The City of Monessen's Fire and Rescue Services shall initiate user fees for the delivery of fire and rescue services, personnel, supplies and equipment to the scene of motor vehicle accidents and other incidents on the highways. The rate of user fees shall be that which is usual, customary and reasonable (UCR), which may include any services, personnel, supplies and equipment and with baselines established by addendum to this article.
A. 
The user fee shall be filed with the motor vehicle insurance carrier, representing an added-on cost of the claim for damages to the vehicles, property and/or injuries. In the event services are required relating to utilities causing safety problems to highway areas, and if the area is deemed unsafe by emergency responders, the same billing process shall apply to said utility whose equipment-related problems cause an emergency services response. The claim's costs shall be filed with the insurance carrier of the owner of a vehicle, property or other responsible party.
B. 
Such fees shall be billed on a per-unit basis for each applicable fire and rescue service provided.
C. 
Such fees shall be regulated by Exhibit A, Fire and Rescue Services Billing Fee Schedule,[1] and may be changed by a majority vote of the Monessen City Council, from time to time, as deemed necessary. Such fee adjustment shall come at the request, in writing, of any or all of the following: the Monessen Bureau of Fire, the Monessen Fire Department Company 81-1, or the Monessen Fire Department Company 81-2.

The Municipal Fire Chief, with approval from the Mayor and City Council, may make rules or regulations and from time to time may amend, revoke or add rules and regulations, not consistent with this article, as they may deem necessary or expedient in respect to billing for these fees or the collection thereof.
All amounts collected as a result of this article shall be placed into a fund as established by the Monessen Bureau of Fire, to be used exclusively for personnel, supplies and equipment of Fire and Rescue Services. Such fund shall be equally distributed between Monessen Fire Company 81-1 (also known as "Downtown") and Monessen Fire Company 81-2 (also known as "Hilltop").
In the event any provision, section, sentence, clause or part of this article shall be held to be invalid, such invalidity shall be severable and shall not affect or impair any of the remaining provisions, sections, sentences, clauses, or parts of this article, it being the intent of the City of Monessen that the remainder of the article shall be and shall remain in full force and effect.
All ordinances or resolutions or parts of ordinances or resolutions insofar as they are inconsistent herewith are hereby repealed and rescinded.
This article shall become effective after 10 days upon the date of approval.
