A. 
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Narberth, Montgomery County, Pennsylvania.
BOROUGH MANAGER
The appointed Manager of the Borough of Narberth or the Borough Manager's designee to address the relevant matter under this chapter.
PROPERTY OWNER
A person, entity, or association that is the legal landowner of a property, all tenants or occupants of an occupied property, and/or the owners, agents, or landowner of record in charge of unoccupied properties.
B. 
Any terms not herein defined shall have the meanings given to them in the Narberth Borough Code or, if not defined therein, in the Narberth Borough Code, Chapter 394, Property Maintenance, unless the context plainly requires another meaning.
A. 
The allowance, permitting, or causing of snow or ice to lie upon, remain upon, or be piled or accumulated upon the sidewalks of the Borough shall constitute a public nuisance.
B. 
It shall be the duty of all property owners with properties abutting public streets in the Borough of Narberth, to clear or cause to be cleared a pathway in the sidewalks fronting their respective properties in accordance with the guidelines of the Americans with Disabilities Act of 1990, as amended, not later than 12 hours after snow, ice, or sleet has ceased to fall. The pathway shall be not less than 36 inches (three feet) in width and shall be thoroughly cleared of snow and ice. However, snow, ice, or sleet that has ceased to fall after 6:00 p.m. of any evening may be removed at any time before 10:00 a.m. of the next morning. Should the snow and ice on the sidewalk be frozen so that it cannot be removed without injury to the pavement, the sidewalk shall be strewn with sand, ashes, sawdust, salt or similar abrasive materials to ensure the hazard posed by such snow or ice is remediated and a pathway is clear.
C. 
Snow and ice must also be removed in the manner under Subsection B above from the portion of any sidewalks leading to streets adjacent to corner properties and any portions of the sidewalk leading to a mid-block crosswalk, including the clearing of ramps. Snow shall be sufficiently cleared around any fire hydrant or drain located along the street or sidewalk abutting the property owner's property to provide for the proper functioning and access to such fire hydrant or drain.
D. 
Snow is unavoidably pushed onto sidewalks and driveways or other curb openings because of snowplow operations by the Borough or ongoing pedestrian traffic. Should snow or ice reaccumulate on the sidewalk or sidewalks of any property in the Borough due to plowing operations, pedestrian traffic, or for any other reason, it is the responsibility of the property owner to again see to its removal and clearance in accordance with Subsection B above.
E. 
Snow or ice removed from sidewalk areas must be placed on the property owner's property from which it was removed. If there is an excessive amount of snow or ice, and there is no longer any place on the property to deposit the snow or ice, then it may be placed along the property side of the curb line.
F. 
It is hereby declared a public nuisance for any property owner or contractor or agent of a property owner to shovel, plow, throw or deposit snow or ice into or upon a public street road, right-of-way, parking space, sidewalk or other private property in the Borough in a manner which allows the snow to remain on such street or to throw or pile any snow upon any fire hydrant, drain, or public trash can or bench.
In the event that any property owner fails, neglects, or refuses to comply with the provisions of § 446-2 within the time limit prescribed, the Borough may proceed immediately to clear or treat all snow and/or ice from the sidewalks or other designated areas with such costs chargeable to the property owner at the then-current rates prevailing for labor and materials plus an additional 10%, together with all charges and expenses. The Borough may file a municipal lien against the property in violation if such costs and expenses are not thereafter paid within 30 days, with any additional costs or expenses to file such lien also payable by the property owner, and/or the Borough may pursue civil proceedings to collect the same. The removal of snow or ice or the covering of ice by the Borough shall in no manner relieve the property owner from the imposition of penalties as herein provided.
