Parking meters shall be installed on such streets or portions thereof or any other designated location in the Borough of Honesdale as may be now or hereafter designated by the Borough Council of the Borough of Honesdale by resolution at a public meeting.
The proper officers or appointed agents of the Borough are hereby authorized and directed to enter into a contract for the purchase and installation of parking meters as from time to time may be necessary for the number of individual parking spaces to be provided and may enter into a contract or contracts for such parts and maintenance as may be necessary from time to time to keep said parking meters in good operating condition.
A. 
Each parking meter shall be placed immediately adjacent to an individual parking space and in such position relative to the individual parking space and other parking meters as to leave no reasonable doubt as to the individual parking space for which such meter indicates parking time.
B. 
Each parking meter installed shall indicate by a proper legend the legal parking time established by the Borough for such individual parking space and, when operated, shall indicate on and by its dial the duration of the legal parking and, on the expiration of such period, shall indicate illegal or overtime parking.
C. 
Parking meter zones are established upon and along certain streets and any other designated location in the Borough. All meters appearing in the Borough at the time of the statement of this article are hereby "grandfathered." Removal, deletion, addition or reorganization of any and all meters shall be authorized by resolution.
A. 
The following lawful meter parking times are Monday through Saturday from 9:00 a.m. to 5:00 p.m. Sundays, legal holidays and any and all other occurrences approved and as observed by the Borough of Honesdale are free parking days.
B. 
Two-hour parking time limits.
(1) 
No person shall continuously park a vehicle for longer than two continuous hours during lawful meter parking times upon any of the following described streets or parts thereof:
(a) 
Main Street from Fourth Street to Twelfth Street, including all numbered streets in between Main Street and Church Street from Fourth Street to Eleventh Street and West Eleventh Street, but not between Church Street and Court Street.
(b) 
Church Street from Fourth Street to Twelfth Street.
(2) 
If any such vehicles shall remain parked in any individual parking space for longer than two continuous hours, such vehicle shall be considered in violation of this subsection, unless said vehicle is parked in a lawful parking place in accordance with the special permit as specifically set forth in § 195-22 of this chapter.
C. 
Ten-hour parking time limits.
(1) 
No person shall continuously park a vehicle for longer than 10 continuous hours during lawful meter parking times upon any of the following described streets or parts thereof:
(a) 
Court Street from Sixth Street to and including Eleventh Street, including all numbered streets in between Church Street and Court Street where such meters are installed.
(b) 
Ninth Street, Tenth Street, and Eleventh Street from Court Street to the river bank where such meters are installed.
(2) 
This section does not apply to vehicles lawfully parked in accordance with the special permit as specifically set forth in § 195-22 of this chapter.
It shall be unlawful to park any vehicle in the parking meter zone other than entirely within the lines or markings of an individual parking area.

A. 
When any vehicle shall be parked in an individual parking space during the time of limited parking, the owner or operator of such vehicle shall, upon entering such individual parking space, immediately deposit, or cause to be deposited, required payment of coin or otherwise, including credit card payment, as specified by and or upon the subject meter, unless otherwise designated. Said payment shall be made in the parking meter adjacent to the individual parking space occupied by such vehicle. Failure to deposit such payment as required herein or failure to operate such meter in accordance with the instructions thereon shall constitute a violation of this chapter. Upon the deposit of such payment, such individual parking space may be occupied lawfully by such vehicle as indicated thereon, or as provided by the Honesdale Borough Fee Resolution Schedule then in effect,[1] unless otherwise designated on said meter. However, no payment as provided for herein shall entitle any vehicle to occupy an individual parking space for longer than the lawful parking period as prescribed on the subject meter and/or by related ordinances of Honesdale Borough. If any such vehicle shall remain parked in an individual parking space for such length of time that the meter shall indicate by proper signal that the lawful parking period has expired, such vehicle shall be considered as parking over time and in violation of this chapter, unless said vehicle is parked in the lawful parking space in accordance with any and all special permits as specifically set forth in this chapter or any other provision adopted by Honesdale Borough.

Contractors or other persons as from time to time approved by the Borough Council of the Borough of Honesdale shall be allowed to apply for a special permit to occupy a parking space for an entire day or days by making proper application at the Borough Secretary's office at the Borough Hall, Main Street, in the Borough of Honesdale. Said special permit shall be issued at the rates as set forth from time to time by resolution of the Borough Council, unless otherwise designated on said permit, and shall be displayed as directed by the issuing agent at the time of receipt. Said permits shall be in lieu of coins in said parking meters as set forth in § 195-19 of this article.
A. 
It shall be the duty of each police officer, or parking enforcement officer, of the Borough to refer to the Borough, by special parking permit tickets, numbered consecutively, the following information for violation of parking permits issued for the use of parking lots provided by the Borough and the following information for each violation reported:
(1) 
The location of the parking meter which indicates that the vehicle was parked in the parking space in violation of any of the provisions of this chapter.
(2) 
The date and hour of such violation.
(3) 
The state license number of such vehicle.
(4) 
Any other facts, knowledge of which is necessary or desirable to a thorough understanding of the circumstances attending such violation.
(5) 
A Borough police officer or the Borough's Parking Enforcement Officer shall be authorized to ticket vehicles parked at meters in violation of this chapter one time for every 60 minutes they remain parked without paying the required fee by depositing the same in the appropriate meter.
(6) 
Exceptions. Council may temporarily suspend the provisions of this article requiring coin deposit in meters establishing a maximum parking time at meters. In that event, the provisions of this article shall not apply during any period covered by said action.
(7) 
A Borough police officer or the Borough's Parking Enforcement Officer shall be authorized to ticket vehicles parked at meters in violation of § 195-21 one time for every 60 minutes they remain continuously parked in violation of § 195-21.
B. 
Each police officer or parking enforcement officer shall also place on every vehicle a notice to the owner or operator thereof that the vehicle has been parked in violation of the provisions of this section and instructing such owner or operator to report at Borough Hall, in the Borough of Honesdale, within the time designated on the notice as attached to such vehicle and to pay to the Borough a fee as set forth in the Borough's Fee Schedule. There will be no second notice mailed out.
If the violator reports to the Honesdale Borough Hall, 958 Main Street, within 24 hours for meter tickets or 168 hours for other violations from the time when the ticket is issued, or deposits the appropriate fine in one of the Borough's lock boxes within said time limit, no further action shall be taken and no further penalties shall be imposed. In the event payment is not made as provided herein within 24 hours of the ticket's issuance, and $15 is paid before the eighth day, no further action will be taken. In the event payment is not made as provided herein within seven days of the ticket's issuance, on the eighth day the fines increase to $50. Thereafter, the Borough may proceed to enforce the penalty for the violation by causing a citation to be issued through the office of the District Magistrate, in which case the fine as provided herein shall apply as well as the additional cost of prosecution as imposed for a summary offense by the office of the District Magistrate.
Any person, firm or corporation violating any of the provisions of this article or aiding, abetting or assisting in the violation of any such provisions shall, upon conviction, be sentenced to pay a fine of $50.
