There is hereby created a recreation board pursuant to the Borough Code, known as the "New Freedom Borough Recreation Commission."
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH
New Freedom Borough, York County, Pennsylvania.
BOROUGH COUNCIL
The Council of New Freedom Borough.
MEMBER
Appointed member of the New Freedom Borough Recreation Commission.
RECREATION COMMISSION
The New Freedom Borough Recreation Commission.
RECREATION FACILITIES
The public parks, playfields, and all outdoor and indoor recreation areas and facilities owned or controlled by the Borough, whether within or without the limits of the Borough.
A. 
The Recreation Commission shall be composed of five members, or up to seven members, of the Borough to be appointed by the Borough Council, with the power to provide and conduct programs, at or on public recreation areas, facilities, and centers, subject to limitations set forth herein and all of the responsibilities of the Borough Code and New Freedom Borough ordinances.
B. 
The members shall serve for terms of five years, or until their successors are appointed, except that the members of such Commission, first appointed, shall be appointed for such terms that the term of at least one member shall expire annually thereafter.
C. 
Vacancies shall be filled in the same manner as original appointments and for the unexpired term.
D. 
Members shall serve without pay.
A. 
The Recreation Commission shall appoint from its membership a Chairman and such other officers as it may deem necessary for the orderly conduct of its business, and it may adopt bylaws, rules and regulations covering its procedures not inconsistent with provisions of the Borough Code and ordinances of the Borough; and in the absence of such adopted bylaws, rules and regulations, shall conduct its business in accordance with Robert's Rules of Order Revised.
B. 
The Commission shall hold regular meetings at such times and places as it may designate.
C. 
A quorum shall be a simple majority of sitting members, but no less than three.

The Recreation Commission shall supervise the public parks, playfields, and all outdoor and indoor recreation areas and facilities as deemed by the Borough Council, whether within or without the limits of the Borough. However, the Commission shall not have authority to establish, create, pass, or enforce any park rules; such authority is reserved to the Borough Council.
B. 
The Commission shall establish, plan, and coordinate recreation programs within the community, and shall work cooperatively with the Recreation Director, if one has been appointed by the Borough Council, to implement recreation programs as well as any guidance issued by the Borough Council.
C. 
The Commission shall periodically review current recreation programs and assess recreation facilities within the Borough to determine additional needs, and submit recommendations pertaining to recreation programs, facilities, guidelines, policies, or user fees to the Borough Council.
D. 
The Commission shall serve in an advisory capacity to the Borough Council on recreation-related matters, including long-term planning, funding and budgetary needs, and facility and program policies; further, the Commission shall review and provide recommendations on recreation-related matters submitted by the Borough Council.
E. 
The Commission shall promote community use of recreation facilities and community participation in recreation programs.
F. 
The Commission shall work to enhance the quality of life of citizens of New Freedom Borough by implementing and advertising a variety of recreation programs and services for all ages and abilities.
A. 
The Recreation Commission may accept any grant, gifts, bequest or donation of services, equipment, real estate or money from any individual or group to be used as specified by the donor or in accordance with the terms of acceptance upon approval of the Borough Council. However, the Recreation Commission shall have no authority to enter into any contract or incur any obligation binding upon the Borough, excepting in the instances of grants, gifts, bequests or donations as above specified; all obligations or contracts made on behalf of the Recreation Commission shall be fully executed within the then-current fiscal year and all within the budget appropriation made by the Borough Council.
B. 
The Commission shall recommend contracts for improvements to recreation facilities to the Borough Council for approval and funding by the Borough Council.
The Borough Council shall have the power to employ an Executive Director or Superintendent of Recreation, who possesses the necessary qualifications and who has demonstrated by actual work their ability to organize and direct a community recreation system, and supervise the activities of such other personnel as may be deemed necessary in carrying out the program.
Any funds appropriated by the Borough Council and budgeted to the Recreation Commission shall be disbursed by the fiscal disbursing officer of the Borough, upon vouchers issued by the proper Borough officers and within the budget appropriations made. Funds received by the Recreation Commission from sources other than budget appropriations shall be deposited by the Borough, to the credit and for the use of the Commission and disbursed as the above budget funds are disbursed, except that funds received by gift, bequest, or otherwise shall be disbursed in accordance with the terms of such gift or bequest, or the terms of the acceptance thereof upon approval of the Borough Council.
A. 
The Recreation Commission shall make full and complete reports to the Borough Council at such times as may be designated or requested by the Borough Council.
B. 
The fiscal year of said Recreation Commission shall conform to that of the Borough.
