "Residential Tenant Report Ordinance of North Franklin Township."
Each and every owner (or owners) of any and all single-family or duplex dwellings, apartment buildings, mobile home parks, or of any and all other rental or leased properties situated within the Township of North Franklin is required, on or before February 1 of each year, to submit to the Township, on forms provided by the Township, the number of parcels or units, including location, then being leased or available for lease, and the name or names and mailing addresses of all renters or lessees over the age of 18 occupying said rental units or parcels.
Within 30 days from the beginning term of a lease-letting and/or rental agreement for property within the Township, the owner/landlord/lessor must file the occupancy information report with the Township. Notice will be given if the Township needs further information regarding the submitted report.
After the initial report of occupancy pursuant to § 324-3 hereof is made, the property owner need only submit a report for the year involved in the event that there has been a change in occupancy of the rental unit or parcel; that is, if new occupants have not moved in or if prior occupants have not vacated the rental unit or parcel, the property owner need not submit an annual report.
The Township shall have blank forms readily available at the Township building during regular Township hours. The initial report form shall be attached hereto and be effective until a subsequent form is adopted by way of resolution of the Township Supervisors.
Any person/property owner (which shall include any individual, partnership, association or corporation) convicted before a Magisterial District Judge for violation of any of the provisions or requirements of this chapter shall be liable to a fine or penalty not exceeding $300 for each and every offense and the costs of prosecution thereof. For the purposes of this section, the failure to submit the required report for each apartment building, mobile home park, or other rental or lease property shall be a separate offense.
The provisions of this chapter are severable. If any sentence, clause, or section of this chapter is for any reason found to be unconstitutional, illegal, or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, or sections of this chapter. It is hereby declared to be the intent of the Board of Supervisors of North Franklin Township that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, or section not been included herein.
All ordinances or parts of ordinances inconsistent with this chapter are hereby repealed insofar as they may be inconsistent herewith.
This chapter shall become effective five days after enactment.
