CODE ENFORCEMENT OFFICER
A person who is employed by the City of Albany Department of Buildings and Regulatory Compliance and whose job duties entail either the inspection of buildings for, or the enforcement of compliance with the City Code, New York State Uniform Fire Prevention and Building Code, Housing Code, Plumbing Code, Electrical Code, Mechanical Code, and/or any other applicable codes such codes.
DGS WORKER
A person employed by the City of Albany Department of General Services with the job title of "Laborer 1," "Laborer 2," "Laborer 3," "Supervisor," and/or "Division Foreperson."
PUBLIC SERVICE OFFICER
A person employed by the Albany Parking Authority with the job title "Public Service Officer or Public Service Officer Supervisor."
TRAFFIC SAFETY AIDE
A person employed by the Albany Parking Authority with the job title "Traffic Safety Aide."
A. 
A person is guilty of harassment of a code enforcement officer, DGS worker, public service officer, or traffic safety aide when, with intent to harass, annoy, or alarm a code enforcement officer, public service officer, or traffic safety aide engaged in the performance of their duties as a code enforcement officer, public service officer, or traffic safety aide, such person:
(1) 
Strikes, shoves, kicks, or otherwise subjects a code enforcement officer, DGS worker, public service officer, or traffic safety aide to physical contact or attempts or threatens to do the same; or
(2) 
Engages in a course of conduct or repeatedly commits acts which alarm or seriously annoy a code enforcement officer, DGS worker, public service officer, or traffic safety aide and which service no legitimate purpose. Nothing in this subsection shall be construed to apply to activities which are regulated by the National Labor Relations Act[1], as amended, the Railway Labor Act[2], as amended, or the Federal Employment Labor Management Act[3], as amended.

B. 
A violation of subsection A of this section shall be a class B misdemeanor.
