As used in this article, the following terms shall have the meaning indicated, unless a different meaning clearly appears from the context:
ANIMAL AT-LARGE
Any animal being upon any public highway, street, alley, cartway, park or any other public land, or upon property of another person other than the owner, and not being accompanied by or under the control of the owner or any other person having custody of said animal.
ANIMAL OWNER
When applied to the proprietorship of an animal, the term "owner" includes every person having the right of property to such animal and every person who keeps or harbors such animal or has it in his/her care, and every person who permits such animal to remain on or about any premises occupied by him/her.
The police officers of the Borough of Milton shall have the responsibility for the enforcement of this chapter of the Code of Ordinances Borough of Milton and the Dog Laws, 3 P.S. 459-101 et seq.
It shall be unlawful for the owner of any animal(s) to allow or permit such animal(s) to run at large in the Borough of Milton.
It shall be unlawful for the owner of any animal(s) to allow or permit such animal(s) to run at large within any Borough-owned fenced-in areas (i.e., baseball fields at Brown Ave Park).
Any police officer may seize an animal found running at large in the Borough of Milton. Such animals are to be impounded in a licensed kennel, located at 685 Cherry Street.
Per the established memorandum of understanding (MOU, dated 04/15/2020), 4 Paws Sake, the licensed kennel operator, shall cause and give notice by personal service or registered or certified mail, with return receipt requested, to the last known address, which shall be set forth in the license application or the permanent identification records of the person whose name the license and/or permanent identification was procured, or his agent, to claim the dog within five days after receipt thereof. If after five days of obtaining the postal return receipt, the dog has not been claimed, 4 Paws Sake shall dispense the dog by sale (or adoption) or giving it to the humane society or association for the prevention of cruelty to animals.
Per the established MOU, 4 Paws Sake, the licensed kennel operator, shall detain any unlicensed dog lacking proper permanent identification for 48 hours. Any dog remaining unclaimed after 48 hours may be humanly killed or given to a humane society or association for the prevention of cruelty to animals.
A. 
A dog determined to be dangerous under § 502-A of the Dog Law, 3 P.S. 459-502A, shall be restrained or otherwise kept in accordance with Article VI-A of the Dog Law, 3 P.S. 459-501-A, et seq.
B. 
Dogs may be killed only in accordance with the requirements of § 501 of the Dog Law, 3 P.S. §§ 459-501, and otherwise, said dog(s) must be detained and delivered to the police or a state dog warden. While detained, said dog must be treated in humane manner.
