As used in this chapter, the following terms shall have the meanings indicated:
MARLBORO FARMERS MARKET
Farmers market operated by the Township of Marlboro and located at 444 Route 520, Marlboro, New Jersey.
An approved application in a form to be determined by the Business Administrator is required in order to participate as a vendor at the Marlboro Farmers Market. The application shall include but not be limited to the following elements:
A. 
In-person, mail or online registration through the Township's website.
B. 
Applicant waiver/indemnification and hold-harmless agreement.
C. 
Proof of insurance.
D. 
Applicant "producer" agreement.
E. 
The applicant must furnish a certificate of insurance (ACORD 25) providing evidence of general liability limits including bodily injury and property damage as follows: $300,000 per occurrence for an individual; $500,000 per occurrence for a charitable organization; $1,000,000 per occurrence for any commercial applicant. Any corporation must also include evidence of workers compensation - statutory limits and employers' liability minimum of $300,000 per accident/$300,000 per employee/$300,000 policy limit.
F. 
Applications shall be approved in the sole discretion of Township, based upon the availability of space and other factors to be determined by the Business Administrator.
A. 
Vendors shall be responsible for a market registration fee.
(1) 
Prepaid seasonal rate: Not to exceed $500.
(2) 
Prepaid daily rate: Not to exceed $50.
B. 
The registration fee is independent of any license or permit fees required by fire or health officials which shall be the responsibility of the vendor.
C. 
No discounts pursuant to Chapter 24 of the Code of the Township of Marlboro shall be applicable.
A. 
Rules and regulations shall be determined by the Business Administrator for the operation of the farmers market.
B. 
Rules and regulations shall be included in the application for vendor registration and strictly enforced.
Any person submitting or who knowingly provides false or misleading information will be subject to immediate removal from all programs or facilities, and forfeit any and all fees paid. Such person shall also be subject to the penalties provided in § 169-6 of this chapter.
Violations of the provisions of this chapter shall be punishable as provided in § 4-3 of the Code.
