A. 
Every person, whether he be owner, tenant, or occupant of any dwelling house other than an apartment house, shall cause all garbage, swill, and offal to be removed from the premises at least once every week.
B. 
Every owner, lessor or agent of any building which is a tenement house within the meaning of the Tenement House Act shall provide and maintain therein for the use of the tenant's proper receptacle for the storage of garbage and shall remove same from the premises as often as is required.
C. 
Every proprietor of any hotel, restaurant, boarding house, store, market, or other establishment where food for human or animal consumption is manufactured, prepared, handled, sold, or served shall cause to be removed from the premises as often as necessary or as directed by this Board all garbage and other waste matter which may accumulate thereon. All garbage and waste matter shall, while on the premises, be stored in such a manner as not to create a nuisance.
D. 
All refuse containers, including, but not limited to, cans, containers and compactors, shall be located consistent with the site plan approved by the Board of Adjustment or Planning Board, or if premises were not the subject of a site plan which addressed refuse containers, then refuse containers shall be located on the premises, prior to disposal, in a place which is least obtrusive, as determined by the Superintendent of Highways, to the public and adjoining property owners.
E. 
The owner, agent, lessee, tenant, or occupant of every dwelling or other premises in the Borough must provide and keep on such premises sufficient and suitable receptacles with tight-fitting covers for receiving and holding refuse materials. However, if the structure contains three or more dwelling units, the tenant or occupant shall not be responsible.
F. 
The use of paper bags and cardboard boxes and plastic bags as receptacles for refuse is strictly prohibited.
A. 
All garbage which may accumulate in the Borough, or which may be stored, kept, or maintained therein without violating this article shall be kept in watertight metal or plastic receptacles provided with tightly fitting covers, except that barrels may be used for vegetable trimmings if removed daily. Said metal or plastic receptacles shall be kept clean, and no water shall be allowed to enter therein except for the purpose of cleaning. No garbage shall be burned at any time. Watertight metal or plastic receptacles shall not include plastic bags.
B. 
Automated trash collection.
(1) 
In collection districts designated by the Public Works Division to receive automated trash collection, the garbage, offal, refuse and waste as provided in this section shall be placed in Borough-issued receptacles. Receptacles shall be placed at the edge of the roadway at the curb with the front facing the street. The receptacles shall be placed free from obstruction of any type as to interfere with the operation of the system as designed or obstruct the lifting and dumping of the receptacle by the truck operator. The receptacle shall not exceed 300 pounds when filled.
(2) 
Additional automated receptacle fee. There shall be a fee of $75 charged for the rental of one additional Borough-issued receptacle per residential unit. The receptacle shall at all times remain the property of the Borough and shall stay with the property in the event the owner/lessee of that property moves and/or sells their home. In the event the owner of the property sells their home, it is the responsibility of the seller to ensure that the receptacle remains with that property. If said receptacle is removed or otherwise damaged, the fee to replace it shall be $75.
C. 
Pickup.
(1) 
Residents of the Borough of Roselle shall place garbage at the curb for pickup.
(a) 
It shall be unlawful for any person to place or cause to be placed to permit to remain any receptacle containing refuse material earlier than 8:00 p.m. on the day prior to that premises' regular collection day as established by the Council and the Superintendent of Highways.
(b) 
Any person obtaining a permit to renovate, repair, demolish or construct any structure shall provide for the private collection and disposal of all debris resulting from the renovation or construction so permitted. Municipal collection will not be provided for any refuse or debris resulting from any such permitted activity except with respect to concrete or cement steps or sidewalks which have been removed by the homeowner or member of his family. Placing contents and debris from construction into the trash receptacle shall be a violation of this chapter and punishable by the fines set forth below.
(c) 
It shall be unlawful to fill a dumpster higher than three inches below the top.
(d) 
It shall be unlawful for any person to place, or cause to be placed, in any location beyond the front setback, any bulk items or material earlier than 8:00 a.m. on the day prior to that premise's regular collection day established by the Superintendent of Public Works.
(2) 
Any person or entity violating any of the provisions of this article shall be subject to fines as follows:
(a) 
First offense: $250.
(b) 
Second offense: $500.
(c) 
Third offense: $1,500 or imprisonment for a term not exceeding 90 days, or both.
(d) 
Each violation of any of the provisions of this article and each day that same is violated shall be deemed and taken to be a separate and distinct offense.
(3) 
This article shall be enforced by the Health Inspector, Property Code Enforcement Officer or their designee or the Roselle Police Department.
All carts and vehicles used for the removal of ashes, rubbish, garbage, refuse or other substance shall be strongly and tightly constructed so that the contents of said vehicle cannot escape from same. All wastepaper shall be placed in bags or packages so as to prevent the escape thereof.
No person shall permit any wagon or vehicle used for the collection or removal of garbage, swill, offal, or other substance to stand in the streets or other public places within the limits of this Borough at any time, except when being loaded.
No person shall permit any garbage, swill, offal, or other substance collected or removed under the provisions of this article to remain or be disposed of within the limits of this Borough except by written consent of this Board.
