It is the policy of the City of Linwood to promote and protect the health if its employees, residents and public by enacting a non-smoking policy that will cover all buildings and jurisdiction under the direction of the City. To that end, all City-owned buildings shall be smoke free. Smoking shall be prohibited in all interior portions of City-owned or -leased facilities, inclusive of private offices and City vehicles.

Department heads shall inform employees of this policy.
2. 
All department heads shall have copies in their Personnel Policies and Procedures Manual, post the policy, and provide copies to employees upon request.
3. 
Departments Heads shall have the right to withhold services of their department to any resident or member of the public who continues to smoke after having been informed first about the no smoking status of the buildings.
4. 
The Police Department is designated as the agency responsible to enforce this policy with the public.
5. 
The Police Department official engaged in enforcing this policy may order any person smoking in violation to comply with its provisions.
Disciplinary action is an appropriate step for supervisors to initiate if any employee violates the stated policy. For continuity, all disciplinary actions shall be progressive and discussed first with the City Administrator prior to any action by the Department.

Smoking is defined as the burning of a lighted cigar, cigarette, pipe, and/or any other matter of substance that contains tobacco.
2. 
Smoking area is that location(s) on the exterior of the building where employees can smoke and will have access to ashtrays.
3. 
In the event of an employee complaint, the employee may contact the department head in writing.
4. 
If the complaint remains unsettled; the City Administrator shall meet with all parties to resolve the issue.
5. 
Areas where smoking is prohibited or permitted shall be so designated by the appropriate sign. If no sign is posted, smoking is prohibited except as outlined in Point B of this policy. Posting of all required signage shall be the responsibility of the Department of Public Works.
