Parking meters shall be installed on such streets or portions
thereof or any other designated location in the Borough of Honesdale
as may be now or hereafter designated by the Borough Council of the
Borough of Honesdale by resolution at a public meeting.
The proper officers or appointed agents of the Borough are hereby
authorized and directed to enter into a contract for the purchase
and installation of parking meters as from time to time may be necessary
for the number of individual parking spaces to be provided and may
enter into a contract or contracts for such parts and maintenance
as may be necessary from time to time to keep said parking meters
in good operating condition.
It shall be unlawful to park any vehicle in the parking meter
zone other than entirely within the lines or markings of an individual
parking area.

A. When any vehicle shall be parked in an individual parking space during
the time of limited parking, the owner or operator of such vehicle
shall, upon entering such individual parking space, immediately deposit,
or cause to be deposited, required payment of coin or otherwise, including
credit card payment, as specified by and or upon the subject meter,
unless otherwise designated. Said payment shall be made in the parking
meter adjacent to the individual parking space occupied by such vehicle.
Failure to deposit such payment as required herein or failure to operate
such meter in accordance with the instructions thereon shall constitute
a violation of this chapter. Upon the deposit of such payment, such
individual parking space may be occupied lawfully by such vehicle
as indicated thereon, or as provided by the Honesdale Borough Fee
Resolution Schedule then in effect, unless otherwise designated on said meter. However, no
payment as provided for herein shall entitle any vehicle to occupy
an individual parking space for longer than the lawful parking period
as prescribed on the subject meter and/or by related ordinances of
Honesdale Borough. If any such vehicle shall remain parked in an individual
parking space for such length of time that the meter shall indicate
by proper signal that the lawful parking period has expired, such
vehicle shall be considered as parking over time and in violation
of this chapter, unless said vehicle is parked in the lawful parking
space in accordance with any and all special permits as specifically
set forth in this chapter or any other provision adopted by Honesdale
Borough.
Contractors or other persons as from time to time approved by the Borough Council of the Borough of Honesdale shall be allowed to apply for a special permit to occupy a parking space for an entire day or days by making proper application at the Borough Secretary's office at the Borough Hall, Main Street, in the Borough of Honesdale. Said special permit shall be issued at the rates as set forth from time to time by resolution of the Borough Council, unless otherwise designated on said permit, and shall be displayed as directed by the issuing agent at the time of receipt. Said permits shall be in lieu of coins in said parking meters as set forth in §
195-19 of this article.
If the violator reports to the Honesdale Borough Hall, 958 Main
Street, within 24 hours for meter tickets or 168 hours for other violations
from the time when the ticket is issued, or deposits the appropriate
fine in one of the Borough's lock boxes within said time limit, no
further action shall be taken and no further penalties shall be imposed.
In the event payment is not made as provided herein within 24 hours
of the ticket's issuance, and $15 is paid before the eighth day, no
further action will be taken. In the event payment is not made as
provided herein within seven days of the ticket's issuance, on the
eighth day the fines increase to $50. Thereafter, the Borough may
proceed to enforce the penalty for the violation by causing a citation
to be issued through the office of the District Magistrate, in which
case the fine as provided herein shall apply as well as the additional
cost of prosecution as imposed for a summary offense by the office
of the District Magistrate.
Any person, firm or corporation violating any of the provisions
of this article or aiding, abetting or assisting in the violation
of any such provisions shall, upon conviction, be sentenced to pay
a fine of $50.
