All prospective employees of the Town of Babylon shall be fingerprinted
so that the Town may obtain a criminal history report from the New
York State Division of Criminal Justice Services (DCJS). Each prospective
employee shall submit proof that he or she has been electronically
fingerprinted through a DCJS-approved statewide Vendor-Managed Civil
Fingerprint Capture System.
The Commissioner of Public Safety or his or her designee shall
gather and review all information provided by DCJS in connection with
a prospective employee's criminal history and provide a report
to the Town Attorney in that regard.
If any prospective employee has been convicted of a felony and/or
misdemeanor, the decision regarding his or her fitness for the position
sought shall be made by the Town Attorney using the factors set forth
in Article 23-a of the New York State Correction Law.
