[1982 Code § 3-6.1]
As used in this section:
PARK
Shall mean a park, reservation, playground, beach, recreation
center or any other area in the Borough, owned or used by the Borough,
and devoted to active or passive recreation or devoted or used as
a memorial.
VEHICLE
Shall mean any wheeled conveyance, whether motor-powered,
animal-drawn or self-propelled. The term shall include any trailer
in tow of any size, kind or description. Exception shall be made for
baby carriages and vehicles in the service of the Borough parks.

No person in a park shall:
a. Willfully mark, deface, disfigure, injure, tamper with, or displace
or remove, any building, bridges, tables, benches, fireplaces, railings,
paving or paving material, water lines or other public utilities or
parts or appurtenances thereof, signs, notices or placards, whether
temporary or permanent, monuments, stakes, posts, or other boundary
markers, or other structures or equipment, facilities or park property
or appurtenances whatsoever, either real or personal.
b. Dig, or remove any beach sand, whether submerged or not, or any soil,
rock, stones, trees, shrubs or plants, downed timber or other wood
or materials, or make any excavation by tool equipment, blasting,
or other means or agency.
c. Construct or erect any building or structure of whatever kind, whether
permanent or temporary in character, or run or string any public service
utility into, upon, or across such lands, except on special written
permit issued hereunder.
d. Damage, cut, carve, transplant or remove any tree or plant or injure
the bark, or pick the flowers or seeds, of any tree or plant. Nor
shall any person attach any rope, wire or other contrivance to any
tree or plant. A person shall not dig in or otherwise disturb grass
areas, or in any other way injure or impair the natural beauty or
usefulness of any area.
e. Climb any tree or walk, stand or sit upon monuments, vases, fountains,
railing, fences or gun carriages or upon any other property not designated
or customarily used for such purposes.
f. Tie or hitch a horse to any tree or plant.

No person in a park shall have brought in or shall dump, deposit
or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt,
rubbish, waste, garbage, or refuse, or other trash. No such refuse
shall be placed in any waters in or contiguous to any park, or left
anywhere on the grounds thereof, but shall be placed in the proper
receptacles where these are provided; where receptacles are not so
provided, all such rubbish or waste shall be carried away from the
park by the person responsible for its presence, and properly disposed
of elsewhere.

No person shall take part in or abet the playing of any games
involving thrown or otherwise propelled objects such as balls, stones,
arrows, javelins or model airplanes. The playing of rough or comparatively
dangerous games such as football, baseball and quoits shall be prohibited.

No person shall ride a horse except on designated bridle trails.
Where permitted, horses shall be thoroughly broken and properly restrained,
and ridden with due care, and shall not be allowed to graze or go
unattended, nor shall they be hitched to any rock, tree or shrub.

No person in a park shall use any park areas for picnicking;
camping on any park areas shall be prohibited.

No person in a park shall:
a. Consume or sell alcoholic beverages at any time in the park except
as provided herein.
b. Have entered or be under the influence of intoxicating liquor.
At certain specifically designated recreation centers where
meals or lunches are served under concession privileges, the sale
of alcoholic beverages by such concessionaire shall be permitted under
the strict regulation and control of the Borough Council. Sales of
alcoholic beverages shall be made only in individual drinks, not in
original packages or otherwise in bulk, and shall be served for consumption
on the immediate premises of the concession. Such sales shall be duly
licensed pursuant to law.

No person shall bring, or have in his possession, or set off
or otherwise cause to explode or discharge or burn, any firecrackers,
torpedo, rocket or other fireworks or explosives of inflammable material,
or discharge them or throw them into any such areas from land or highway
adjacent thereto. This prohibition shall include any substance, compound,
mixture, or article that in conjunction with another substance or
compound would be dangerous from any of the foregoing standpoints.

No person shall build or attempt to build a fire, except on
such areas and under such regulations as may be designated by the
Borough Council. No person shall drop, throw, or otherwise scatter
lighted matches, burning cigarettes or cigars, tobacco paper or other
inflammable material within any park area or on any highway, road
or street abutting or contiguous thereto.

No person shall be responsible for the entry of a dog or other
domestic animal into areas other than automobile parking concourses
and walks immediately adjacent thereto, and in such other areas as
may be clearly marked by signs bearing the words "Domestic Animals
Permitted in this Area." Nothing herein shall be construed as permitting
the running of dogs at large. All dogs in those areas where such animals
are permitted shall be restrained at all times on adequate leashes
not greater than 10 feet in length.

No person shall gamble or participate in or abet any game of
chance.

No person shall sleep or protractedly lounge on the seats or
benches, or other areas, or engage in loud, boisterous, threatening,
abusive, insulting or indecent language, or engage in any disorderly
conduct or behavior tending to be a breach of the public peace.

No person in a park shall:
a. Expose or offer for sale any article or thing, nor shall be station
or place any stand, cart, or vehicle for the transportation, sale
or display of any such article or thing. Exception is hereby made
as to any regularly licensed concessionaire acting by and under the
authority and regulation of the Borough Council.
b. Announce, advertise, or call the public attention in any way to any
article or service for sale or hire.
c. Paste, glue, tack or otherwise post any sign, placard, advertisement,
or inscription whatever, nor shall any person erect or cause to be
erected any sign whatever on any public lands or highways or roads
adjacent to a park.

Except for unusual and unforeseen emergencies, parks shall be
open to the public every day of the year during designated hours.
The opening and closing hours for each individual park shall be posted
therein for public information. These hours shall be 7:00 a.m. to
sundown.

All forms of food and beverages are prohibited in all public
parks located in the Borough of Jamesburg.

a. Required. A permit shall be obtained from the Borough Council before
participating in those activities by a group, association or organization
such as, but not limited to, parties, theatrical or entertainment
performances, athletic events, gatherings or rallies.
b. Application Information. A person seeking insurance of a permit hereunder
shall file with the Borough Council an application containing the
following information:
1. The name and address of the applicant.
2. The name and address of the person, persons, corporation or association
sponsoring the activity, if any.
3. The day and hour for which the permit is desired.
4. The park or portion thereof for which such permit is desired.
5. An estimate of the anticipated attendance.
6. Any other information which the Council shall find reasonably necessary
to a fair determination as to whether a permit should issue hereunder.
c. Fee. There shall be an application fee as set forth in the Borough
Schedule of Fees Ordinance.
d. Standards for Issuance. The Council shall issue a permit hereunder
when the following is determined:
1. That the proposed activity or use of the park shall not unreasonably
interfere with or detract from the general public enjoyment of the
park.
2. That the proposed activity and use shall not unreasonably interfere
with or detract from the promotion of public health, welfare, safety
and recreation.
3. That the proposed activity or use shall not be reasonably anticipated
to incite violence, crime or disorderly conduct.
4. That the proposed activity shall not entail unusual, extraordinary
or burdensome expense or police operation by the Borough.
5. That the facilities desired have not been reserved for use at the
date and hour required in the application.
e. Effect of Permit. A permittee shall be bound by all park rules and
regulations and all applicable ordinances fully as though the same
were inserted in such permits.
f. Liability of Permittee. The person or persons to whom a permit issued
shall be liable for any loss, damage or injury sustained by any person
whatever by reason of the negligence of the person or persons to whom
such permit shall have been issued.
g. Exhibit of Permit. No person shall fail to produce and exhibit any
permit from the Council he claims to have upon request of any authorized
person who shall desire to inspect the same for the purpose of enforcing
compliance with any ordinance or rule.
h. Interference with Permittees. No person shall disturb or interfere
unreasonably with any person or party occupying any area, or participating
in any activity, under the authority of a permit.
i. Revocation. The Borough Council shall have the authority to revoke
a permit upon a finding of violation of any rule or ordinance, or
upon good cause shown.

The Police Department shall, in connection with their duties
imposed by law, diligently enforce the provisions of this section,
and shall have the authority to:
a. Eject from the park any person acting in violation of this section.
b. Seize or confiscate any property, thing or device in the park or
used in violation of this section.

ANIMALS
Shall mean and include cats, dogs, horses, any fowl or birds
- any living creatures within jurisdiction of the park.
AUTHORIZED EMERGENCY VEHICLES
Shall mean vehicles of the Fire Department, Police vehicles
and such; ambulances and other vehicles approved by the Chairman when
operated in response to an emergency.
BICYCLE PATH
Shall mean any path maintained for self-propelled vehicles;
no motorized bikes.
BRIDLE PATH
Shall mean any path maintained for equestrians; no motorized
vehicles.
CHAIRMAN
Shall mean the Chairman of Middlesex County Department of
Parks and Recreation.
COMMERCIAL VEHICLES
Shall mean and include every type of motordriven vehicle
used for commercial purposes on the highways; or any omnibus or vehicle
adapted for more than nine passengers, or engaged in the carrying
of any merchandise, or upon which is displayed for advertising purpose
any writing, symbol, flag, banner, target, sign, placard, etc.
CROSSING
Shall mean any crossing, whether marked by a pavement or
otherwise; the extension of any sidewalk space across any intersecting
drive, street, highway or bridle path.
CURB
Shall mean any boundary of any street, road, avenue, boulevard,
drive or bridle path, whether or not marked by a curbstone.
DRIVE
Shall mean any road, avenue, drive or boulevard maintained
by the Department of Public Parks for vehicular use, including the
parts thereof under or over any bridge.
DRIVER-OPERATOR
Shall mean any person, who propels, operates or is in charge
of a vehicle.
MOTOR VEHICLE
Shall mean and include all vehicles propelled other than
by muscular power, and shall also include all motor operated vehicles
of the bicycle or tricycle type.
OFF ROAD VEHICLES
Shall mean any powered vehicles designed for or capable of
cross-country travel on or immediately over land, water, sand, snow,
ice, marsh, swampland, or other terrain which would include, but not
be limited to, such vehicles as four wheel drive, motorcycle, snowmobile,
amphibious or air cushion vehicles; except those vehicles utilized
for fire, emergency or law enforcement purposes and any vehicle whose
use is expressly authorized by the Parks Department.
OFFICIAL TRAFFIC CONTROL DEVICES
Shall mean all signs, signal marking and device placed or
erected by authority of the Chairman or other official having jurisdiction
for the purpose of regulating, warning or guiding traffic.
PARK RANGERS OR OFFICERS
Shall mean any person employed by the Middlesex County Parks
Department as a Park Ranger or Special Officer or any municipal or
State Police Officer.
PARKING PLACE
Shall mean any part of any drive or space designated as a
place for the standing of vehicles.
PATH
Shall mean any footpath, walk or any path maintained for
pedestrians.
PERMIT
Shall mean any written license issued by or under the authority
of the Parks Department, permitting the performance of a specified
act or acts.
PERSON
Shall mean any person, corporation, company, association,
joint stock association, firm or co-partnership.
RIGHT-OF-WAY
Shall mean the privilege of the immediate use of the roadway,
drive, path.
RUBBISH
Shall mean any refuse matter that includes ashes, dross,
cinders, shell, paper, dirt, sand, oil, grease, clay, loam, stone
or building materials, brush, stumps, hay, straw, oats, sawdust, shavings,
or manufacturing, trade or household waste, old iron or other metals
or objects made therefrom, or sick, diseased, or dead animals, organic
refuse or any other offensive matter, including swill, brine, offal,
fecal matter, or garbage.
SAFETY ZONE
Shall mean any space (within a drive) established for pedestrians.
TRAFFIC
Shall mean pedestrians, ridden or herded animals; vehicles,
either singly or together, while in the confines of the Parks jurisdiction.
VEHICLE
Shall mean any conveyance (except by baby carriage) including
motor vehicles, bicycles, tricycles, sleds, sleighs, pushcarts or
vehicles propelled by other than muscular power - also any horse (trailers)

All Middlesex County Parks Department Resolutions shall be effective
within all the parks, recreation areas and open space reservations
of the Middlesex County Park System and regulate the use thereof by
all persons.
Any person found guilty by a Municipal Court Judge of violating
any of the provisions of these rules and regulations shall be subject
to a fine, as set forth on the attached Schedule, imprisonment for a period not to exceed 90 days, or both,
as shall be determined by said Municipal Court Judge, pursuant to
N.J.S.A. 40:24-3.
