As used in this article, the following terms shall have the meanings indicated:
FLUID MILK PRODUCTS
Cream, sour cream, vitaminized milk, buttermilk, cultured buttermilk, skimmed milk, homogenized milk, milk beverages, cream beverages, skimmed milk beverages and all other beverages containing in whole or in part milk or cream.
MILK
The lacteal secretion obtained by the complete milking of one or more healthy mammals properly fed and kept, excluding that obtained within 15 days before and five days after calving, kidding, or giving birth or such other period as may be necessary to render the milk practically colostrum free.
No person shall sell or deliver or have in possession for sale or delivery in the Borough any milk or fluid milk products without obtaining first from this Board a license for such sale or delivery.
A fee of $35 shall be paid for each license required by this article.
A. 
The sale of loose milk or fluid milk products or the use of milk pumps or other mechanical devices for the retail dispensing of milk or fluid milk products is prohibited unless such device is approved by this Board. All milk or fluid milk products shall be placed in final delivery containers in the plant in which they are pasteurized. It shall be unlawful for any person to sell or serve any milk or fluid milk products except in the original container in which they were received from the producer or distributor, provided that milk or fluid milk products may be dispensed for coffee, tea, and similar beverages and as an ingredient in the serving of desserts and salads from devices approved by this Board.
B. 
No milk or fluid milk products shall be sold or delivered in the Borough unless the same have been pasteurized; provided, however, that nothing in this chapter shall prohibit the sale of delivery of certified raw milk.
The requirements concerning the sale, production and handling of certified milk shall be governed by N.J.S.A. 24:10-74,[1] its amendments, and supplements, which are made a part of this article as though incorporated herein and set out at length.
