A. 
No person shall engage in the activities of a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman without having first obtained a license to do so as provided by this Chapter; provided, however:
1. 
A person may obtain a sixty-day temporary permit to perform such services pending issuance of the license provided by this Chapter; or
2. 
A person who has been trained by and is licensed or registered by another public law enforcement agency and has applied for a license hereunder may engage in the activity of a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman for a period not to exceed thirty (30) days following filing of the application pending issuance of the license pursuant to this Chapter. No applicant will receive more than one (1) temporary license extension.

A. 
Section 600.050 of Ordinance No. 21-0432 is enacted pursuant to Chapter 43, Section 43.535, RSMo., to regulate the issuance of licenses for corporate security advisors, couriers, Loss Prevention Agents, Patrol Security Officers, Security Officers and Watchmen licensee(s) within Jefferson County, Missouri.
B. 
Section 600.050 of Ordinance No. 21-0432 is enacted pursuant to the Federal Register and in compliance with the Code of Federal Regulations (CFR).
C. 
An applicant seeking to engage as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchmen shall submit his/her fingerprints to the Missouri State Highway Patrol, Criminal Justice Information Services (CJIS) Division, along with appropriate fees. The Missouri State Highway Patrol, CJIS Division will compare the subject's fingerprints against its criminal file and submit the fingerprints to the Federal Bureau of Investigation (FBI) for a comparison with national criminal history records. The results of the FBI check will be returned to the Missouri State Highway Patrol, CJIS Division, which will disseminate the state and national results to the Jefferson County Sheriff's Office, Jefferson County, Missouri.
D. 
The Jefferson County Sheriff's Office, Jefferson County, Missouri, shall render a fitness determination based upon the results of the criminal background check. In rendering a fitness determination, the Jefferson County Sheriff's Office, Jefferson County, Missouri, will decide whether the subject of record has been convicted of or is under pending indictment for:
1. 
A crime which bears upon his/her ability or fitness to serve in that capacity;
2. 
Any felony or a misdemeanor which involved force or threat of force, controlled substances, or was a sex-related offense; or
3. 
Enumerated disqualifiers.
E. 
The subject of record may request and receive a copy of his/her criminal history record information from the Jefferson County Sheriff's Office, Jefferson County, Missouri. Should the subject of record seek to amend or correct his/her record, he/she must contact the Missouri State Highway Patrol, CJIS Division, for a Missouri State record and the Federal Bureau of Investigation for records from other state jurisdictions maintained in its file.
F. 
Any person desiring to act as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman in the County shall make written application to the Jefferson County Sheriff's Office Sheriff for licensing as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman upon a form or forms prescribed by the Sheriff of Jefferson County. Such application shall describe the premises or the locality upon or within which the applicant is to serve as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman and shall be accompanied by a written statement of a responsible business enterprise, citizen or group of citizens indicating its or their intention to employ the applicant as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman. The applicant's fingerprints will be taken by the Jefferson County Sheriff's Office at the time of submission of the application or another law enforcement agency by which the applicant is licensed or registered as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman.

Before being licensed under these rules, individual and company applicants shall file with the application a certificate of liability insurance in the amount of one million dollars ($1,000,000.00), naming Jefferson County and the Jefferson County Sheriffs Department as an additional insured and certificate holder and protecting the board from liability judgments, suits, and claims, including, but not limited to, suits for bodily injury, personal injury, including false arrest, libel, slander, invasion of privacy, and property damage arising out of the licensing of individuals and entities providing private security services or proprietary private investigative services. The insurance must be written by a company approved by the Missouri Superintendent of Insurance and approved by the board with respect to its form, manner of execution and sufficiency; provided, further, however, before a license is issued to a nonresident of Missouri, the applicant must file with the Missouri Secretary of State a written consent for jurisdiction of the courts of Missouri, and any case(s) arising from any contract for performance of private security services or proprietary private investigative services made within city are to be performed wholly or in part, in the city or in any way connected with the business within the city or occurring in connection with the business of the one (1) licensed within the city. Any company licensed must provide the insurance specified and cover all employees; provided, however, that in the event a suit is filed, or claim is made involving Jefferson County and/or the Jefferson County Sheriff's Department, the company shall immediately notify the board at which time the licensee may be required to furnish additional insurance. Failure of a licensee to maintain insurance is grounds for revocation. In the absence of adequate insurance, all licenses granted to employees or agents of that company are automatically suspended. Each certificate of insurance must stipulate coverage for armed/unarmed personnel as appropriate.

All applications for a license as a corporate security advisor, courier, loss prevention agent, patrol security officer, security officer or watchman shall be referred to the Sheriff of Jefferson County, who shall investigate the moral character and fitness of the applicant or applicants, their experience in such business, the character of the services they expect to perform and the manner in which such business is to be carried on, and who shall obtain such other information concerning the applicant as he may deem necessary in order to determine the applicant's fitness and qualifications for the conduct of such activity.
