The Borough of Marietta establishes a Quick Ticket Program to aid in the enforcement of certain violations identified in § 50-2. The issuance of a Quick Ticket is in addition to any other remedy or fine that the Borough may be entitled to under its ordinances or other applicable law. The Borough may issue a Quick Ticket under this chapter whether or not the Borough has undertaken any other enforcement activity.
Violations of the following Marietta Borough sections or provisions shall be enforceable by Quick Ticket:

A. 
Quick Tickets may be issued by the Borough's code enforcement officials, police officers, and any other agent hired or appointed by the Borough designated to do so.
B. 
Upon finding a violation, a Quick Ticket may be issued to any combination of: 1) the owner of the property at issue; 2) the occupant of the property at issue; and 3) to the individual or business known to have committed the violation.
C. 
Quick Tickets for multiple violations can be issued to the same person at the same time. For violations where a Quick Ticket is issued, the violation is corrected, and a similar violation then occurs, a new Quick Ticket may be issued for the similar violations. For violations that are not corrected, additional Quick Tickets may be issued for that violation but not more than one Quick Ticket every 30 days.
D. 
Quick Tickets shall generally be served by mail. The Borough may, however, serve a Quick Ticket by handing it to an adult member of the household or other person in charge of the residence at the residence of the person to be served, by leaving or affixing the violation ticket to the property where the violation exists, or by handing it at any office or usual place of business of the violator, to his/her agent, or to the person for the time being in charge.
A. 
Within 15 days of receiving a Quick Ticket, the recipient may:
(1) 
Admit the violation, waive the right to appeal, and pay the $25 fine in full satisfaction of the Quick Ticket; or
(2) 
File an appeal by returning to the Borough Office the form provided by the Borough along with an appeal fee of $50.
B. 
Any recipient who fails to file an appeal within 15 days shall waive the right to an appeal.
C. 
All appeals will be held before the Public Works Committee of the Borough or such other body appointed by a resolution of the Borough. The panel on appeal may uphold the Quick Ticket, vacate the Quick Ticket, and modify any associated cost. A substantially prevailing appellant will be provided a refund of their appeal fee.
D. 
Quick Tickets not paid within 15 days of receipt (or in the case of appeals, within 15 days after the appeal is decided) will be subject to an additional $50 penalty. Failure of the person to make payment within 30 days shall make the person subject to a summary citation before the local Magisterial District Judge's office which shall include the Quick Ticket fine, the additional penalty, and all attorney's fees and other costs of collection.
The payment of a Quick Ticket does not eliminate the need to remedy the underlying violation. Nothing in this chapter will limit the ability of the Borough to issue notices of violation or to abate conditions for which a Quick Ticket is issued.
