It is the legislative intent and policy of the City of Monessen to regulate parking within the City of Monessen for the safety and benefit of the public and the residents and businesses of the City of Monessen. This article is intended to consolidate parking regulations, limitations, restrictions, and prohibitions for the downtown area of the City of Monessen into a single article.
A. 
The City Council may designate, as herein provided, certain spaces and areas within the City of Monessen as no parking.
B. 
The City Council hereby designates the following on-street spaces and areas as no-parking spaces or areas, as provided below:

C. 
For purposes of this article, "business parking" shall mean parking use by the patron, customer, guest, visitor, invitee, member, owner, employee, or contractor of a nearby business or organization located within the City of Monessen.
D. 
For purposes of this article, "limited residential parking" shall mean parking by a resident in a parking space within 25 yards of such resident's residence and for whom off-street parking associated with such residence is unavailable due to no action of the resident or the owner of such residence.

(4) 
City parking lot located on the northern side of Donner Avenue between Eighth Street and Tenth Street (adjacent to the Monessen Civic Center), designated by parking space.
C. 
Leases or permits for such spaces and areas shall include such terms and conditions and be as determined by the City Council by ordinance or resolution.

City parking lot located at the southeastern corner of Donner Avenue and Fourth Street.
(3) 
City parking lot located at the southeastern corner of Schoonmaker Avenue and Fourth Street (subject to leased/permitted parking under § 365-26.8 herein), designated by parking space.
(4) 
City parking garage located on the northern side of Schoonmaker Avenue between Fifth Street and Fourth Street (subject to leased/permitted parking under § 365-26.8 herein), designated by parking space.
(5) 
City parking lot located at the northwestern corner of Schoonmaker Avenue and Fifth Street.
(6) 
City parking lot located on the eastern side of Sixth Street between Schoonmaker Avenue and Donner Avenue.
(7) 
City parking lot located on the northern side of Donner Avenue between Eighth Street and Tenth Street (adjacent to the Monessen Civic Center) (subject to leased/permitted parking under § 365-26.8 herein), designated by parking space.
A. 
Prohibitions. Except when necessary to avoid conflict with other traffic, or to protect the safety of any person or vehicle, or in compliance with law, or the directions of a police officer or official traffic control device, no person shall:
(1) 
Stop, stand or park a vehicle:
(a) 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street.
(b) 
On a sidewalk or between a sidewalk and the curb.
(c) 
Within an intersection.
(d) 
On a crosswalk.
(e) 
Between a safety zone and the adjacent curb within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by official traffic control devices, or within 75 feet of the intersection of curblines on those intersections in which safety zones are marked out.
(f) 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
(g) 
Upon any bridge or other elevated structure upon a highway or within a highway tunnel.
(h) 
On any railroad tracks.
(i) 
In the area between roadways of a divided highway, including crossovers.
(j) 
At any place where official signs prohibit stopping.
(k) 
Within a 25 feet from the intersection of curblines or, if none, within 15 feet of the intersection of property lines at an intersection, except at alleys.
(l) 
Within 50 feet of the entrance to any public, private or parochial school between the hours of 7:30 a.m. and 4:30 p.m. during the months in which such schools are in session.
(m) 
In any alley.
(2) 
Stand or park a vehicle:
(a) 
In front of a public or private driveway.
(b) 
Within 15 feet of a fire hydrant.
(c) 
Within 20 feet of a crosswalk at an intersection.
(d) 
Within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic control signal located at the side of a roadway.
(e) 
Within 20 feet of the driveway entrance to any fire station or, when properly sign posted, on the side of a street opposite the entrance to any fire station within 75 feet of the entrance.
(f) 
Where the vehicle would prevent the free movement of a bus.
(g) 
On a limited access highway unless authorized by official traffic control devices.
(h) 
At any place where official signs prohibit standing.
(3) 
Park a vehicle:
(a) 
Within 50 feet of the nearest rail of a railroad crossing.
(b) 
At any place where official signs prohibit parking.
B. 
Unattended vehicle on private property. No person shall park or leave unattended a vehicle on private property without the consent of the owner or other person in control or possession of the property, except in the case of emergency or disablement of the vehicle, in which case the operator shall arrange for the removal of the vehicle as soon as possible.
C. 
Parking parallel or near curb.
(1) 
Except when necessary in compliance with law or official traffic control devices, or where angle parking is permitted, the operator of a vehicle shall not stop, stand or park such vehicle on any street other than parallel with the edge of the street.
(2) 
No person shall park any vehicle more than 12 inches from any curb, nor with the left side of such vehicle next to the curb, except on one-way streets where parking is indicated as being permitted.
D. 
Setting brakes and stopping motor. No person having control or charge of a motor vehicle shall allow such vehicle to stand on any street unattended, without first effectively setting the brakes thereon and stopping the motor of such vehicle.
E. 
Parking for certain purposes prohibited. No person shall park a vehicle upon any street or highway for the principal purpose of:
(1) 
Displaying such vehicle for sale.
(2) 
Commercial washing, greasing, painting or repairing such vehicle, except repairs necessitated by an emergency.
(3) 
Displaying advertising thereon.
(4) 
Offering goods, wares and merchandise therefrom for sale.
(5) 
Storage, which shall consist of allowing such vehicle to remain in one place continuously for over 72 hours.
F. 
Passenger or material loading zones.
(1) 
No person shall stop, stand or park any vehicle for a period of time longer than is necessary for the expeditious loading or unloading of passengers in any place marked as a passenger zone.
(2) 
No person shall stop, stand or park any vehicle for a period of time longer than is necessary for the expeditious loading or unloading of passengers, or for the unloading and delivery or pickup and loading of materials, in any place marked as a loading zone. In no case shall the stop for loading or unloading of materials exceed 30 minutes.
G. 
Use of bus stops. No operator of any vehicle other than a bus shall stand or park in an officially designated bus stop, except that the operator of any passenger vehicle may stop temporarily in any such stop or stand for the purpose of and while actually engaged in the loading and unloading of passengers.
The City Council appoints and authorizes the City Police. Department and the City Code Parking Officer to enforce the provisions of this article. The City, by and through its authorized representatives, shall have the authority to issue tickets in lieu of any summons/citation, which tickets shall be an offer to settle and resolve any such violation without the necessity of the issuance of a summons/citation.
Appeals from any ticket or violation of this article shall conform to the process and requirements of the City's appeals process, as may be adopted and implemented by the City Council by ordinance or resolution, which are hereby incorporated by reference. Any board of appeals shall be comprised of appointees of the City Council. Appeal fees shall be as set by ordinance or resolution of the City Council, and any appeal fees shall be returned or refunded to the appellant if the appeal of the appellant is granted.
Whoever violates any provision of this article shall be guilty of a summary violation, the penalties for which are as follows:
A. 
A fine of $30 for nonmeter violations, if the fine is paid within 10 days from the date of issuance noted on the parking ticket. If a fine set forth in this section is not paid within 10 days, each fine set forth in this section shall be increased by $10 (i.e., a fine of $40) if a fine is paid on the 11th through 30th day. If the fine is not paid within 30 days, each fine shall be increased by $20 (i.e., a fine of $50) for payments made on the 31st day or thereafter.
B. 
Any vehicle parked in violation of any of the provisions of this article may be towed and impounded in accordance with applicable law. However, no vehicle shall be towed under the provisions of this section unless the police officer ordering the vehicle towed and impounded does so in strict compliance with the rules, regulations, and procedures promulgated by the Chief of Police.
C. 
A violation of the Handicapped Parking Spaces Ordinance shall be a fine of $55. If a fine set forth in this section is not paid within 10 days, each fine set forth in this section shall be increased by $10 (i.e., a fine of $65) if a fine is paid on the 11th through 30th day. If a fine is not paid within 30 days, each fine shall be increased by $20 (i.e., a fine of $75) for payments made on the 31st day or thereafter.
D. 
Notwithstanding the provisions found in Subsection A herein, the fine shall be $200 where a citation/summons is issued by the City of Monessen or its Police or Parking Enforcement Officer(s).
The City Council and its agents, officials, and representatives shall not under any circumstances be liable or responsible for damages caused to any person or property by reason of the parking of any vehicle in compliance or noncompliance with the terms and provisions hereof. The person or persons responsible for any such parked vehicle shall bear sole liability for any damages or theft caused as a result thereof.
Any ordinance or part of any ordinance that conflicts with the provisions of this article is hereby repealed to the extent of any such conflict on the effective date of this article.
If any provisions, sentence, clause, section, or part of this article or application thereof to any person or circumstance is for any reason found to be unconstitutional, illegal or invalid by a court of competent jurisdiction, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections, or parts of this article. It is hereby declared as the intent of the City Council of the City of Monessen that this article would have been adopted had such unconstitutional, illegal or invalid provision, sentence, clause, section, or part not been included herein.
This article shall become effective 10 days after enactment.
