A. 
Definitions. As used in this Chapter, the following terms shall have the meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
Any motorized vehicle manufactured and used exclusively for off-highway use, with an unladen dry weight of one thousand five hundred (1,500) pounds or less, traveling on four (4) or more non-highway tires, with either:
a. 
A seat designed to be straddled by the operator, and handlebars for steering control, but excluding an electric bicycle; or
b. 
A width of fifty (50) inches or less, measured from outside of tire rim to outside of tire rim, regardless of seating or steering arrangement.
B. 
Permits are authorized under Section 304.013, RSMo., shall be issued upon payment of fifteen dollars ($15.00), subject to the following requirements:
1. 
All applicants shall be at least sixteen (16) years of age at time of application.
2. 
All applicants shall have a valid Missouri Driver's License and present same to the City Clerk as proof at the time of application.
3. 
Applicants and ATVs must meet all other requirements pursuant to State and Federal law.
4. 
Applicant must be able to show proof of current liability insurance for the ATV being operated, and at all times vehicle is in use. Failure to maintain such liability insurance renders the permit issued null and void.
5. 
The ATV, if permitted, shall display the permit at all times the ATV is operated on any Seymour street or road; it will be attached to the ATV in a conspicuous location, on the exterior of the rear of the utility vehicle, so that it may be identified without obstruction.
6. 
Applicant automatically forfeits the permit upon conviction in any court of this State for violation of any law involving operation, while intoxicated, of any motor vehicle.
7. 
Permits issued will be valid for the calendar year in which it was issued, thereafter, the applicant must seek a renewal of the permit on the same terms set forth herein. The applicant shall pay as many twelfths (12ths) as there are months (part of a month counted as a month) remaining from the date of the license to the next succeeding January first (1st).
8. 
A permit is only issued for a specific ATV, as identified by the applicant's application, and can only be used for that ATV. A permit is not transferable or assignable.

A. 
Every all-terrain vehicle permitted, shall have the following equipment:
1. 
A lighted headlamp and tail lamp which shall be in operation at any time in which a utility vehicle is being used on any street or highway.
2. 
An equilateral triangular emblem, to be mounted on the rear of such vehicle at least two (2) feet above the roadway when such vehicle is operated upon any street. The emblem shall be constructed of substantial material with a fluorescent yellow-orange finish and a reflective, red border at least one (1) inch in width. Each side of the emblem shall measure at least ten (10) inches.
3. 
A bicycle safety flag, which extends not less than seven (7) feet above the ground, attached to the rear of the vehicle. The bicycle safety flag shall be triangular in shape with an area of not less than thirty (30) square inches and shall be day-glow in color.
4. 
A braking system maintained in good operating condition.
5. 
An adequate muffler system in good working condition.

A. 
Every individual who operates a properly permitted ATV, as defined herein, shall operate such vehicle following the operation rules listed in this Chapter.
Operation Rules:
1. 
Must be operated within the stated legal speed limit on the street, road or alley, within the City of Seymour, not to exceed thirty (30) miles per hour.
2. 
Must be operated with recognized courtesy and acknowledgement of other vehicles traveling the streets, roads and alleys within the City of Seymour.
3. 
ATVs may not operate on U.S. Highway 60.
4. 
No ATV may be operated on the streets, roads, alleys within the City of Seymour, between the hours of 12:00 a.m. and 6:00 a.m.
5. 
Must be operated with a securely fastened safety helmet on the head of the individual operating the ATV, unless the individual is at least eighteen (18) years of age.
6. 
May not be operated in any careless way so as to endanger the person or property of another.
7. 
May not be operated while under the influence of alcohol or any controlled substance.
8. 
No permitted operator of an ATV shall carry a passenger.
