Except as provided in this chapter, sidewalks shall always be kept open and free of obstructions to public travel.
It shall be unlawful for any person to place a pile of stone, lumber, brick, mortar beds, boxes, barrels, merchandise, household goods, furniture or any other items on a sidewalk within a radius of 48 inches from any fire hydrant or plug within the Borough of Millvale.
It shall be unlawful for any person to discharge or cause to be discharged any stormwater, roof runoff, sump pump discharge or other waters onto any sidewalk where such discharge is determined to be a hazard by the Borough of Millvale appointed designee. Upon such determination by the Borough designee, written notice shall be served upon the person to take such steps as are necessary to abate the hazard.
No person shall place, exhibit or display upon any sidewalk in the Borough of Millvale any goods, wares or merchandise, or any fixture, table, machine or other device for the display or sale of goods, wares or merchandise. The following are exempt from this section:
A. 
Goods, wares or merchandise may be placed, exhibited or displayed on the inside line of the sidewalk if they do not extend more than 24 inches into the sidewalk and the sidewalk is sufficiently wide so that a free and unencumbered walkway at least five feet in width remains available for the use of pedestrians;
B. 
Goods, wares or merchandise may be temporarily placed on the sidewalk for such limited time as may be necessary pending the loading or unloading, removing or storing away of the same; or
C. 
Goods, wares or merchandise may be placed, exhibited or displayed on a sidewalk if authorized by the Borough through a special events permit granted under Chapter 259 of the Borough Code.
A. 
Planters are permitted only on sidewalks within Commercial and Mixed-Use Districts and the Riverfront Overlay.
B. 
Planters placed on sidewalks shall comply with the following dimensions:
(1) 
The minimum height of a planter shall be 12 inches; however, a lesser minimum height is permitted where the plants growing in the container exceed a height of 12 inches above the sidewalk;
(2) 
The maximum height of a planter shall be 21 inches;
(3) 
Plants growing within the planter may not exceed a height of 72 inches above the sidewalk;
(4) 
The maximum sidewalk area that may be covered by a planter is 72 square inches;
(5) 
No planter may protrude more than 24 inches into the sidewalk from the building wall which the container abuts; and
(6) 
No plants growing within the planter may protrude more than 24 inches into the sidewalk from the building wall which the container abuts.
C. 
Planters may be placed on the sidewalk only by persons owning or operating a business abutting the sidewalk and may be placed only directly in front of the business premises.
D. 
No planter shall be located within 36 inches from either side of any doorway which opens onto the sidewalk.
E. 
No planter may be placed within 24 inches of the dividing line between separate businesses, or within 24 inches of a sidewalk corner.
F. 
No planter may be placed so as to obstruct the view of the street number assigned to that business premises.
G. 
Planters shall be placed so as to allow an unobstructed sidewalk area at least 60 inches wide.
H. 
No business may place more than two planters upon the sidewalk at the same time. If the business is located at a corner or otherwise abuts more than one sidewalk, two planters may be placed in front of each wall on each such sidewalk.
I. 
No signs, advertisements, messages, logos or other forms of advertising are permitted on planters.
J. 
All planters shall be kept clean and maintained in good repair while on the sidewalk.
K. 
No planter may be placed upon the sidewalk unless the business owner has provided to the Borough a certificate of insurance coverage in a minimum amount of $100,000 for any liability arising from or in connection with the planter.
L. 
During the growing season, business owners shall cultivate planters with ornamental plants, and any dead or dying plants shall be removed and replaced with healthy plants.
A. 
Chairs, tables and seating may be placed on the sidewalk with a minimum unobstructed path of 48 inches as measured from the curb.
B. 
Chairs, tables and seating that are portable must be secured inside the building premises when the business is not open to the public.
