The office of City Administrator of the City is hereby created and established. The City Administrator shall be appointed by the Mayor with approval of the Board of Aldermen on the basis of his or her administrative and executive ability and qualifications and shall hold office during the pleasure of the Mayor and Board of Aldermen.

The City Administrator shall be the executive assistant to the Mayor and shall report to the Mayor on occasion to keep the Mayor updated on all City business.

No person elected as member of the Board of Aldermen of the City shall, subsequent to such election, be eligible for appointment as City Administrator until at least one (1) year has elapsed after such Board member shall have ceased to be a member of the Board of Aldermen. A Board member, while still in office, may not be appointed as City Administrator.

The City Administrator shall furnish a corporate surety bond to be approved by the Board of Aldermen in such sum as may be determined by the Board of Aldermen and which shall be conditioned upon the faithful performance of the duties imposed upon the City Administrator as herein prescribed. The premium for such bond shall be a proper charge against and shall be paid by the City.

The City Administrator may appoint, subject to the approval of the Mayor and Board of Aldermen, one (1) of the other officers or department heads of the City to serve as City Administrator pro tempore during any temporary absence or disability of the City Administrator. In case of the temporary absence or disability of the City Administrator and his failure to so appoint a City Administrator pro tempore, the Mayor and Board of Aldermen shall designate some qualified City employee to perform the duties of the City Administrator during the period of temporary absence or disability of the City Administrator. Said employee shall furnish a corporate surety bond as provided in Section 115.280 of this Chapter.

A. 
The City Administrator shall receive compensation from the City from time to time determined by resolution.

The City Administrator shall be reimbursed for all sums necessarily paid or debts necessarily incurred by him or her in the performance of his or her duties, or sums paid or debts incurred when traveling on business pertaining to the City pursuant to the direction of the Board of Aldermen; reimbursement shall be made, however, only when an itemized claim-setting forth the sums expended and debts incurred for which reimbursement is requested has been presented and approved by the Board of Aldermen.

The City Administrator shall be considered a salaried exempt employee. No overtime pay is authorized, unless special circumstances are approved in advance by the Board of Aldermen. The City Administrator shall be off work with pay during all City approved holidays and does not have a set schedule.

The City Administrator shall be the administrative head of the government of the City under the direction and control of the Mayor and Board of Aldermen except as otherwise provided in this Chapter. He or she shall be responsible for the efficient administration of the affairs of the City which are under his or her control.

It shall be the duty of the City Administrator to attend all meetings of the Board of Aldermen, except when his or her removal is under consideration.

The City Administrator may attend all meetings of the Planning Commission and any other commission, board or committee hereafter created by the Board of Aldermen, upon his or her own volition or upon direction of the Board of Aldermen. At such meetings the City Administrator shall be heard by such commissions, boards or committees as to all matters upon which he or she wishes to address the members thereof, and he or she shall inform the members as to the status of any matter being considered by the Board of Aldermen and he or she shall cooperate with the members of all commissions, boards or committees appointed by the Mayor and Board of Aldermen to the fullest extent consistent with his or her other duties.

It shall be the duty of the City Administrator to recommend to the Board of Aldermen such reorganization of offices, positions, departments or units under his or her direction as may be in the interest of efficient, effective and economical conduct of the City's business.

It shall be the duty of the City Administrator and he or she shall have the authority to control and give directions to all heads of departments and to subordinate officers and employees of the City under his or her jurisdiction through their department heads.

It shall be the duty of the City Administrator to see that all laws and ordinances of the City are enforced and to see that all franchises, licenses and permits granted by the City and contracts entered into by the City are faithfully performed and observed.

It shall be the duty of the City Administrator to make investigations into the affairs of the City and all departments and divisions thereof, to investigate contracts to which the City is a party, and to investigate the performance of obligations of and to the City.

It shall be the duty of the City Administrator to recommend to the Board of Aldermen for adoption such resolutions and ordinances as he or she deems necessary or expedient.

It shall be the duty of the City Administrator to keep the Board of Aldermen at all times fully advised with respect to the financial condition and needs of the City. The City Treasurer shall provide all financial reports to the City Administrator on a weekly basis.

It shall be the duty of the City Administrator to prepare and submit a proposed annual budget and a proposed annual salary plan to the Board of Aldermen for its review and approval.

It shall be the duty of the City Administrator to purchase supplies for the City and for its departments and divisions of the City. All expenditures recommended to the Board of Aldermen shall be submitted through the City Administrator. The City Administrator may sign any contracts for the City when directed and approved by the Board of Aldermen.

The City Administrator shall be the Chief Personnel Officer of the City and shall have the power and authority to appoint, dismiss, promote and demote any officers and employees of the City except the City Attorney, elective officers, and members of appointed boards and commissions; without the necessity of approval of the Mayor or Board of Aldermen. This Section shall supersede any other City ordinance relating to personnel, except for such Rules and Regulations that the Board of Aldermen shall approve, in writing.

The Chief of Police may be appointed by the City Administrator, subject to the approval of the Mayor and Board of Aldermen, on the basis of his or her qualifications and abilities as may be required by State law for a Peace Officer. The City Administrator may also serve as the Chief of Police and at a salary which may be adjusted by the Board of Aldermen. Should the City Administrator be removed/terminated, it does not affect his or her position of Chief of Police.

It shall be the duty of the City Administrator to investigate all complaints relating to matters concerning the administration of the City government and all employees/officers.

It shall be the duty of the City Administrator to exercise general supervision over all public buildings, public parks and all other public property which is under the control and jurisdiction of the City.

It shall be the duty of the City Administrator to perform such other lawful functions and exercise such other powers as may be assigned to him from time to time by ordinance, resolution or other act of the Board of Aldermen.

The Board of Aldermen and its members shall deal with the administrative services of the City only through the City Administrator, except for the purpose of inquiry, and neither the Board of Aldermen nor any member thereof shall give orders to any subordinates of the City Administrator. The City Administrator shall take his orders and instructions from the Mayor and Board of Aldermen only when sitting in a duly held meeting of the Board of Aldermen, and no individual Board member shall give any orders or instructions to the City Administrator.

It shall be the duty of all subordinate officers, employees and the City Clerk, City Treasurer, City Attorney, City Clerk, Court Clerk, and City Police Chief to assist the City Administrator in administering the affairs of the City efficiently, economically and harmoniously to the extent consistent with their duties as prescribed by law and the ordinances of the City.

The City Administrator shall be removed from office only pursuant to a resolution of the Board of Aldermen. Said resolution must be approved by the affirmative vote of at least three members of the Board of Aldermen at a regular Council meeting. The Mayor may veto said vote, in which case all Board members must vote to remove the City Administrator. However, at least thirty (30) days prior to the vote by the Board of Aldermen upon a resolution for the removal of the City Administrator, the City Administrator shall be furnished with a written notice stating the Council's intention to vote upon his removal and the reasons therefor. Within seven (7) days after the delivery to the City Administrator of such notice, he may by written notification to the City Clerk request a hearing before the Board of Aldermen. Thereafter the Board of Aldermen shall fix a time for the hearing, which shall be held at the Council's usual meeting place before the expiration of the thirty-day period. The City Administrator may appear and be heard at said hearing, with or without counsel. After furnishing the City Administrator with written notice of intended removal, the Board of Aldermen may suspend him or her from office, but his or her compensation shall continue until his or her removal by resolution of the Council adopted at or subsequent to the aforesaid hearing. In removing the City Administrator, the Board of Aldermen shall use its uncontrolled discretion and its action shall be final and shall not depend upon any particular showing or degree of proof. If the City Administrator is also the Chief of Police, upon voting to remove the City Administrator; said vote does not remove him or her from the position of Chief of Police. Removal of the Chief of Police, shall be made in the same manner following general orders pertaining to the Chief of Police and following State law.
