The following words, terms and phrases, when used in this article,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
BICYCLE
A device propelled by human power upon which a person may
ride, having either two or three wheels in a tandem or tricycle arrangement;
provided, however, that a front-wheel drive power-assisted device
having construction substantially similar to a bicycle shall be considered
a bicycle.
MOPED
A two- or three-wheeled vehicle with operable pedals which
is equipped with a motor that does not exceed 50 cubic centimeters
piston displacement, produces 1.5 brake horsepower or less, and cannot
propel the vehicle at a speed greater than 25 miles per hour on a
level surface; provided, however, that the term "moped" shall not
include a front-wheel drive power-assisted bicycle.
MOTORCYCLE
A motor vehicle having a saddle or seat for the use of a
rider and designed to travel on not more than three wheels in contact
with the ground.
SIDEWALK or PEDESTRIAN PATHWAY
That portion of a street right-of-way and adjacent easements
which is constructed and paved separate from the paved street surface
and which is for the use of pedestrians, bicycles and other uses specifically
authorized by this article; also that portion of the paved street
surface which is striped or otherwise marked as being intended for
the use of pedestrians, bicycles and other uses specifically authorized
by this article.
SNOWMOBILE
A motor-driven vehicle designed for travel primarily on snow
or ice of a type which utilizes sled-type runners or skis, or an endless
belt tread, or any combination of these or other similar means of
contact with the surface upon which it is operated.
VEHICLE
A device in, upon or by which any person or property is or
may be transported or drawn upon a street, excepting devices exclusively
moved by human power.
No person shall operate a snowmobile, motorcycle, moped or other
motor vehicle upon any sidewalk or pedestrian pathway within the Village.
However, this section shall not be construed to prohibit the use of
sidewalks and pedestrian pathways by pedestrians or persons using
motorized wheelchairs, non-motorized bicycles, Class I or Class II
electric bicycles, or motorized scooters.
No person shall operate a permitted motorized device, as identified in §
326-25, on a sidewalk or pedestrian pathway at a speed greater than is reasonable and prudent under the conditions then existing. A person operating a bicycle on a sidewalk or pedestrian pathways shall yield the right-of-way to motor vehicles that are crossing the sidewalk or pedestrian pathways and to a pedestrian and shall give an audible signal before overtaking and passing a pedestrian.
Any person who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of this article shall be responsible for a municipal civil infraction, subject to §
1-2. Increased civil finds may be imposed for "repeated violations," which means a second or subsequent municipal civil infraction violation committed by a person within any twelve-month period and for which a person admits responsibility or is determined to be responsible. The increased civil fine for repeat violations is set forth in §
1-2.
