The provisions of this chapter imposing regulation of parking
shall not relieve any person of the duty to observe other and more
restrictive provisions prohibiting or limiting the stopping, standing
or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other
New Jersey statute or as herein provided.

(b) Any unoccupied vehicle parked or standing in violation of this article
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any peace officer may provide for the removal of such
vehicle. The owner shall pay the reasonable costs of the removal and
storage which may result from such removal, before regaining possession
of the vehicle.
(c) All-night parking restriction. No person shall park a commercial
motor vehicle, trailer, semitrailer or pole trailer, as defined by
N.J.S.A. 39:1-1 et seq., between the hours of 12:00 midnight and 6:00
a.m., prevailing time, on any street in the Borough of Morris Plains;
provided, however, that the Chief of Police or his designee may grant
permission for the overnight parking of a such vehicle, trailer, semitrailer
or pole trailer due to an emergent situation; provided, further, that
this prohibition shall not apply to pickup trucks or passenger minivans
parked on Allen Place, Carlyle Avenue, Concord Place, Diana Road,
Maple Avenue or Sunset Road during the hours of said restriction.

(a) The parking
of all commercial vehicles and commercial equipment, as hereinafter
defined, which are being used to provide a private service within
the Borough shall be prohibited from parking on any street between
the hours of 6:00 p.m. to 6:00 a.m. in all residential zones. Residential
zones shall include the R-1, R-2, R-3, R-4, R-5, R-6, R-7 and R-8
zones.
(1) For
purposes of this article, "commercial vehicle" shall be defined as
follows:
(i)
Any truck, being any motor vehicle designed and used or maintained
primarily for the transport of property.
(ii)
Any van or pickup truck bearing commercial license plates or
having any sign, lettering or other indicia indicating that the vehicle
is maintained for business or commercial purposes.
(vi)
All dump trucks regardless of size.
(vii)
All non-passenger vehicles and/or equipment or machinery, including,
but not limited to, construction vehicles and equipment.
(2) For purposes of this article, "commercial equipment" shall be defined
as "any construction equipment or large equipment used primarily in
the course of conducting a trade or business." Examples of commercial
equipment shall include, but not be limited to, excavators, backhoes,
rollers, pavers and equipment commonly used for landscaping purposes.
(b) Municipal vehicles exempted.
(1) Exempt from the provisions of this article are any motor vehicles
owned or operated by the Borough of Morris Plains or any agency or
department thereof.
(2) Also exempt from the provisions of this article shall be any commercial
vehicle that is providing a service to the Borough at the Borough's
request.
(c) Violations
and penalties.
(1) Any person found guilty of violating this article of the Code of
the Borough of Morris Plains shall be subject to a penalty consisting
of a fine, the maximum of which shall be the maximum fine permitted
to be imposed by the court having jurisdiction over the violation
of this article of the Code of the Borough of Morris Plains; provided,
however, that the fine shall not be less than $500 nor more than $2,000
per offense.
(2) In the event of a continuing violation, each day shall constitute
a separate offense.
(3) Each vehicle which is parked in contravention of the provisions of
this article shall constitute a separate offense.
(4) The provisions of this article shall be enforced by the Borough's
Police Department and the Borough's Zoning Official.
(5) In the event that any commercial vehicle or equipment that is in
violation of the provisions of this article shall remain parked for
a period of seventy-two (72) hours in the residential zone, it shall
be towed by the Borough at the owner's expense.
(6) No commercial vehicle or commercial equipment shall be deemed to
be in violation of the provisions of this article if the commercial
vehicle or commercial equipment is reported to the Borough's Police
Department as being inoperable, and is removed from the residential
zone within twenty-four (24) hours by the owner.
(7) Any commercial vehicle or commercial equipment that is not registered,
or whose owner is otherwise unidentifiable, which shall remain parked
in any residential zone for a period of thirty-six (36) hours, shall
be removed by the Borough.
(8) Commercial vehicles and equipment that are servicing utilities within
the Borough are exempt from the provisions of this act unless the
vehicle or equipment has been parked for more than five (5) days.
(d) All other parts, portions and provisions of the Borough of Morris
Plains Code, be and the same, are hereby ratified and confirmed, except
where inconsistent with the terms hereof. In the event of any such
inconsistency, the terms of this section shall be deemed to govern.

RESIDENT PARKING EXEMPTIONS.
(a) Exemption. Noncommercial motor vehicles owned and operated on a regular
basis by residents of the following streets shall be exempt from the
one-hour, two-hour, three-hour and six-hour time limit parking restrictions
set forth in Section 22-12, provided the said vehicles display a current
resident parking sticker, are parked on the street where the sticker
holder resides, and are otherwise in compliance with this section,
and provided further that no such vehicle remains parked in one location
more than 48 hours.

(b) Administration. Applications for resident parking stickers pursuant
to this section shall be made in writing using the application provided
by the Borough Clerk and stickers shall be issued to residents on
the following terms and conditions:
(1) Persons who are residents of the streets listed in Paragraph (a)
above shall be eligible for resident parking stickers for a maximum
of two noncommercial motor vehicles owned or principally operated
by persons residing at that street address, upon presentation of proof
of residence and payment of the appropriate resident parking sticker
fee. Proof of residence shall consist of the New Jersey Motor Vehicle
registration for the noncommercial vehicle to be issued a resident
parking sticker.
(2) Each resident parking sticker shall be valid for one calendar year
or until residency on said street is terminated, whichever first occurs.
(3) A resident parking sticker shall be valid only to whom issued and
to the vehicles specified on the application and shall not be transferable
to another person or vehicle. Upon termination of the residency, the
person holding a resident parking sticker shall surrender same to
the Borough Clerk's office.
(4) A properly displayed sticker shall constitute authorization to park
the vehicle for an unlimited period of time in any one-hour, two-hour,
three-hour or six-hour time limit parking areas on the street for
which the exemption sticker was issued, except when emergency or snow
removal restrictions are in effect, and provided further that such
vehicles shall not be parked in one location for more than 48 hours.
(5) The resident parking sticker fee shall be the fee set forth in the
Fee Schedule of the Borough of Morris Plains, Section 2-46 of the
Revision.
(6) It shall be unlawful and a violation of this Section for any person
to represent that he/she is entitled to resident parking exemption
when he/she is no longer entitled, to fail to surrender a resident
parking sticker to which he/she is no longer entitled, or to park
a vehicle displaying such a parking sticker at any time when the holder
of the sticker or the vehicle is not so entitled.

(a) Exemption. Motor vehicles operated on a regular basis by owners or
employees of businesses with a street address fronting on the following
streets shall be exempt from the three-hour time limit parking restrictions
set forth in Section 22-12 of the Revised Ordinances, provided the
said vehicles display a current business parking sticker and are otherwise
in compliance with this section, and provided further that no such
vehicle remains parked in one location more than 12 consecutive hours:
(b) Administration. Applications for business parking stickers pursuant
to this section shall be made, in writing, on forms provided by the
Borough Clerk and stickers shall be issued to owners and employees
of businesses on the following terms and conditions:
(1) A maximum of 32 business parking stickers shall be issued annually.
Persons who are owners or employees of businesses with a street address
fronting on the streets listed in Paragraph (a) above shall be eligible
for business parking stickers on a first-come-first-served basis,
upon presentation of proof of eligibility and payment of the appropriate
business parking sticker fee. Proof of eligibility shall consist of
either proof of ownership of a business with a street address fronting
on an eligible street or, in the case of an employee of a business
with a street address fronting on an eligible street, a verification
of employment letter on the letterhead of the business, signed by
the owner of the business with a street address fronting on an eligible
street, to be issued a business parking sticker.
(2) Each business parking sticker shall be valid for one calendar year,
or until the business is no longer located on said street, or, in
the case of an employee, the employee's employment by said business
is terminated, whichever first occurs.
(3) A business parking sticker shall be valid only to whom issued. Upon
termination as outlined in Paragraph (b)(2) above, any and all persons
holding a business parking sticker shall surrender same to the Borough
Clerk's office.
(4) A properly displayed sticker shall constitute authorization to park
the vehicle for an unlimited period of time in any three-hour time
limit parking space on the street for which the exemption sticker
was issued, except when emergency or snow removal restrictions are
in effect and provided further that such vehicles shall not be parked
in one location for more than 12 hours.
(5) The business parking sticker fee shall be the fee set forth in the
Fee Schedule of the Borough of Morris Plains, Section 2-46 of the
Revision.
(6) It shall be unlawful and a violation of this section for any person
to represent he/she is entitled to a business parking exemption when
he/she is not so entitled, to fail to surrender a business parking
sticker to which he/she is no longer entitled, or to park a vehicle
displaying such a parking sticker at any time when the holder of the
sticker, or the vehicle, is not so entitled.
